DISCUSSION:
History: IVEX, LLC is requesting an amendment to the 2020
Comprehensive Plan Land Use Map to change the land use
designation from R-L/MD (Urban Low/Medium Density Residential) to
C-TC (Town Center Commercial) on property located at 4616
Colorado Street SE.
On January 12, 2004, the Planning Commission held a public hearing
on this item, and unanimously recommended approval. The
Commission supported the change because it provides a natural
extension of the downtown, since it is adjacent to property in the C-
TC designation. A copy of the draft minutes of the Planning
Commission meeting is attached to this report.
The 2020 Vision and Strategic Plan proposes that the downtown be
connected to Prior Lake. One means of accomplishing this is to
extend the downtown westerly along CSAH 21 over time. The
McCombs Study also suggests that the market would absorb this
additional property for downtown uses.
Current Circumstances: A single family dwelling, constructed in
1920, currently occupies the site. The property is currently zoned R-2
(Low-Medium Dens.ity Residential). A single family dwelling is a
permitted use in the R-2 use district.
The property abuts both CSAH 21 and Colorado Street. However,
access is only provided via Colorado Street.
PHYSICAL SITE CHARACTERISTICS:
Total Site Area: The peircel is 9,616 square feet (.22 acres) in area.
TopoQfaph"v: The property is flat with little elevation change.
VeQetation: The site contains minimal vegetation.

Proposed Comprehensive Land Use Plan Amendment
Backuound
IVEX, a locally owned and operated business specializing in real estate investment,
management, and mortgage services, is interested in building a multi-purpose office
building in the downtown Prior Lake area. Specifically, the location of interest is a
property currently owned by IVEX located at 4616 Colorado Street in Prior Lake with a
legal description of LOTS 13 AND 14 AND THE WEST 12 FEET OF LOT 12, BLOCK
13, ADJUDICATED AND REVISED PLAT OF LOTS 1 THROUGH 16, BLOCK 13,
AND LOTS 1 THROUGH 13, BLOCK 15, OF THE VILLAGE OF PRIOR LAKE,
SCOTI COUNTY, MN. In support of this development project, IVEX would remove
the structure currently located on the property.
IVEX feels this in an excellent location for a multi-purpose office building, creating a
win-win scenario for all parties, for the following reasons:
· The location supports the City Council's initiative to enhance Prior Lake
downtown redevelopment activities.
· The location supports the 2020 Vision and Strategic Plan's desire to extend
downtown towards the lake.
· The proximity of the location to CR21 and potential intersection at Arcadia makes
the site both very visible and accessible.
· The municipal City parking lot across the street (in addition to any potential on-
site parking) provides more than adequate parking availability.

In support of this exciting development initiative, IVEX is requesting the City Council
approve an amendment to the Prior Lake Comprehensive Land Use Plan to change the
zoning for the property located at 4616 Colorado Street, Prior Lake, MN from R-2 to C-3.

RECITALS
WHEREAS, IVEX, LLC requested an amendment to the City of Prior Lake 2020
Comprehensive Plan Land Use Map to change the land use designation from
the R-L1MD (Urban Low/Medium Density Residential) to the C-TC (Town Center)
designation for the property legally described as follows:

WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance
with Minnesota Statutes and Prior Lake City Code; and
WHEREAS, The Planning Commission conducted a public hearing on January 12, 2004, for
those interested in this request to present their views; and
WHEREAS, On February 2, 2004, the Prior Lake City Council considered the proposed
amendment to the 2020 Comprehensive Plan Land Use Map to change the
designation of the above described property to the C-TC (Town Center
Commercial) designation and;
WHEREAS, The City Council received the staff reports, Planning Commission minutes and
other information; and
WHEREAS, The City Council has carefully considered the testimony, staff reports and other
pertinent information contained in the record of decision of this case.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that:
1. The above recitals are incorporated herein as if fully set forth.
2. The City Council hereby adopts the fOllowing findings of fact:
(a) The amendment is consistent with the goals and objectives of the 2020 Comprehensive
Plan.
(b) The amendment is necessary for the benefit and success of the 2020 Vision and
Strategic Plan to extend the downtown area to the lake.
(c) The C-TC designation naturally extends the downtown.
3. The proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the
following described property as C-TC (Town Center) is hereby approved:
Lots 13 and 14 and the west 12 feet of Lots 12, Block 13, adjudicated and revised plat of Lot
1 through 16, Block 13, and Lots 1 through 13, Block 15, Village of Prior Lake, Scott County,
Minnesota.
4. Approval of this amendment is subject to the approval of the Metropolitan Council.

