HomeMy WebLinkAbout20-040 Suite Living Senior Care of Prior Lake Final Plat and Development Agreement 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 20-040 A RESOLUTION APPROVING THE SUITE LIVING SENIOR CARE OF PRIOR LAKE FINAL PLAT AND DEVELOPMENT AGREEMENT Motion By: Thompson Second By: Braid WHEREAS, Landco Investments of Prior Lake, LLC (the “Developer”), has submitted an application to the City of Prior Lake for approval of a Final Plat for Suite Living Senior Care of Prior Lake; and WHEREAS, Suite Living Senior Care of Prior Lake represents Outlot D of the approved 2013 Eagle Creek Estates plat; and WHEREAS, The City Council has found that the final plat of Suite Living Senior Care of Prior Lake is in substantial compliance with the approved preliminary plat and final plats for outlots in Eagle Creek Estates. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of Suite Living Senior Care of Prior Lake is approved subject to the following conditions, which shall be met by the Developer prior to release and recording of the final plat: a. Proof of recording a covenant which runs with the land, in a form approved by the City, which restricts the use of the property to occupancy as required for a Senior Care Facility. b. Compliance with all City Engineering/Public Works requirements. c. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney. d. Payment of all fees prior to release of the final plat mylars. e. Reductions of the entire final plat be submitted, to the following scales: 1” = 200’; and one reduction at no scale which fits onto an 8 1/2” x 11” sheet of paper. f. Three mylar sets of the final plat with all required signatures are submitted. g. The final plat and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by June 14, 2020, will render the final plat null and void. 3. The Mayor and City Manager are hereby authorized to execute the Development Agreement on behalf of the City. Passed and adopted by the Prior Lake City Council this 16th day of March 2020.
