CITY OF PRIOR LAKE
ORDINANCE NO. 120-10
AN ORDINANCE AMENDING SECTION 1101.700 OF PRIOR LAKE CITY CODE AND
THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE

The City Council of the City of Prior Lake does hereby ordain:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1101.700, is
hereby amended to designate the following legally described property as the Towering
Woods Townhomes Planned Unit Development (PUD).
LEGAL DESCRIPTION:
That part of Lot 2, Block 1, Towering Woods, Scott County, Minnesota according to the
recorded pat thereof, except that part described as follows:
Beginning at the Northeast corner of Lot 2; thence South 0 degrees 02 minutes 57 seconds
West (assumed bearing) a distance of 93.89 feet; thence South 50 degrees 18 minutes
06 seconds West a distance of 48.75 feet; thence South 39 degrees 41 minutes 54
seconds East a distance of 67.77 feet; thence South 55 degrees 50 minutes 02 seconds
West a distance of 106.62 feet; thence North 89 degrees 57 minutes 03 seconds West
parallel with the North line of said Lot 2 a distance of 95.68 feet to the West line of said
Lot 2; thence Northerly along said West line a distance of 237.12 feet to the Northwest
WHEREAS: Twin Cities Habitat for Humanity has submitted an application for a Planned Unit
Development to be known as Towering Woods Townhomes; and
WHEREAS: The Prior Lake Planning Commission considered the proposed Planned Unit Development
at a public hearing on March 9, 2020; and
WHEREAS: Notice of the public hearing on said PUD has been duly published in accordance with the
applicable Prior Lake Ordinances; and
WHEREAS: The Planning Commission proceeded to hear all persons interested in this issue and
persons interested were afforded the opportunity to present their views and objections
related to the PUD; and
WHEREAS: The Prior Lake City Council considered the proposed PUD for Towering Woods
Townhomes on October 19, 2020; and
WHEREAS: The City Council finds the PUD is compatible with the stated purposes and intent of the
Section 1106 Planned Unit Developments of the Zoning Ordinance.

3. The Towering Woods Townhomes Planned Unit Development includes the following
elements:
a. The PUD is a multi-family development consisting of 12 lots for high density
townhomes.
b. The developer is responsible for grading, topsoil, turf establishment and
construction of the trails/sidewalks to the specifications provided by the City as
indicated on the approved PUD plans.
c. The elements of the plan will be as shown on the plans dated October 5, 2020,
except for modifications approved as part of the final PUD plan.
4. It hereby adopts the following findings:
a. Provides a flexible approach to development which is in harmony with the purpose
and intent of the City's Comprehensive Plan and Zoning Ordinance.
The proposed PUD is consistent with the Comprehensive Land Use Plan
designations on the entire site. The PUD approach allows the location of the
housing units in ways that preserve additional trees on the site.
b. More creative, efficient and effective use of land, open space and public facilities
through mixing of land uses.
The proposed PUD plan clusters the residential areas into 3 attached-unit
buildings.
c. Create a sense of place and provide more interaction among people;
The plan incorporates a sidewalk connection to the existing City sidewalk network.
d. Increase transportation options, such as walking, biking or bussing;
The plan proposes a reconstruction of 170th Street (The Ponds Park entrance) to
a full street section.
e. Provide opportunities for life cycle housing to all ages.
This PUD does not provide a specific life cycle housing opportunity.
f. Provide more efficient and effective use of streets, utilities, and public facilities that
support high quality land use development at a lesser cost.
A reduction of density on the site verses what a larger apartment complex could
create will lessen the traffic impact on 170th Street and park entrance as well as
create better compatibility with other existing housing units and density in the area
g. Enhanced incorporation of recreational, public and open space components in the
development which may be made more useable and be more suitably located than
would otherwise be provided under conventional development procedures. The
PUD district also encourages the developer to convey property to the public, over
and above required dedications, by allowing a portion of the density to be
transferred to other parts of the site.

The PUD preserves a greater amount of open space and resulting tree
preservation as a result.

h. Preserves and enhances desirable site characteristics and open space, and
protection of sensitive environmental features including, but not limited to, steep
slopes, wetlands, and trees. Where applicable, the PUD should also encourage
historic preservation, re-use and redevelopment of existing buildings.
The plan eliminates additional points of conflict (driveways) on 170th Street that
traditional high density development may include.
i. High quality of design compatible with surrounding land uses, including both
existing and planned.
The proposed design is compatible with the surrounding high-density residential
land uses.
5. Final plans for the Towering Woods Townhomes Planned Unit Development are
subject to the following conditions:
a. The developer shall revise the plans according to the October 12, 2020 City
Engineering & Public Works Dept. Memorandum
b. The developer shall revise the plans according to the October 7, 2020 City
Community Development Dept. Memorandum
c. The developer shall obtain a grading permit from the City Engineering Department
prior to any grading or tree removal on the site.
d. The Developer shall obtain the required permits from other state or local agencies
prior to applicable on the site.
This ordinance shall become effective from and after its passage and publication.

SUMMARY: The Ordinance amends the Official Zoning Map for the City of Prior Lake by amending the Zoning
Use District from R-3 (High Density Residential) to PUD (Planned Unit Development) for the following parcel
identification number (PID): 252340130.
This ordinance shall become effective from and after its passage and publication.