AfRPA Award of Excellence (Donna Tilsnet)
Tllsner: Reviewed the process and competitiveness of the MRPA Award of Excellence for facilities. Congratulated Prior
lake on its commitment to the development of parks as a community meeting place. Presented Parks Supervisor AI
Friedges, and Recreation Coordinator Chris Esser with an award of excellence for Lakefront Park.
FIshIng In Neighborhood Program (AI Friedges)
AI Frledaes: Reviewed that the staff is proposing to cooperate with the DNR and MinnAqua programs to participate in the
Fishing in Neighborhoods (Fin) program. The program will be implemented in the entrance pond at Lakefront Park, and will
include the installation of a lighted fountain/aerator and improvement of the shoreline for access.
Mark Nemeth: Discussed how excited he is to work with the City of Prior Lake in kicking off and promoting the program.
Believed it will be a real asset in promoting the care and appreciation of the natural environment that is particularly unique
to the City of Prior Lake.
Michelle Kellv: Discussed the participation and details of MinnAqua program in the project.

Hauaen: Reviewed the accomplishments of 2003, together with the goals for 2004. Also reviewed the changes to the 2020
Vision and Strategic Plan that were proposed by the Long-Range Planning group in October. Concluded by encouraging
residents and business owners to be proud of where Prior Lake has come from and where its going, and to continue
developing those partnerships that make us a team.

Consider Approval of a Resolution Amending the 2020 Comprehensive Plan Land Use Map to the C. TC Designation

Kansler: Reviewed the agenda item in connection with the staff report, advising that a Comprehensive Plan amendment is
the first of two steps. The applicant will also need to apply for a zoning change.

Blombera: Believed this was an appropriate changed given that the 2020 Vision identifies an extension of the Downtown
area toward the lake as opportunities arise. Also believed that redevelopment of the area will be a positive addition to
Downtown.

Consider Approval of an Ordinance Amending the Zoning Map to Zone Approximately 80 Acres R-1 (Low Density
Residential) on Property Located West of Spring Lake Regional Park and North of CSAH 12.
Kansler: Reviewed the agenda item in connection with the staff report.
LeMalr: Asked about the density of the project.
Kansler: R-1 seems to be appropriate in that it provides the lowest density even though R-1 does allow for town home
development with the same density as single-family, as well as single-family homes.
Blombera: Asked if including the information regarding the shoreland is inconsistent with the R-1 zoning designation.
Kansler: Explained that the shoreland district is consistent with the R-1 designation. The purpose for noting the shoreland
area is to clarify that some properties within this area may also have some limitation due to shoreland restriction, especially
in the Howard Lake area.
MOTION BY LEMAIR, SECOND BY BLOMBERG, TO APPROVE ORDINANCE 04-05 AMENDING THE ZONING MAP TO
ZONE APPROXIMATELY 80 ACRE R-1 ON PROPERTY LCOATED WEST OF SPRING LAKE REGIONAL PARK AND
NORTH OF CSAH 12.

