HomeMy WebLinkAbout120-09 - Parkhaven Ord 4646 Dakota Street SE Prior Lake, MN 55372 CITY OF PRIOR LAKE ORDINANCE NO. 120-09 An Ordinance Amending the Approved Preliminary PUD Plan for Parkhaven at Pike Lake to Allow 65 Residential Units WHEREAS, Parkhaven Holdings LLC, the property owner, has applied for a Major Amendment to the Planned Unit Development (PUD) known as Parkhaven at Pike Lake to allow 65 residential single-family units; and WHEREAS, The City Council approved the original PUD Preliminary Plan for Jeffers Pond per Ordinance 118-07 on May 21, 2018; and WHEREAS, WHEREAS, WHEREAS, The Prior Lake Planning Commission conducted a public hearing on July 27, 2020 to consider the Major Amendment to the PUD to allow 65 residential single-family units; and Notice of the public hearing on said hearing was duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinance; and The Prior Lake City Council considered the Major Amendment on September 8, 2020; and WHEREAS, WHEREAS, The Planning Commission and City Council have reviewed the Major Amendment to the PUD according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said Major Amendment to the PUD to be consistent with the provisions of said Ordinances; and The City Council has the authority to impose reasonable conditions on a Major Amendment to the PUD. The City Council of the City of Prior Lake, Minnesota, does hereby ordain that: 1. The above recitals are herein fully incorporated herein as set forth above. 2. The Parkhaven at Pike Lake Planned Unit Development includes the following elements: a. The PUD is a single-family development consisting of 65 lots for single family homes. b. As part of the park development, the developer is responsible for grading, topsoil, turf establishment, construction of the trails/sidewalks, park monument signage, park benches, kayak launch, fishing pier, Pike Lake Park parking area, and park access drive to the specifications provided by the City as indicated on the approved PUD plans. c. The elements of the plan will be as shown on the plans dated August 5, 2020, except for modifications approved as part of the final PUD plan. Page 2 of 3 3. It hereby adopts the following findings: a. Provides a flexible approach to development which is in harmony with the purpose and intent of the City's Comprehensive Plan and Zoning Ordinance. The proposed PUD is consistent with the Comprehensive Land Use Plan designations on the entire site. The PUD approach allows the location of the residential a nd recreational land uses in ways that preserve and enhance the natural features of the site including the Prior Lake outlet channel corridor and near the Pike Lake Park areas. b. More creative, efficient and effective use of land, open space and public facilities through mixing of land uses. The proposed PUD plan clusters the residential areas and provides over 50% of open space on the site. c. Create a sense of place and provide more interaction among people; The PUD plan proposes trails, and other pedestrian elements to connect the residential components, as well as the county trail corridors and Pike Lake Park trail connect ions. The street design and pedestrian trail design create a sense of place that transitions the residential development into the nearby natural Pike Lake Park. Other park features provided by the developer include park benches, a kayak launch, fishing p ier, park monument signage, and parking lot. d. Increase transportation options, such as walking, biking or bussing; The plan includes a network of trails that will connect to the regional trail system and the Pike Lake Park main entrance. The developer will incorporate a parking area. e. Provide opportunities for life cycle housing to all ages. This PUD does not provide a specific life cycle housing opportunity. f. Provide more efficient and effective use of streets, utilities, and public facilities that support high quality land use development at a lesser cost. The public streets provide access throughout the development and connectivity to adjacent areas as well as the main access points for the entire regional area to the surrounding highway system. g. Enhanced incorporation of recreational, public and open space components in the development which may be made more useable and be more suitably located than would otherwise be provided under conventional development procedures. The PUD district also encourages the developer to convey property to the public, over and above required dedications, by allowing a portion of the density to be transferred to other parts of the site. The PUD incorporates preservation of a natural trail system corridor near the entrance to Pike Lake Park. The developer proposes parkland features in addition to the required parkland dedication fee. h. Preserves and enhances desirable site characteristics and open space, and protection of sensitive environmental features including, but not limited to, steep slopes, wetlands, and trees. Where applicable, the PUD should also encourage historic preservation, re-use and redevelopment of existing buildings. The plan includes the construction of the main vehicular and pedestrian entrance to Pike Lake Park along with park signage to enhance the open space around the public park . Page 3 of 3 i. High quality of design compatible with surrounding land uses, including both existing and planned. All surrounding land uses are currently undeveloped for residential and commercial subdivisions at this time; however, future development will be required to incorporate environmental considerations for the nearby park and outlet channel features similar to the proposed Parkhaven at Pike Lake development. 4. Final plans for the Parkhaven at Pike Lake Planned Unit Development are subject to the following conditions: a. The developer shall revise the plans according to the August 7, 2020 City Engineering & Public Works Dept. Memorandum b. The developer shall revise the plans according to the August 7, 2020 City Community & Economic Development Dept. Memorandum c. The developer shall obtain a grading permit from the City Engineering Department prior to any grading or tree removal on the site. d. The Developer shall obtain the required permits f rom other state or local agencies prior to applicable on the site e. The project, as proposed, does not meet stormwater requirements and will require additional modifications to meet stormwater requirements. Materials submitted to date demonstrate that all stormwater requirements can be met with modifications to the existing plan. Modifications may include but are not limited to: • Increase Pond 9 surface area and change outlet orifice to 6 inches. • Increased Pond 8 surface area and depth and change outlet ori fice to 4 inches. • Modify Pond 4 outlet orifice to 4 inches. • Modify Pond 3 outlet orifice to 4 inches. • Meet freeboard requirements on Wetland F. Wetland F High Water Level (HWL) will increase by 0.09 feet, which will meet freeboard requirements. • Update plans and map to clarify all stormwater drainage areas. • Submit additional calculations to demonstrate compliance with wetland bounce and inundation requirements. • Add additional outlet protection for wetlands where deemed necessary by the City Engineer. 5. The Parkhaven at Pike Lake PUD is hereby amended to allow 65 residential single-family units. This ordinance shall become effective upon its passage and publication. CITY OF PRIOR LAKE ORDINANCE NO. 120-09 AN ORDINANCE AMENDING ORDINANCE NOS. 120-08 AND 120-09 RELATING TO THE EFFECTIVE DATE OF SAID ORDINANCES WHEREAS, the City Council adopted Ordinance Nos. 120- 08 and 12049 ("Ordinances") relating to public safety on August 17, 2020. WHEREAS, the Ordinances stated that they would become effective upon passage and publication. WHEREAS, the County has requested that the City delay the effective date of the Ordinances in order to provide additional time to update the County's criminal database. THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, ORDAINS: Section 1. T h e Ordinancesshallnotbepublished, and therefore shall not become effective, until the County has completed its review and update. Section 2.
