The area of Sycamore Trail S . W . that is being affected by Mr . Simpson ' s proposal is owned by neighboring property owners and not the city of -0 Prior Lake . Although Mr . Simpson ' s proposal may fit city planning commission criteria for development , - it does not have 100 % consent from neighboring property / road owners . This is a private land use problem that is the sole responsibility of the land owners and not the city of Prior Lake . A city has no jurisdiction to grant ingress or egress access to any property located along a private road not owned by the city itself . There are several cases similar to this on record at the Scott County courthouse dating back as far as fifteen ( 15 ) years that will support the argument that the city has no jurisdiction over a private road such as Sycamore Trail . II . On March 7th , 1994 Mr . Simpson was asked to furnish a drainage plan to the city that would guarantee not to " exacerbate " off site drainage con- ditions . After being turned down by the neighbors to the South and West of his residence , Mr . Simpson dropped his initial plans of putting in a decent storm sewer system to handle off site water runoff . Instead , he is : relying on Valley Engineering Company ' s report that states new construction will only "incrementally" add to the existing drainage problem . I must emphasize that Mr . Simpson has hired Valley Engineering to produce such a report making the report ' s contents bias towards Mr . Simpsons proposal . Furthermore , since this is a private road , " road owners " should be allowed to question Mr . Steve Harvey ' s calculations regarding the impact of new construction as stated in the Valley Engineering report regarding their own road . In addition to Valley Engineering ' s report , I have also examined Mr . Larry Anderson ' s report regarding the proposed construction ' s impact on off site drainage . First of all , Mr . Anderson states that the increase in runoff will not cause significant drainage problems in the area but he fails to point out that it may worsen or " exacerbate " the existing problem . He also fails to explain in any detail where he thinks water flowing from a new driveway will exactly go . There is zero curbing directly across from the proposed new driveway and I don ' t think it takes an engineer to figure out where water runoff will go . It will adversely effect a portion of 3442 ' s lot . It will definately exacerbate the existing problem at 3420 , as well as , add to the existing problem in front of 3406 and 3415 . In summation , Mr . Simpson was asked to provide information that would assure the city , as well as , his neighbors that his proposal would not exacerbate the existing drainage problem . Valley Engineering ' s report concludes " incremental" exacerbation while Mr . Anderson ' s report concludes that the problem is " not significant " . Neither report , however , states clearly that development on the proposed site won ' t exacerbate or compound an already bad situation . I do not believe his drainage plan is adequate and I am sure it will exacerbate the present runoff situation in this area . I don ' t feel either report adequately meets the criteria set forth by the city last March 7th , 1994 . III . Another aspect to Mr . Simpson ' s proposal is the fact that the city has to change a decision it made several years ago . The previous owners to Mr . Simpson ' s residence were granted a permit to add on to their home about five ( S ) years ago . At that time the city planning department approved of such permanent construction . Now years later , the city planning department approves of the removal and re - installation of a three ( 3 ) season porch they once deemed as a permanent structure . Recently the city has had to withstand the pressures being applied by the numerous developers it has coming forth with their requests . Standing their ground , the city has had to deny some residential development requests that go against our city ' s long range development plans . Development requests that are surely more significant than Mr . Simpson ' s request . Our city ' s long range goal is to do away with ten thousand square foot lots like Mr . Simpson ' s proposed lot . Why can ' t we hold our ground as a city and uphold previous planning decisions , as well as , continue working on our long range goal for larger lot sizes ? Iv . Packing in another home on this block depreciates the neighboring home values . Some are worse than others , however mine has been estimated to come down in value approximately 10 % . Mr . Simpson ' s potential financial gain comes at the expense of his neighbors . Mr . Simpson ' s existing home will y definately depreciate if he does what he intends to do to it . v . The safety issue is one that is the responsibility of the road owners . All owners , including Mr . Simpson , agree that we have safety issues to address on this curve of Sycamore Trail . By allowing construction and land - scaping that encroaches the streets ' edge will only make this blind corner worse . In order to save trees on the proposed lot we are now jeopardizing the safety of ourselves and our children by having to build closer to the street in order to comply with the proposed covenants that the city has set forth . I feel the city is getting involved in an area where it doesn ' t believe it is getting involved . It is a private road and therefore it ' s owners should have more say as to what is appropriate or not regarding safety . There are numerous complaints already on file with the police department regarding