Dear Mr. Ryan:
This letter is to inform you that the City of Prior Lake has approved your request to subdivide the
parcel located at 5290 Frost Point Circle SE into two parcels as shown on the survey received
December 31, 2003.
Please note that as part of the building permit application for the new dwelling on Parcel A, the
applicant will be required to provide the following information:
a. submit the required fees in the amount of $4,225.00. See attached
memorandum outlining required fees.
b. install sewer and water connections to Parcel A. Repair any damage to street
and boulevard as a result of the connection.
c. relocate existing driveway for Parcel B from Parcel A to Parcel B.
d. remove that portion of the existing retaining wall on Parcel B that encroaches into
Parcel A.
e. comply with relevant portions of the Floodplain Ordinance.
In order to implement this administrative land subdivision, all pertinent documents must be filed
with the Scott County Auditor's Office within sixty (60) days of the date of this approval letter.
Scott County requires that the City approve deeds creating new parcels or altering legal
descriptions before they will be accepted for recording. Please submit the original deeds to this
office and we will issue the necessary approvals. Copies of the recorded documents must be
submitted to the City as evidence that the administrative land subdivision has been filed.

Tracts C & D RLS #29 (PIN #25 060 004 0) is proposed to be subdivided into two (2) single
family lots. The property was initially served with sewer and water utilities in 1974 under Project
74-2. These lots were 100% assessed for frontage and trunk acreage charges. Under the original
assessment roll this parcel was assessed lateral front footage of 200' and a trunk acreage
assessment of .98 acres.
Since utilities are avail.able to the property site, the cost for the extension of services internally
will be the responsibility of the developer. In addition to these improvement costs, the
subdivision will be subject to the following City charges:
Park Dedication
Collector Street Fee
Stormwater Management Fee
$2670.00/unit
$1500.00/acre
$2943.00/acre
Parcel B would be exempt from these fees since an existing home is located on this parcel. The
remaining lot (Parcel B) would be subject to the application of these City charges which would
generate the following costs to the developer based upon a net lot area calculation of .35 acres as
provided within the site data summary sheet of the preliminary plat description:
Cash Park Dedication:
1 unit @ $2670.00/unit = $2,670.00
Collector Street Fee:
.35 acres @ $1500.00/ac = $525.00
Storm Water Manaeement Fee:
.35 acres @ $2943.00/ac. = $1,030.00
These charges represent an approximate cost of $4,225.00 for the newly created lot. Assuming
the initial net lot area of the plat does not change, the above referenced park dedication, collector
street and storm water charges would be determined and collected at the time of approval.
There are no other outstanding special assessments currently certified against the property. Also,
the tax status of the property is current with no outstanding delinquencies.

Dear Mr. Ryan:
This letter is to inform you that the City of Prior Lake cannot approve your
request to subdivide the parcel located at 5290 Frost Point Circle SE into two
parcels based upon the following:
1. Section 1006.101 of the Subdivision Ordinance requires that "the
division will not cause any structure on the land to be in violation of the
Zoning Ordinance." The existing dwelling on proposed Parcel B does
not meet the 10 foot side yard setback required in the R-1 use district.
If you remove that portion of the existing dwelling that creates the violation the
City will be able to approve the administrative subdivision subject to standard
conditions, most of which must be met prior to a building permit. However, the
existing structure must comply with setback requirements prior to approval of the
administrative subdivision.

I spoke to Chuck Ryan on Friday. He was surprised that 60 days had elapsed. He thought he submitted
the request less than 30 days ago. Would you check since I was told that Friday was the 60 day
deadline.
I explained about the issues. He asked how we differentiate from the new Lakeside house where we
allowed an illegal lot since two buildings occupied the property for almost a year and now the old cabin is
being torn down. What kind of security did we use there?
I don't want to put us in a bad situation but on the other hand we have done essentially the same thing
before I wonder how we can distinguish. Could we talk about this Monday? Thanks. Frank.

Tracts C & D RLS #29 (PIN #25 060 004 0) is proposed to be subdivided into two (2) single
family lots. The property was initially served with sewer and water utilities in 1974 under Project
74-2. These lots were lOO% assessed for frontage and trunk acreage charges. Under the original
assessment roll this parcel was assessed lateral front footage of 200' and a trunk acreage
assessment of .98 acres.
Since utilities are available to the property site, the cost for the extension of services internally
will be the responsibility of the developer. In addition to these improvement costs, the
subdivision will be subject to the following City charges:
Park Dedication
Collector Street Fee
Stormwater Management Fee
$2670.00/unit
$1500.00/acre
$2943.00/acre
Parcel B would be exempt from these fees since an existing home is located on this parcel. The
remaining lot (Parcel B) would be subject to the application of these City charges which would
generate the following costs to the developer based upon a net lot area calculation of .43 acres as
provided within the site data summary sheet of the preliminary plat description:
Cash Park Dedication:
1 unit @ $2670.00/unit = $2,670.00
Collector Street Fee:
.35 acres @ $1500.00/ac = $525.00
Storm Water Mana2ement Fee:
.35 acres @ $2943.00/ac. = $1,030.00
These charges represent an approximate cost of $4,225.00 for the newly created lot. Assuming
the initial net lot area of the plat does not change, the above referenced park dedication, collector
street and storm water charges would be determined and collected at the time of approval.
There are no other outstanding special assessments currently certified against the property. Also,
the tax status of the property is current with no outstanding delinquencies.

