HomeMy WebLinkAbout20-048 Emergency Extension rev by council 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 20-048 A RESOLUTION EXTENDING THE MAYOR’S EMERGENCY DECLARATION IN RESPONSE TO COVID-19 Motion By: Burkart Second By: Braid WHEREAS, Mayor Kirt Briggs of the City of Prior Lake declared a local emergency in response to COVID-19 on March 16, 2020 by Resolution No. 20-047; and WHEREAS, based upon the Mayor’s declaration, the City Council finds that this situation threatens the health, safety, and welfare of the citizens of the community and will cause a significant impact on the ability of public safety personnel to address any immediate dangers to the public as a result of COVID-19; and WHEREAS, the City Council finds that traditional sources of financial aid, assistance and r elief may not be able to compensate for the potential impact of COVID-19, and has determined that the necessary resources to respond to and recover from this pandemic will exceed those resources available within the City of Prior Lak e, and additional resources may be needed from Scott County and state and federal sources; and WHEREAS, declaration of an emergency under Minn. Stat. Chap. 12 by the Governor and/or the Mayor authorizes the City pursuant to Minn. Stat. Sec. 12.37 to exercise various powers without compliance with time-consuming procedures and formalities prescribed by law including performance of public work, entering into contracts, incurring of obligations, employment of temporary workers, rental of equipment, purchase of supplies and materials, limitations on tax levies, and appropriation and expenditure of public funds. NOW, THEREFORE, pursuant to Minn. Stat. Sec. 12.29, the Council of the City of Prior Lake hereby continues and extends the local emergency declard by Mayor Kirt Briggs on March 16, 2020. 1. The emergency declaration authorizes City authority under Minn. Stat. Chap. 12, invokes City Code Section 113, Emergency Management and authorizes other appropriate community containment and mitigation strategies. 2. To the extent that normal state laws and city policies and procedures impede an efficient response or compliance with federal and state directives or recommendations, the City Manager, Emergency Manager Director, and designees are hereby authorized to suspend compliance with those laws, policies and procedures as authorized by the Governor’s Declaration and Minn. Stat. Sec. 12.32, and to take those actions deemed necessary to protect the public health and safety. 3. The Council directs City Staff to review ordinance and regulatory requirements, operations, civil and legal proceedings, events, and resources to determine whether the foregoing should be adjusted or suspended, and to make recommendations regarding additional emergency regulations to support the employees and residents of the City of Prior Lake. 4. The Council directs all City departments and offices to operate and support the response to this emergency, under the direction and coordination of the Emergency Management Director, including implementing new employee protocols, strategies, and processes to ensure that essential public services are maintained. 5. The Council directs the City’s Emergency Management Director and other appropriate City staff to request and coordinate appropriate aid and resources from surrounding jurisdictions, Scott County, the State of Minnesota, and the Federal government, as needed. 6. The emergency declaration shall continue until terminated by the Mayor, the City Manager and/or the City Attorney. The termination of the declaration shall be in writing and shall be provided to the City Council and the public. 7. This extension of the emergency declaration shall be given prompt and general publicity and shall be filed promptly by the City Clerk. PASSED AND ADOPTED THIS 16th DAY OF MARCH 2020.