safety on this area of Sycamore Trail . This is a real concern and not an imagined one . Mathew R . Dear Mayor , Planning Commission , and Council Members , My name is Dave Johnston and I reside at 3415 Sycamore Trail adjacent to Mr . Simpson ' s residence . The purpose for my letter is to explain my concerns regarding Mr . Simpson ' s land division request , as well as , the condition of Sycamore Trail in the area around my home . My concerns involve several aspects to what is being proposed . I have water drainage , road deterioration , density , and safety concerns that are directly I also have a quality of life within my related to Mr . Simpson ' s proposals own neighborhood concern as well . The drainage issue , I feel , is a major concern . My home is directly across from a storm sewer that was installed not too long ago to handle water run off from two new homes that were just built . It is poorly designed and was poorly installed and does not do an effective job of dispersing water run off . I feel it is not adequate to handle any additional run off that may be caused by construction of another new home on Mr . Simpson ' s lot . As it stands now , I always have standing water in front of my home out in the street . I feel that another new home will definately compound the existing problem and therefore shouldn ' t be allowed . The condition of the road is another concern . I am not happy with the way the city allowed the two new homes that were recently built across the street from me to get by without properly repairing the street once they were completed . I am not confident that the city will enforce any street repair on Mr . Simpson nor a new homeowner on his proposed lot . Maintenance . Construction of a new home on the subdivided parcel will involve considerable excavation . Effect on property values . During the last several years a number of residents have made improvements to their homesites ranging from landscaping to replacement of old cabins with new homes . The new lot that would be created by a subdivision , because of its size and topography , will only allow construction of a small home that is not consistent with the neighborhood as it now exists and will effectively reduce the value of neigh - boring properties . Simpson ' s confidence based on an engineering report that uses a " windshield survey " of the property as its basis , which the engineer acknowledges does not accurately depict actual field elevations and volumes and considers the effect of only a 10 - year storm event . We have nothing against Mr . Simpson . He has , however , made it clear that his motivation in this matter is strictly one of profit since he intends to sell both lots and move away . We believe his plan would depreciate the value of the neighborhood and diminish its safety , and that there is enough real potential damage to surrounding homes , and the roadway , to deny the appli - cation . The dedicated area may follow a line consistent with the current 40 ' wide street. • The newly created parcels (A & B) shall be equal to or greater than 10 ,000 square feet. • The existing structures on newly created Parcel A shall meet all of the requirements of the Zoning Ordinance including the 10 ' side yard setback requirement. If all of these items are satisfied, the Planning Department would recommend approval of the Administrative Plat. This approval would be subject to review by other City departments and other affected public agencies. After our telephone conversation , we discussed some possible options for platting this property. First, the setback must remain at a minimum of 10 ' . Your proposal of a 9 ' side yard setback would require a variance from the Zoning Ordinance. The Planning Department would not recommend approval of any plat that did not conform to the City ' s Zoning Ordinance. Second, The Planning Department would not allow any encroachment onto Parcel B for the existing porch. This would create numerous problems with regard to measuring setbacks and property rights , to name a few. Third, the right-of-way must be dedicated because it is considered a new plat. We require developers of previously undeveloped property to dedicate right- of--way, and this situation is no different with respect to the Subdivision Ordinance . Finally, Horst suggested that the new lot line need not be parallel to the south line. The new line may be parallel to the existing house, or some other configuration to make this plat meet the Ordinances . I have attached a copy of the survey with a possible option for platting. I encourage you to work with your surveyor to plat this property in accordance with all applicable Ordinances . A report that quantifies the stormwater flows is attached . It appears that the present storm drainage facilities are adequate for both the existing and proposed conditions . Even though the impact of one more house and driveway is of the neighborhood development , the addition of any more incrementally small in the context hard surface has high visibility that often become the focus of real and imagined drainage problems in the adjacent areas . In viewing the site , I found no reason to support the argument that the neighbors' basement water problems would worsen . The low driveways along the north and west sides of the street are bermed and storm sewered , thus averting inflow from the street. Often , basement water problems are caused by infiltration from high ground water. Due to the fact that the proposed new lot is already very steep , little chance for seepage into the groundwater exists . When a house and driveway are added , then even less seepage will occur. I also understand that John Simpson has reviewed the April 20th memorandum and has requested a rehearing of his application for an administrative land division . For the reasons stated in this letter , I believe that the council acted well within its discretion when it denied Mr . Simpson ' s application for an administrative land division . The council was entitled to base its decision upon -Section 6 - 6 - 4 ( A ) of the ordinance along with the stated opposition of neighboring property owners . . As I understand it , the problem arises in those areas of the city which were acquired by annexation . The previous township government had approved development with access by private roads . Private streets may s be permitted in planned unit developments . z ( Section 6 - 6 - 2 ( I ) ) Location : All lots shall have frontage on a publicly dedicated street or a street that has received legal status except that lots in planned unit developments may have frontage on a private road or street . ( Section 6 - 6 - 4 ( A ) ) Both of the sections are included in Title 6 which governs subdivision regulations and Chapter 6 of that title which is entitled " Minimum Design Standards . " These sections , read together , demonstrate a strong public policy on the part of the city discouraging private streets . Section 6 - 6 - 2 ( I ) provides , however , that private streets may be approved by the council . of course , the plat itself must be approved by the council . Thus , asareetspetheeq ouncia hass approval the of a plat which contained private authority to approve the plat . Section 6 - 6 - 4 ( A ) does not prohibit private streets . Instead , it governs the location of lots on a proposed plat . That sect :ILon itself is quite unambiguous except for the reference to " a street that has received legal status . The answer is in the affirmative . The council has the authority to approve private roads and may approve a lot on a private road that has " legal status . " In the Simpson case , Section 6 - 6 - 2 ( I ) did not apply . The council was not asked to approve a private street ; a private street r already existed . The council was asked to approve an administrative land division ( Section 6 - 1 - 3 ) . I do not know whether the private street in question " has received legal status " by virtue of the fact that it is part of a previously approved subdivision . It is clear , however , that the council could rely on that section to disapprove the division . The council heard testimony that brought into question the legal status of the private road and the right of a buyer of the proposed lot to an unqualified right of access . Based upon that consideration , the council could deny the division until given a clear opinion which satisfies staff and the council regarding the right of access . If the council approves a plat containing a private road pursuant to the authority given it by Section 6 - 6 - 2 ( I ) , the council , in effect , acknowledges the " legal status " of the private road . The council denied the applications submitted by King and Benedict without any reference to Section 6 - 6 - 4 ( A ) . Since those applications were denied , they provide no precedence for reconsidering the Simpson application . I do not know whether the members of the council had Section 6 - 6 - 4 ( A ) in mind when the council either approved or denied similar ads . A restrictive policy regarding private roads may have unintended results in those platted areas served by private roads . These older plats may contain impractical lots which need to be ✓ rearranged through the administrative land division procedure . The planning staff may need guidance in addressing those situations . In conclusion , the provisions of Section 6 - 6 - 4 ( A ) provide ample justification for the council ' s denial of the Simpson application since the applicant did not :satisfy the requirement of legal status . The council may , of course , reconsider its decision if it wishes to grant a variance from that section or ii mcne applicant has additional information concerning the " legal status " of the street to the satisfaction of the city . Please be advised that there have been three recent, similar administrative plat applications that have been approved and/or reviewed by the City Council. All three applications involved splitting property located adjacent to a private street. 1 . Administrative Plat File 91 -03 , for Douglas and Linda Theilbar located at 15329 Breezy Point Road, that on January 21 , 1992 , the City Council granted approval of an administrative plat and also a variance for lot size and setbacks within the administrative plat . The property is located on a private street of Breezy Point Road . There was no discussion by the City Attorney at that time , nor was there an objection received from the City Attorney related to the City not having an authority to approve the subdivision adjacent to a private street. 