On December 4,2003, the City received the above referenced development application to
subdivide one parcel into two parcels. The DRC reviewed the proposed subdivision on
December 11,2003, and make the following comment:
1. Section 1106.101 of the Subdivision Ordinance states that an administrative land
subdivision may be approved provided all newly created lots comply with
minimum zoning use district standards. The existing house on Parcel B does not
meet the required 10 foot setback from the proposed property line. The applicant
proposes to remove a portion of the dwelling AFTER the new house is built on
Parcel A. However, the planning staff cannot approve the subdivision because it
will create a nonconforming setback for the existing dwelling. This does not meet
the requirements of the Subdivision Ordinance.
The DRC discussed various ways to approach this issue. We considered requesting a
substantial Letter of Credit to ensure the portion of the existing dwelling is removed prior
to a certificate of occupancy. Our concern is whether this is really a viable option. Is the
City willing to drawn down a LOC and remove a portion of an existing home, and are we
willing to remove occupants from a new dwelling if they move in without a certificate of
occupancy?
Another option might be to allow construction of the new dwelling without subdividing
the lot. This would also require a LOC to ensure the lot is subdivided or the existing
home removed prior to issuance of a certificate of occupancy. Our concerns with this
option are the same as with the first option listed above.

That applicant met with you earlier this year about this matter. As a result of that
meeting, we agreed to look at ways in which to accomplish this matter. By ordinance, we
must make a decision on this application by Friday, December 19,2003. As it stands, the
application does not meet the requirements of the Subdivision Ordinance and cannot be
approved. Please advise us on how to proceed. Thank you.

PROCEDURE FOR APPROVAL OF AN
ADMINISTRATIVE LAND SUBDIVISION
In some instances, the City staff may administratively approve the subdivision of an existing platted
parcel (Section 1006.101 of the City of Prior Lake Subdivision Ordinance). Administrative land
subdivisions may only be approved when the proposed subdivision meets the following criteria:
1. The divisions will not result in more than three (3) parcels.
2. All newly created lots must meet the minimum standards of the Zoning District in which they are
located and the resulting parcels must generally conform to the shape and area of existing or
anticipated land subdivisions in the surrounding areas.
3. The division will not cause any structure on the land to be in violation of the Zoning Ordinance.
4. Any easements that may be required by the City must be granted.
Process: Following receipt of a complete application, the City staff will review the application for
conformance with the provision of the Zoning Ordinance, the Subdivision Ordinance and all other
applicable City ordinances. The City shall take action to either approve or deny an administrative
subdivision and notify the applicant in writing of this decision within ten (10) business days of receipt of a
completed application.
Appeals: The decision of the staff to approve or deny an administrative land subdivision may be
appealed by an affected party within five (5) days of the decision. An appeal shall be processed according
to the provisions of Section 1109.300 of the Zoning Ordinance.
APPLICATION INSTRUCTIONS
· Application Fee: Check payable to the "City of Prior Lake". The non-refundable filing fee for an
Administrative Land Subdivision is $175.00.
· Signed Application: Include authorization from the property owner on the application form or by
attached letter of authorization if an agent signs the application.
· Application Checklist: The attached checklist identifies the necessary information. Failure to
provide any of the required information will result in an incomplete application. The Application
Checklist will expedite the review of your application. Attach the checklist with the application
materials.

Legal Description: Tract C and D, Registered Land Survey Number 29
Scott County.
Currently there is a single home located on Tract C with the home extending
onto Tract D. The property is currently owned by Sue Seyfert.
We are proposing to resize/reshape the two lots (Tract C and Tract D) as
shown on the attached drawing and now described as Parcel A and Parcel B.
As shown on the drawings, we will remove an 8' x 16.2' area of the western
part of the existing home and remove the deck behind this area. Along with
changing this area, the lot line has been adjusted so that the 10'-0" sideyard
setback is now met.
It is our intention to build a new home on what is now described as Parcel A
for Sue Seyfert. The existing home on Parcel B will be remodeled and sold
to another party.
Sue Seyfert and her family have lived on this property for more than thirty
years and this proposal satisfies Sue's desire to maintain being a part of this
community.
We feel the proposal meets the requirements as they were presented by City
Staff
The front lot line width should be a minimum of 90'. Parcel A is 100' and
Parcel B is 100'. The rear lot line width at 904 elevation should be a
minimum of75'. Parcel A is approximately 95' and Parcel B is
approximately 105'.
The minimum square footage requirement is 15,000sq ft. Parcel A is 15,107
sq ft and Parcel B is 18,506 sq ft. These square footages do not include the
area above the 904 elevation located on the peninsula.
As discussed earlier with the City Administrator and Staff: we are proposing
to build the new home on Parcel A with the understanding that only one
occupancy certificate would be allowed between the Parcel A and Parcel B
at one time. When Sue Seyfert moves into the new home on Parcel A, an
occupancy would not be allowed on Parcel B until the removal of the
westerly part of the existing home is completed to meet the setback
requirement.

I brought the survey to Connie Dunwell ,Chief Deputy Recorder / Registrar
of Titles at Scott County. She reviewed the survey and stated that they
wtffdH record Parcel A and B with the new legal description as shown on the
ne* survey. She stated this would not require a new RLS.
I gave her a copy of the survey. She will inform her coworkers to be aware
of this property after receiving approval from the City of Prior Lake on the
Administrative Land Subdivision.
