HomeMy WebLinkAbout22-063 Dakota Street PUD Summary 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 22- 063 A RESOLUTION APPROVING THE SUMMARY OF ORDINANCE 122-02 AND ORDERING THE PUBLICATION OF SAID SUMMARY Motion By: Braid Second By: Churchill WHEREAS, in accordance with Minnesota Statute, the Planning Commission held a public hearing regarding a Planned Unit Development (PUD) Plan to be known as Prior Lake Luxury Apartments on April 25, 2022; and WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission, city staff reports and others pertaining to the Zoning Ordinance amendments; and WHEREAS, on May 2, 2022, the City Council adopted Ordinance 122-02 amending the Zoning Map to designate a PUD Overlay District for Prior Lake Luxury Apartments at 4662, 4664, and 4666 Dakota Street SE, Prior Lake, MN 55372; and WHEREAS, Minnesota Statutes requires publication of an Ordinance in the official newspaper before it becomes effective; and WHEREAS, WHEREAS, Minnesota Statutes also allows the publication of a summary of an ordinance if the City Council finds that the summary is an accurate representation of the Ordinance; and the City Council desires to publish a summary of the amendment relating to the Prior Lake Luxury Apartments PUD Plan and has determined the publication of a summary of this ordinance will meet the intent of the statute. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Ordinance No. 122-02 is lengthy. 3. The text of summary of Ordinance No. 122-02, attached hereto as Exhibit A, conforms to M.S. § 331A.01, Subd. 10, and is approved, and publication of the title and summary of the Ordinance will clearly inform the public of the intent and effect of the Ordinance. 4. The title and summary shall be published once in the Prior Lake American in a body type no smaller than brevier or eight-point type. The full ordinance text will be available for public inspection after May 2, 2022 by any person during regular office hours at City Hall or in the Document Center on the City of Prior Lake Website. SUMMARY: The Ordinance approves a Planned Unit Development (PUD) Plan and amends the Zoning Map to designate a PUD Overlay District for Prior Lake Luxury Apartments at 4662, 4664, and 4666 Dakota Street SE, Prior Lake, MN 55372 for the following parcel identification numbers (PIDs): 250010570, 250010560, and 250010550. This ordinance shall become effective from and after its passage and publication. Passed by the City Council of the City of Prior Lake this 2nd Day of May 2022.