2 . Administrative Plat File 94-02, for the Tina and Brad King lot split, which was ultimately denied by the City Council, is a similar situation where Associate Planner Gina Mitchell, discussed in her memo to the City Council dated February 7 , 1994 , that the property in question was located on a private street easement and not a public road. At that hearing, although the administrative plat was denied, there was no objection raised by the City Attorney on the issue related to s Subdivision Ordinance 6- 64A relating to the City ' s authority to approve subdivisions of property adjacent to a private road . e City Council considered an administrative land division application by John 3 . April 18 , 1994, th r variances , the proposed subdivision site was a lot of Simpson . The lot split did not require any record and located on a private street, that being Sycamore Trail . The initial application was brought before the City Council on March 7 , 19944 At tat he attended Council stiby City pulated a number of requirements for the applicant to meet. S was Glen Kessel and there was no objection raised related to the issue of Subdivision Ordinance 6-64A regarding the ability of the City to approve lots on privately dedicated streets . 4 . Subdivision file SU9345 , Michael Benedict received approval for a 3 lot subdivision on private street, Breezy Point. The application was later denied by the City Council based upon the fact that the applicant could not prove that the " wetland" was not part of the lake of Prior Lake . However, in that case, City Attorney, Glenn Kessel interpreted the Subdivision Ordinance to state that the City Council has the authority to approve subdivisions with private streets . Until the interpretation, only PUD ' s were eligible to developed with private street systems . It would seem inconsistent that on the one hand the City has the authority under the Subdivision Ordinance to create a subdivision with a private street yet, on the other hand, the City does not have authority to approve a subdivision of land adjacent to a private street . _ The Planning Department requests that the City Attorney provide a legal opinion related to the issue of the City ' s authority to approve subdivision of lands adjacent to private streets . Staff is concerned that if the opinion of Steve Rathky on April 18 , 1994, is accurate, that perhaps other City approvals related to building permits , variances , etc . , may also be in jeopardy if located on a privately dedicated street. The Council discussed the issues and determined that additional information was required before a decision could be made . A report that quantifies the stormwater flows is attached . It appears that the present storm drainage facilities are adequate for both the existing and proposed conditions . Even though the impact of one more house and driveway is incrementally small in the context of the neighborhood development , the addition of any more hard surface has high visibility that often become the focus of real and imagined drainage problems in the adjacent areas . In viewing the site , I found no reason to support the argument that the neighbors ' basement water problems would worsen . The low driveways along the north and west sides of the street are bermed and storm sewered , thus averting inflow from the street . Often , basement water problems are caused by infiltration from high ground water. Due to the fact that the proposed new lot is already very steep , little chance for seepage into the groundwater exists . When a house and driveway are added , then even less seepage will occur. Any additional design stormwater runoff that is generated from the construction will be collected by the existing catch basin . Thank you for the opportunity to be of service in this matter. No . //O.S.Zi 1 . 0 INTRODUCTION : Presently, drainage appears to flow along the north and east edges of Outlot C in a shallow ditch adjacent to the pavement in Sycamore Trail . The ditch shows As the ditch proceeds south to the southernmost driveway evidence of moderate erosions entrance on Outlot C , it feathers out and flows onto Sycamore Trail . The street lacks a crown at this point and drainage appears to spread across the pavement . This drainage collects in a low let on the west side of the street approximately 100 feet point that is drained by a catch basin in inous curb contains the street drainage at the low tv southwest of the property . A hand-formed bitum point on the west side of the street only . The east side drains into a sump that is drained by a 12" diameter PVC culvert connected to the catch basin . Because of the lack of a street crown It is possible that some of the street drainage flows to the east side whenever a headwater condition forms at the catch basin inlet . It is also possible that flow from the larger area east of the street can create a headwater condition at the culvert inlet that overtops the street. In that case a ponding situation would occur in the low point of the street . The curb on the west side of the street then would become the emergency spillway . In order to quantify these possibilities , three issues are addressed : 1 . ) Isolated flow from Area A , 2 . ) Isolated flow from Area B , and 3 . ) Combined flows from areas A & B . A hydrologic model , based on a 10 year storm , was prepared for the purposes of this report to compare the effects of the proposed development before and after construction of a new house and driveway . The assumptions made for developing the rating curves used herein are intended to indicate as best as practicable the prevailing conditions as estimated by a windshield survey and other available maps and surveys . As such , the model does not accurately depict actual field elevations and volumes , but instead compares the effects of increased hard cover against the baseline assumptions . 2 . 0 SUMMARY AND CONCLUSIONS : The results from the hydrologic model computations are included in the data attached to this report . Properly placed , staked sod lining of the existing roadside ditch properly maintained can accommodate the new flow rate . The increased flow can be accommodated by the existing catch basin with only 0 . 