Consider Approval of a Resolution Accepting the feasibility Report for Main Avenue and Dakota Street
Improvement Project and Setting a Public Hearing Date.
McDermott: Reviewed the agenda item in connection with the staff report.
Blomberg: Commented that as a Special Assessment Committee member, they discussed as a group the most equitable
way to distribute costs. Also believed it is important to our infrastructure up-to-date, and with the improvements to building
facades and the construction of new buildings in the Downtown area, it seems appropriate that the infrastructure should be
consistent.
Zleska: Asked if the project will be completed by Lakefront Days.
McDermott: Advised that improvement projects typically take a full summer. We are fast-tracking this project and weather-
permitting expect to finish it before the Lakefront Days celebration.

BACKGROUND:
A single family dwelling, constructed in 1920, currently occupies the site. The
property is currently zoned R-2 (Low-Medium Density Residential). A single
family dwelling is a permitted use in the R-2 use district.
The property abuts both CSAH 21 and Colorado Street. However, access is only
provided via Colorado Street.

Utilities: Sewer and water services are currently available to the site; however,
should the comprehensive plan land use designation and subsequent rezoning
be approved utilities must be upgraded for the commercial use.

ANALYSIS:
The applicant is proposing to remove the existing dwelling and construct an
office building on the site. In order to proceed, the comprehensive plan land use
designation must be changed from R-L/MD (Urban Low/Medium Density
Residential) to C-TC (Town Center Commercial). "This classification is a special
designation for the historical and recognized Town Center which has retained
attributes of a 'downtown,' despite relocation by some original commercial uses.
The classification strives to balance the civic center and contemporary
commercial features with new cultural-focused institutions and enterprises, and
redevelopment potential of retail and service uses."
The 2020 Comprehensive Plan goal and objectives that apply to the request for
C- TC are as follows:
GOAL: ECONOMIC VITALITY: Pursue a prudent use of available resources and
the optimum functioning of economic systems.
OBJECTIVE No.1: Determine and strive for a balance of commerce,
industry, and population.
OBJECTIVE No.2: Encourage a diversified economic base and a broad
range of employment opportunities.
OBJECTIVE No.3: Promote sound land use.
OBJECTIVE No.4: Maintain high standards in the promotion and
development of commerce and industry.

The proposed C- TC designation for this property is consistent with the 2020
Comprehensive Plan policy and goals. Moreover, the proposed amendment is
consistent with the 2020 Vision and Strategic Plan Element to "complete fa]
redevelopment plan tying Downtown to the Lake." The subject parcel abuts
property guided and zoned for commercial uses sO the amendment extends the
downtown west toward Prior Lake, an envisioned by the City Council.
The only corresponding zoning use district is C-3 (Specialty Business). "The 'e-
3' Special Business Use District intends to provide for a variety of commercial
and residential uses within the framework of a traditional downtown area. The
district also contemplates and provides for pedestrian circulation, urban and civic
design and the creative reuse of existing buildings." As previously noted, the
applicant has plans to construct an office building on the property. However, the
property is currently zoned for residential uses. Thus, in order to construct the
office building, the applicant must also seek a zone change, in addition to the
comprehensive land use plan amendment. So the rezoning would be the next
step in the process.
CONCLUSION:
In conclusion, the applicant is requesting a Comprehensive Plan Amendment to
allow for the construction of an office building on the subject property. Staff
believes the request is consistent with the policies and objectives of the 2020
Comprehensive Plan and the 2020 Vision and Strategic Plan.

