ORDINANCE NO. 122-02
AN ORDINANCE AMENDING THE ZONING MAP TO DESIGNATE A PLANNED UNIT
DEVELOPMENT OVERLAY DISTRICT FOR PRIOR LAKE LUXURY APARTMENTS AT
4662, 4662, AND 4666 DAKOTA STREET SE

WHEREAS: The Beard Group, Inc. DBA Prior Lake B Squared Ventures, LLC, on behalf of the
property owner, Prior Lake Economic Development Authority, has applied for a Planned
Unit Development to be known as Prior Lake Luxury Apartments; and
WHEREAS: The Prior Lake Planning Commission considered the proposed Planned Unit
Development at a public hearing on April 11, 2022; and
WHEREAS: Notice of the public hearing on said PUD has been duly published in accordance with
the applicable Prior Lake Ordinances; and
WHEREAS: The Planning Commission proceeded to hear all persons interested in this issue and
persons interested were afforded the opportunity to present their views and objections
related to the PUD; and
WHEREAS: The Prior Lake City Council considered the proposed PUD for Prior Lake Luxury
Apartments on May 2, 2022; and
WHEREAS: The City Council finds the PUD is compatible with the stated purposes and intent of the
Section 1132 Planned Unit Developments of the Zoning Ordinance.
The City Council of the City of Prior Lake does hereby ordain:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1120.200, is hereby
amended to designate a Planned Unit Development (PUD) Overlay District to be known as Prior
Lake Luxury Apartments PUD over the following legally described property:
LEGAL DESCRIPTION:
The Westerly Seventy (70) feet of Lots 3, 4, 5 and 6, Block 8, Prior Lake, Scott County, Minnesota
(PID 250010570);
And
The East 37.5 feet of Lots 3, 4, 5, and 6, Block 8, City of Prior Lake, Scott County, Minnesota (PID
250010560);
And
The East 75 feet of Lots 3, 4, 5, and 6, except the East 37.5 feet thereof, all in Block 8, City of Prior
Lake, Scott County, Minnesota (PID 250010550).

3. The Prior Lake Luxury Apartment PUD includes the following elements:
a. A five-story mixed-use building including 97 market rate residential rental units, a street front
restaurant of approximately 2,600 square feet, a rooftop deck for restaurant customers, a rooftop
deck for tenants, as well as 169 total parking stalls, 134 of which are underground.
b. As part of the development, Prior Lake B Squared Ventures, LLC will be responsible for
reestablishment and improvements in Gateway Park.
c. The elements of the plan will be as shown on the plans dated March 9, 2022, except for
modifications approved as part of the final PUD plan.
4. It hereby adopts the following findings:
a. Provides a flexible approach to development which is in harmony with the purpose and intent of
the City's Comprehensive Plan and Zoning Code;
The proposed PUD is consistent with the Comprehensive Land Use Plan designations and the
Town Center Zoning Use District as multiple family residential developments and restaurants
are permitted uses in the Town Center District.
b. More creative, efficient, and effective use of land, open space, and public facilities through
mixing of land uses;
The proposed mix of multiple family residential and restaurant use will provide new commercial
space which is desired in the downtown area as well as 97 units of quality residential housing.
c. Create a sense of place and provide more interaction among people;
Additional density will provide more vibrancy and interaction among residents in the downtown
area.
d. Support long-term economic stability by strengthening the tax base, job market and business
opportunities;
The tax base will be strengthened with the investment in a structure of this size compared to the
two existing single-family homes which currently occupy the site.
e. Provide opportunities for life cycle housing to all ages;
No age or income restrictions will be required for the 97 new market rate rental units, which will
provide additional opportunities for quality housing to all ages.
f. Provide more efficient and effective use of streets, utilities, and public facilities that support high
quality land use development at a lesser cost;
Streets, utilities and public facilities currently exist to serve the proposed development.
g. Enhanced incorporation of recreational, public and open space components in the development
which may be made more useable and be more suitably located than would otherwise be
provided under conventional development procedures.
The development is proposing to include improvements and access to Gateway Park which will
increase utilization of the park.
h. High quality of design compatible with surrounding land uses, including both existing and
planned.
The design incorporates a ‘nautical’ theme and will be complimentary to the current and future
design of structures in the area.
5. Final plans for the Prior Lake Luxury Apartment Planned Unit Development are subject to the
following conditions:

a. The developer shall revise the plans per the March 25, 2022 City Engineering & Public Works
Department Memorandum.
b. The developer shall revise the plans per the April 7, 2022 City Community Development
Department Memorandum.
c. The developer shall obtain a grading permit from the City Engineering Department prior to any
grading or tree removal on the site.
d. The Developer shall obtain the required permits from other state or local agencies prior to
applicable on the site.
This ordinance shall become effective from and after its passage and publication.