01 ft . increase in headwater. Hence , no spillover to the culvert inlet on the east side of the street should occur and Area "A" flows will remained unchanged for the proposed condition . The modeled rate of flow from Area "A" can be handled by the existing culvert without overtopping the street. The volume of runoff will increase from 0 . 68 acre feet to 0 . 70 acre feet. This additional volume will flow to the lake and should be considered in the reserve capacity afforded new, incremental development within the overall lake watershed . Since the increase in volume is very small , its impact on lake water level will be less than measurable . Consequently , in consideration of the foregoing it is the opinion of the engineer that the proposed construction can be accommodated by the existing storm drainage system , and will not unduly exacerbate off- site drainage conditions . Simpson' s request for Administrative Land Division pending receipt of three conditions . The first condition was Drainage information and plan which confirms that the construction of the house on the subject parcel will not exacerbate off site drainage conditions . " Mr . Simpson has provided a report from Valley Engineering & Company , Inc . which shows that the surface water runoff will have a slight increase in volume and rate compared to pre existing conditions . In Valley Engineering & Company, Inc . and the writer's opinion , this increase in runoff will not cause any significant drainage problems to existing homes in the area . According to the calculations performed by Steve Harvey , the depth of flow at the catch basin at the low point of flow to the catch basif the street will n wse ill provide additional head This increase and the depth on the catch basin to intercept the water into the storm sewer . At the Public Hearing property owners on the north and west side of Sycamore Trail indicated that they have water problems with their houses . These drainage problems were indicated at 3470 , 3454 and 3442 Sycamore Trail . The drainage from this lot appears to stay on the easterly side of the roadway and would not iinage of these houses on these three addresses . The drainage from mpact the dra the street area in general does cross the street in the area of 3420 Sycamore . The driveway for the house at 3420 and 3406 Sycamore were increased in height above the street to provide for positive drainage from the driveway out to the street for the first 10 ' of the driveway . The homes in this area could improve their own surface yard drainage by increasing their height to the curb along these two properties . In summary, it appears that building the offsite house drainage conditions the current plan by Mr . Simpson would not exacerbate The second condition placed was " Safeguards be provided assuring that development of this parcel will not have a substantial negative impact on the property owner to the east. Property f values will be effected directly by the building of a lower valued property on a minimum square footage lot. Many homes in the area are in excess of $300 , 000 . 00 or more in value . The subject property was purchased in the lower $ 100,000 . 00 range after a long market time, and in my opinion the removal of the existing three season porch would effect the curb appeal and marketability of this property, in turn effecting all properties in the area. Also the proposed minimum . lot size, would effect neighboring homes by eliminating open spaces, creating a situation similar to Sand Point addition and the Inguadona Beach area, in which overcrowding has diminished values and buyer appeal . The applicant proposes to subdivide Outlot C , Maplewood, to create two parcels as per attached survey reduction. The application has been filed pursuant to Section 6- 1-3 : Administrative Land Division process , outlined in the Prior Lake Subdivision Ordinance 87 - 10. SITE CONDITIONS : The subject site contains 22 , 197 square feet and is zoned R- 1 , SD . The minimum lot size in this district is 10 , 000 square feet, and 12 , 000 square feet for corner lots . However, the definition of a corner lot is a lot that is situated at the junction of and abutting two or more intersecting streets . Sycamore Trail bends around Parcel B and therefore is not considered a corner lot . The coverage ratio of 22% for structural coverage and 30% impervious surface also apply. The subject site abuts the private section of Sycamore Trail for 296 feet. The last 550 feet of Sycamore Trail are private . The . road section consists of a 22 foot bituminous mat with no curb . An informal homeowners association maintains the roadway. A utility stub was installed for the proposed lot when the area was served with utilities in anticipation of a future subdivision . The Subdivision Ordinance does not permit the creation of private streets , unless approved by the Council. The City has approved lot splits on private roads before , as long as standards of the Zoning Ordinances and requirements of the Subdivision Ordinance are met . The topography of the site slopes from east to west with approximately 15 feet of relief over the proposed vacant lot. An existing single family home is located on the southern lot with a screen porch that straddles the common property line , which must be removed if the lot split is approved. There are five trees worth noting on the vacant lot, three Ash trees , an unidentified tree , and a 24 inch caliper Oak. The Oak will have to be removed due to the proposed driveway location . A