A Resolution Requesting a Variance from Standards, for State Aid Operation for
State Aid Projects 201-102-002, 201-119-003 and 201-131-001
(Downtown South Reconstruction)

WHEREAS, The City of Prior Lake is preparing plans for improvements to the Downtown
South area consisting of Colorado Street from Duluth Avenue to Main Avenue
(SAP 201-131-001), Pleasant Street from Duluth Avenue to Trunk Highway 13
(SAP 201-102-002), and Main Avenue from Pleasant Street to Eagle Creek
Avenue/County Road 21 (SAP 201-119-003) to include the following primary
improvements:
• Construction of new roadway base and pavement
• Construction of new underground utilities consisting of storm sewer,
sanitary sewer and water main and services
• Construction of roadway bump outs and improved ADA facilities
consisting of new sidewalk and pedestrian ramps
• Construction of new lighting and landscaping
WHEREAS, Minnesota Rules for State Aid Operation 8820.9961 require a minimum design
standard for 45-degree pull-in diagonal parking, based on less than 3,000
ADT, of 20-feet parking stall depth and the minimum parking stall depth for the
construction on Colorado Street is proposed to be 17 -feet;
WHEREAS, Minnesota Rules for State Aid Operation 8820.9961 require a minimum design
standard for 45-degree pull-in diagonal parking, based on less than 3,000
ADT, of 20-feet parking stall depth and the minimum parking stall depth for the
construction on Pleasant Street is proposed to be 17 -feet;
WHEREAS, Minnesota Rules for State Aid Operation 8820.9961 require a minimum design
standard for 45-degree pull-in diagonal parking, based on less than 3 ,000
ADT, of 20-feet parking stall depth and the minimum parking stall depth for the
construction on Main Street is proposed to be 17 -feet;
WHEREAS, the reasons for this variance request are provided for in the attached variance
request letter and accompanying enclosures.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. That the City of Prior Lake City Council does hereby request a variance from the Minnesota
Department of Transportation State Aid Operations Rules Chapter 8820.9961 Minimum
Design Standards for 45-Degree and 60-Degree Pull-In Diagonal Parking to allow for a
minimum 17-feet parking stall depth in lieu of the minimum 20 -feet design standard.

3. The City of Prior Lake City Council hereby indemnifies, saves and hold harmless the State
of Minnesota and its agents and employees of and from claims, demands, actions, or
causes of action arising out of or by reason of reconstruction of the Downtown South area
consisting of Colorado Street from Duluth Avenue to Main Avenue, Pleasant Street from
Duluth Avenue to Trunk Highway 13, and Main Avenue from Pleasant Street to Eagle Creek
Avenue/County Road in accordance with Minnesota Rules 8820.9961 and further agrees to
defend at their sole cost and expense any action or proceeding commenced for the purpose
of asserting any claim arising as a result of the granting this variance.
Passed and adopted by the Prior Lake City Council this 2nd day of November 2020.