1. Recommend approval of the Comprehensive Plan Amendment as requested.
2. Recommend denial of the request.

NEX, a locally owned and operated business specializing in real estate investment,
management, and mortgage services, is interested in building a multi-purpose office
building in the downtown Prior Lake area Specifically, the location of interest is a
property currently owned by IVEX located at 4616 Colorado Street in Prior Lake with a
legal description of LOTS 13 AND 14 AND THE WEST 12 FEET OF LOT 12, BLOCK
13, ADJUDICATED AND REVISED PLAT OF LOTS 1 THROUGH 16, BLOCK 13,
AND LOTS 1 THROUGH 13, BLOCK 15, OF THE VILLAGE OF PRIOR LAKE,
SCOTT COUNTY, MN. In support oftbis development project, !VEX would remove
the structure currently located on the property.
NEX feels this in an excellent location for a multi-purpose office building, creating a
win-win scenario for all parties, for the following reasons:
. The location supports the City Council's initiative to enhance Prior Lake
downtown redevelopment activities.
. The location supports the 2020 Vision and Strategic Plan's desire to extend
downtown towards the lake.
. The proximity of the location to CR21 and potential intersection at Arcadia makes
the site both very visible and accessible.
. The municipal City parking lot across the street (in addition to any potential on-
site parking) provides more than adequate parking availability.

The Issues: The applicant is proposing to remove the existing
dwelling and construct an office building on the site. In order to
proceed, the Comprehensive Plan land use designation must be
changed from R-L/MD (Urban Low/Medium Density Residential) to C-
TC (Town Center Commercial). "This classification is a special
designation for the historical and recognized Town Center which has
retained attributes of a 'downtown,' despite relocation by some
original commercial uses. The classification strives to balance the
civic center and contemporary commercial features with new cultural-
focused institutions and enterprises, and redevelopment potential of
retail and service uses."
The 2020 Comprehensive Plan goal and objectives that apply to the
request for C-TC are as follows:

The proposed C- TC designation for this property is consistent with the
2020 Comprehensive Plan goal and objectives. Moreover, the
proposed amendment is consistent with the 2020 Vision and Strategic
Plan Element to "complete [a] redevelopment plan tying Downtown to
the Lake." The subject parcel abuts property guided and zoned for
commercial uses so the amendment extends the downtown west
toward Prior Lake, an envisioned by the City Council.
The only corresponding zoning use district is C-3 (Specialty
Business). "The 'C-3' Special Business Use District intends to
provide for a variety of commercial and residential uses within the
framework of a traditional downtown area. The district also
contemplates and provides for pedestrian circulation, urban and civic
design and the creative reuse of existing buildings." As previously
noted, the applicant has plans to construct an office building on the
property. However, the property is currently zoned for residential
uses. Thus, in order to construct the office building, the applicant
must also seek a zone change, in addition to the Comprehensive Plan
amendment. So the rezoning would be the next step in the process.
In conclusion, the applicant is requesting a Comprehensive Plan
Amendment to allow for the construction of an office building on the
subject property. Staff believes the request is consistent with the
policies and objectives of the 2020 Comprehensive Plan and the 2020
Vision and Strategic Plan.
fI(ldgAt Impact. There is no direct budget impact involved in this
request.
The City Council has three alternatives:
1. Adopt a resolution amending the Comprehensive Plan to include
this area and designate it as C-TC.
2. Continue the review for specific information or reasons per City
Council discussion.
3. Find the Comprehensive Plan amendment inconsistent with the
purpose and intent of the Comprehensive Plan and deny the
request. In this case staff should be directed to prepare a
resolution with findings of fact.

WHEREAS, IVEX, LLC requested an amendment to the City of Prior Lake 2020
Comprehensive Plan Land Use Map to change the land use designation from

designation for the property legally described as follows:
Lots 13 and 14 and the west 12 feet of Lots 12, Block 13, adjudicated and

and
WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that:
1. The above recitals are incorporated herein as if fully set forth.
2. The City Council hereby adopts the following findings of fact:
(a) The amendment is consistent with the goals and objectives of the 2020 Comprehensive
Plan.
(b) The amendment is necessary for the benefit and success of the 2020 Vision and
Strategic Plan to extend the downtown area to the lake.
(c) The C-TC designation naturally extends the downtown.
3. The proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the
following described property as C-TC (Town Center) is hereby approved:

.-. B. Case #03-149 IVEX LLC, is requesting an amendment to the Comprehensive
Plan Land Use Map to the C- TC (Town Center) designation for the property
located at 4616 Colorado Street SE.
City Planner Cynthia Kirchoffpresented the Planning Report dated January 12,2004, on
file in the office of the City Planning Department.
IVEX, LLC is requesting a Comprehensive Plan Amendment to change the land use
designation from R-LIMD (Urban LowlMedium Density Residential) to C-TC (Town
Center Commercial) on property located at 4616 Colorado Street SE.
A single family dwelling, constructed in 1920, currently occupies the site. The property
is currently zoned R-2 (Low-Medium Density Residential). A single family dwelling is a
permitted use in the R-2 use district. The property abuts both CSAH 2l and Colorado
Street. However, access is only provided via Colorado Street.
The proposed C- TC designation for this property is consistent with the 2020
Comprehensive Plan policy and goals. Moreover, the proposed amendment is consistent
with the 2020 Vision and Strategic Plan. The parcel abuts property guided and zoned for
commercial uses so the amendment extends the downtown west toward Prior Lake, an
envisioned by the City Council. Therefore, Staff recommended approval as the request is
consistent with the policies and objectives of the 2020 Comprehensive Plan and the 2020
Vision and Strategic Plan.
Comments from the public:
Applicant Steve Sammis, representing IVEX, stated the company is looking forward to
moving its business to downtown Prior Lake and are planning to construct a new
building. A new office building will help connect the downtown and community as it is
part of the 2020 Vision. This is a clear message that development will help bring new
businesses to the south side of the downtown area complementing the current City
Hall/Library complex.

C. Case #03-139 Arcon Development is requesting to amend the Zoning Map to
include approximately 80 acres of land and to designate the property as R-1 (Low
Density Residential). The property is located on the north side of CSAH 12
immediately west of Spring Lake Regional Park.
Planning Coordinator Jane Kansier presented the Planning Report dated January 12,
2004, on file in the office of the City Planning Department.
On October 21, 2002, the City Council adopted a resolution annexing approximately 80
acres of land located on the north side of Shoreline Drive directly west of Spring Lake
Park. On January 6, 2003, the City Council also approved an amendment to the City
Comprehensive Plan to include this property on the 2020 Comprehensive Plan Map and
to designate this property for Low to Medium Density Residential uses. The applicant is
now proposing to designate this property as R-1 (Low Density Residential) on the City
Zoning Map.
The Planning staff recommended approval as the proposed R-l district is consistent with
the Comprehensive Plan.
It should also be noted a portion of the recently annexed Stemmer property is not
included in this request since the property owners, Bill and Vi Stemmer, did not sign the
petition. Staff recommended the Planning Commission initiate the rezoning of this
property to the R-1 district.
Stamson questioned if the Bill and Vi Stemmer property was part of the development?
Kansier said it was not.

For Plan Amendments that are limited to text changes may only require the information in the
Community Profile and Background section (questions 1-5) of this form. Please talk with your
Sector Representative before submitting any such Plan Amendments. Council staff may
request further information if it is determined that there may be potential impacts to regional
systems, forecasts or policies.

Metropolitan Council Review
Council staff reviews the information submitted on this form within 10 working days to determine
if the Comprehensive Plan Amendment is sufficiently complete for Council review. In the
completeness review process, Council staff evaluates if sufficient information has been
provided to determine the level of impact the amendment may have on regional systems or
policies.
In the case of electronic submission, receipt of the paper copy serves as the official date that
begins the initial 10-day review period.
Once found complete for review, the Council has 60 days to review and take action on the
amendment, with the option for extending the review period an additional 60 days, if necessary,
after providing you with proper notification. The Council's review of Plan Amendments focuses
on compliance with the Metropolitan Land Planning Act, conformance with Regional System
Plans, consistency with the Regional Blueprint and Council policies, and compatibility with
adjacent jurisdictions.
Waiver of Certain Plan Amendment Reviews
In 2000, the Metropolitan Council re-authorized Council staff to waive Council review of "minor"
Plan Amendments when the staff review indicates they are in conformance with regional
system plans, consistent with the Blueprint and compatible with the plans of adjacent
communities. Waivers may be granted for land use changes, MUSA expansions and other
amendments under the following conditions:
In cases where:
o Land use and MUSA changes are 40 acres or less;
o There is no substantial departure from system plans or system impacts;
o There is consistency with other Council policies including housing and density;
Cl There is compatibility with plans of adjacent local government jurisdictions;
o There are no possible cumulative impacts;
o There is no major local opposition; and
o There is a commitment by the jurisdiction to adequately address any outstanding
Comprehensive Plan review issues.