three inch caliper Ash tree at the northwest corner of the house will likely be lost also . However, the development plan may change 4629 Dakota St . S . However, the development plan may change somewhat depending on a future owner. The adjacent home owner to the east of the vacant parcel has expressed concern over a 30 inch caliper Maple tree that is within a few feet of the property line . The grading effort to accommodate the proposed home will come within 14 feet of the Maple which may cause damage to the tree . The adjacent home to the east has a picture window that affords a view of the lake . The proposed home is a walkout to the south, and would block that view. Grading is required at the front and rear of the home to accomplish the proposed development plan. Although this plan does not indicate a retaining wall , one maybe required. BACKGROUND : Staff notified in writing the owners of land contiguous to the parcel , and has received numerous letters of objection. Since there were objections , the application has been forwarded to the City Council who shall hear the objections and decide the matter. The following objections and concerns were raised: • Possible loss of a mature Maple tree , as well as possible monetary and aesthetic value loss to the adjacent property to the east , should a retaining wall be constructed along that property line . • Possible drainage problems to adjacent property owners . • A concern regarding the loss of property value to the applicant's home by removing the screened in porch, which would be contrary to some of the neighbors' objectives of improving the value of the neighborhood. • An increase of traffic in the neighborhood. Please see the attached letters for specific information. In addition to the neighborhood objection , the City's Engineering and Building Inspections Departments indicated that a development plan for the proposed lot must be submitted, acceptable to the City, as a condition of approval . A It letter dated January 24, 1994, was sent to the applicant indicating that objections had been received, the necessary components of the development plan that were needed , and the applicant's alternatives . Please see the attached letter and staff reports for further information . The applicant asked staff to set the meeting date on March 7 , 1994 to allow him time to resubmit his plans to address the concerns of the City's Engineering and Building Inspections Departments and the adjacent property owners . DISCUSSION & SUPPORTING ANALYSIS: The City's Engineering, Building Inspections , and Planning Departments have reviewed this application, and it appears that the development plan has addressed all of the concerns that have been made by the departments . The lot split requires no variances , and meets the criteria outlined in Section 64 = 3 of - the Subdivision Ordinance . The concerns with the development plan and potential damage to the 30 inch caliper Maple tree on the lot to the east will be reviewed again at the time of building permit application for Parcel B . This will be done to reduce the negative effects to the adjacent property owners when Parcel B is developed. Verlyn Raaen of the Engineering Department, recommends as a condition of approval that the easement as shown in the northwest corner of Parcel B of the survey be dedicated to the Home Owner's Association or appropriate body which owns the roadway right- of--way, and an executed copy of this document be forwarded to City Hall , prior to filing the Administrative Land Division with Scott County. It is also recommended that a 5' wide side yard and 10' wide front and rear yard drainage and utility easements be dedicated to the City for each parcel, according to Section 6-6- 5 :A of the Subdivision Ordinance , acceptable to the City Engineer. He also stated that storm water runoff from both proposed lots will drain to the west onto Sycamore Trail, and then south to a catch basin, which then conveys the storm water to the lake . Since no curbs exist, some minor erosion problems may occur at times in the roadway right-of-way. This will need to be monitored by the association and corrective action taken when. required. An alternative available is for the applicant to install bituminous curb to convey the runoff to the catch basin within the paved section of Sycamore Trail . Ideally however, all benefitted property owners should contribute to this alternative . Ralph Teschner, Finance Director and Bill Mangan, Director of Parks and Recreation, have reviewed the proposal , and stated that the development fees of $ 287 . 50 for Collector Street Fees , and $ 188 . 70 for the Park Dedication Requirement be collected as a condition of approval of the Administrative Land Division . COMPREHENSIVE � PLAN IMPACT: The Comprehensive Plan indicates low density residential land use for this area. Therefore , the application has no impact with x _ respect to the plan and is consistent with the Land Use Plan . e Administrative Land Division as requested. ALTERNATIVES: 1 . Approve th 2 . A two - story house sitting in this situation not only worries and concerns us , but would certainly raise questions and doubts of a prospective buyer should we decide to sell our property . The salability as well as the value of our house would be in severe jeopardy . We also have a mature ( 94 " circumferences 30 " diameter ) maple tree adjacent to Mr . Simpson ' s property . The tree is on our property , but is within a foot of the lot line . Should any excavating be done too close to this tree , the tree would be lost due to damage