RESOLUTION APPROVING THE DEERFIELD INDUSTRIAL PARK THIRTEENTH ADDITION
FINAL PLAT AND DEVELOPMENT AGREEMENT

WHEREAS,
WHEREAS,
Mesenbrink Construction, (the “Developer”), property owners, has submitted an
application to the City of Prior Lake for approval of a Final Plat for Deerfield Industrial
Park Thirteenth Addition; and
Deerfield Industrial Park Thirteenth Addition represents the combination of Outlot B of
the approved Deerfield Industrial Park Second Addition plat and Lot 2, Block 2,
Deerfield Industrial Park Second Addition; and
WHEREAS, The City Council approved the Deerfield Industrial Park Thirteenth Addition Final Plat
on August 2, 2021, however, the applicant failed to record the Final Plat at the Scott
County Recorder’s Office within 90 days rendering the City Council approval null and
void.
WHEREAS, The applicant has once again resubmitted the Deerfield Industrial Park Thirteenth
Addition Final Plat to the City Council for approval.
WHEREAS, The City Council has found that the final plat of Deerfield Industrial Park Thirteenth
Addition is in substantial compliance with the approved preliminary plat and final plats
for the Deerfield Additions.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. The final plat of Deerfield Industrial Park Thirteenth Addition is approved subject to the following
conditions, which shall be met by the Developer prior to release and recording of the final plat:
a. A current title opinion or commitment of title insurance is submitted acceptable to the City
Attorney.
b. Payment of all fees prior to release of the final plat mylars.
c. Three mylar sets of the final plat with all required signatures are submitted.
d. The final plat and all pertinent documents must be filed with Scott County within 90 days from
the date of final plat approval. Failure to record the documents by July 3, 2022, will render the
final plat null and void.

3. The Mayor and City Manager are hereby authorized to execute the Development Agreement on
behalf of the City.
Passed and adopted by the Prior Lake City Council this 4th day of April 2022.