IVEX, LLC is requesting a Comprehensive Plan Amendment to change the
land use designation from R-L/MD (Urban Low/Medium Density Residential) to .
C-TC (Town Center Commercial) on property located at 4616 Colorado Street
SE.
BACKGROUND:
A single family dwelling, constructed in 1920, currently occupies the site. The
property is currently zoned R-2 (Low-Medium Density Residential). A single
family dwelling is a permitted use in the R-2 use district.
The property abuts both CSAH 21 and Colorado Street. However, access is only
provided via Colorado Street.
PHYSICAL SITE CHARACTERISTICS:
Total Site Area: The parcel is 9,616 square feet (.22 acres) in area.
Topography: The property is flat with little elevation change.
Vegetation: The site contains minimal vegetation.
Wetlands: A wetland is not present on the property.
Access: The property is currently accessed via Colorado Street.

ANAL YSIS:
The applicant is proposing to remove the existing dwelling and construct an
office building on the site. In order to proceed, the comprehensive plan land use
designation must be changed from R-L/MD (Urban Low/Medium Density
Residential) to C-TC (Town Center Commercial). "This classification is a special
designation for the historical and recognized Town Center which has retained
attributes of a 'downtown,' despite relocation by some original commercial uses.
The classification strives to balance the civic center and contemporary
commercial features with new cultural-focused institutions and enterprises, and
redevelopment potential of retail and service uses."
The 2020 Comprehensive Plan goal and objectives that apply to the request for
C-TC are as follows:

The proposed C-TC designation for this property is consistent with the 2020
Comprehensive Plan policy and goals. Moreover, the proposed amendment is
consistent with the 2020 Vision and Strategic Plan Element to "complete [a]
redevelopment plan tying Downtown to the Lake." The subject parcel abuts
property guided and zoned for commercial uses so the amendment extends the
downtown west toward Prior Lake, an envisioned by the City Council.
The only corresponding zoning use district is C-3 (Specialty Business). "The 'C-
3' Special Business Use District intends to provide for a variety of commercial
and residential uses within the framework of a traditional downtown area. The
district also contemplates and provides for pedestrian circulation, urban and civic
design and the creative reuse of existing buildings." As previously noted, the
applicant has plans to construct an office building on the property. However, the
property is currently zoned for residential uses. Thus, in order to construct the
office building, the applicant must also seek a zone change, in addition to the
comprehensive land use plan amendment. So the rezoning would be the next
step in the process.
CONCLUSION:
In conclusion, the applicant is requesting a Comprehensive Plan Amendment to
allow for the construction of an office building on the subject property. Staff
believes the request is consistent with the policies and objectives of the 2020
Comprehensive Plan and the 2020 Vision and Strategic Plan.
ALTERNATIVES:

management, and mortgage services, is interested in building a multi-purpose office
building in the downtown Prior Lake area Specifically, the location of interest is a
property currently owned by IVEX located at 4616 Colorado Street in Prior Lake with a
legal description of LOTS 13 AND 14 AND THE WEST 12 FEET OF LOT 12, BLOCK
13, ADJUDICATED AND REVISED PLAT OF LOTS 1 THROUGH 16, BLOCK 13,
AND LOTS 1 THROUGH 13, BLOCK 15, OF THE VILLAGE OF PRIOR LAKE,
SCOIT COUNTY, lvfN. In support of this development project, IVEX would remove
the s1ructure currently located on the property.
IVEX feels this in an excellent location for a multi-purpose office building, creating a
win-win scenario for all parties, for the following reasons:
. The location supports the City Council's initiative to enhance Prior Lake
downtown redevelopment activities.
. The location supports the 2020 Vision and Strategic Plan's desire to extend
downtown towards the lake.
. The proximity of the location to CR21 and potential intersection at Arcadia makes
the site both very visible and accessible.
. The municipal City parking lot across the street (in addition to any potential on-
site parking) provides more than adequate parking availability.

Metropolitan Council Review
Council staff reviews the information submitted on this form within 10 working days to determine
if the Comprehensive Plan Amendment is sufficiently complete for Council review. In the
completeness review process, Council staff evaluates if sufficient information has been
provided to determine the level of impact the amendment may have on regional systems or
policies.
In the case of electronic submission, receipt of the paper copy serves as the official date that
begins the initial 10-day review period.
Once found complete for review, the Council has 60 days to review and take action on the
amendment, with the option for extending the review period an additional 60 days, if necessary,
after providing you with proper notification. The Council's review of Plan Amendments focuses
on compliance with the Metropolitan Land Planning Act, conformance with Regional System
Plans, consistency with the Regional Blueprint and Council policies, and compatibility with
adjacent jurisdictions.
Waiver of Certain Plan Amendment Reviews
In 2000, the Metropolitan Council re-authorized Council staff to waive Council review of "minor"
Plan Amendments when the staff review indicates they are in conformance with regional
system plans, consistent with the Blueprint and compatible with the plans of adjacent
communities. Waivers may be granted for land use changes, MUSA expansions and other
amendments under the following conditions:
In cases where:
o Land use and MUSA changes are 40 acres or less;
o There is no substantial departure from system plans or system impacts;
o There is consistency with other Council policies including housing and density;
o There is compatibility with plans of adjacent local government jurisdictions;
o There are no possible cumulative impacts;
o There is no major local opposition; and
o There is a commitment by the jurisdiction to adequately address any outstanding
Comprehensive Plan review issues.

The Metropolitan Council staff found the City's comprehensive plan amendment (CPA) complete for
review on February 18,2004. The amendment proposes to re-guide .22 acres from low/medium density
residential to commercial. The CPA is generally located along Eagle Creek Avenue SE, west of State
Highway l3 in the City of Prior Lake.
At its May 24, 2000 regular meeting, the governing body of the Council identified certain types oflocal
comprehensive plan amendments that may be reviewed by Council staff without further formal review by
the governing body of the Council. Council staff applied the plan review waiver criteria established by
the Council's governing body and finds that the amendment is in conformance with metropolitan system
plans, consistent with the Regional Blueprint, and has no impact on the plans of other units of local
government. Therefore, the Council will waive further review and the City may place this amendment
into effect.
The amendment, explanatory materials supplied and the information submission form will be appended to

On December 11, 2003 the City of Prior Lake determined all of the necessary submittals
for the above application have been received. This letter serves as your official
notification that the application is now complete.
The DRC will now begin formal review of this request. At this time, you are tentatively
scheduled for the January 12, 2004, Planning Commission meeting. I will notify you of
any changes to that date.
The City review process can be substantially less than 120 days, and we intend to move
this matter through the process in a timely manner that provides a complete, professional
review. Occasionally, however, due to meeting schedules, it is sometimes necessary to
extend the 60-day review period. This letter also serves as your official notice that the
City is extending the 60-day deadline for an additional 60 days from February 12, 2004
to April 12, 2004.

You are hereby notified that the Prior Lake Planning Commission will hold a public
hearing at Prior Lake Fire Station #1, located at 16776 Fish Point Road SE (Southwest
of the intersection of County Road 21 and Fish Point Road), on:
Monday, January 12, 2004, at 6:30 p.m. or as soon thereafter as possible.

An amendment to the Comprehensive Plan Land Use Map