to the root system . The aesthetic value that a tree of this stature gives to our property as well as the entire neighborhood , is unmeasurable , much less what it means to the value of our property . Dear Planning Department , I am writing you today in response to a letter I received dated January 4 , 1994 from Ms . Gina Mitchell , Associate City Planner . ( see attached ) . My response to the proposed land division of Mr . John Simpson ' s property located at 3437 Sycamore Trail S . W . is that I object . I have several reasons for my objection to Mr . Simpson ' s request . These reasons I have listed in outline form below as follows , Neighborhood Property Values : The area in which I , and the Simpson ' s live , has had many improvements in the quality of the homes made by homeowners over the past ten years that I have lived here . There have been two new homes built at 3402 and 3406 within the past two years . 3406 is actually a replacement of an extremely old cabin that was an eye sore to the entire neighborhood prior to its demolition this past autumn . There have been improvements made at 3420 , 3380 , 3486 , and even 3437 , Mr . Simpson ' s residence prior to his purchase . There have been extensive landscape work done at 3478 , 3470 and 3508 Sycamore Trail within the past two years , dramatically improving these home ' s external appearances . 3415 Sycamore , and my home at 3442 , were both built five years ago . My home , just like 3406 , was a replacement of an old cabin . All of these improvements have gradually increased each other ' s property values . Good looking , well cared for homes all surround Mr . Simpson ' s piece of property enhancing his homes ' value . It is my opinion that Mr . Simpson ' will s proposed land division have a negative impact on all neighboring property values . Any home that could be built on that proposed site would obviously be very small and of lesser market value that its neighboring homes . A residence of this nature will bring down all the home values in the area offsetting the improvements we ' ve all made . I see a home on this proposed site as a giant step backwards in our neighborhood ' s quest towards improving the area and therefore should not be allowed . Granting Mr . Simpson ' s request would not be fair to many of my neighbors , as well as , myself . We have all made large financial commitments to our home ' s and our community by paying increased taxes . I feel this proposed land division seriously tarnishes our reasons for faithfully doing so . f Water Drainage : ' The plat sketch that Mr . Simpson furnished along with his request for land division , I believe , does not accurately tell the whole story . , Mr . Simpson ' s survey is only for the purpose of determining square footage , completely ignoring elevation . The proposed site has a rather steep incline to the north and west sides . Assuming Mr . Simpson ' s proposed site would be a corner lot , both of the street sides would have sharp drop offs to the curb . Once the w property is developed , and ' a home is ' built , where is the run off from rain and melting snow , going to go ? Well I ' ll tell you , it is F going to go, into , my basement and Ron Johnson ' s basement like it has been doing for years . The new homes roof and driveway will divert water downhill out into the street which is not capable of properly ', disposing of it . This past autumn both Ron Johnson and myself had extensive work done on our homes to try and resolve our wet basement problems . Know- I ing that our efforts were only a band aid to a more serious problem , I felt that I had to try something because my five year old home has had a wet basement ever since I built it . I feel the only solution is to improve the street . Widen the F road , : install an adequate storm sewer , (unlike whatever was done this past autumn between 3402 and 3406 ) , and prohibit the development of Mr . Smpson ' s proposed site . I realize this is easier said than done , however , I feel it is the only solution to the existing water run off problem currently in this area . Development of Mr . Simpson ' s F proposed site would only compound the water run- off problem worse . Street Standards : Although , I am not an expert on residential street code requirements , I think it is safe to assume that the street in front of Mr . Simpson ' s proposed site is not up to current Prior Lake residential standards '. This issue , I feel , was overlooked when you granted permits at 3415 and 3406 . The setbacks from the street at ' both . 3415 and 3406 are very close to the minimum requirements . Should this portion of 'Sycamore Trail be upgraded to current Prior Lake residential street codes these two homes will have doorsteps at the curb , or atleast , one of those homes will . Before this proposed land division be granted , I suggest that the 4 residents of Sycamore Trail in this particular area , and the city planning department , mutually agree on a future street plan . Every- one has had their own surveys done by several different surveyors . I have seen a few of my neighbors , I have reviewed Mr . Simpsons survey , and I ' have < one of my own . All of these surveys seem to contradict each other. Also , ' I think the city may need a larger portion of Mr . Simpson ' s proposed site just to create a decent navigable roadway . 1 I 3 Approximately a year and a half ' ago the city granted a change in property lines between 3454 and 3470 . This was done without any notification of contiguous landowners . By doing this the city shrunk the lot size of 3454 , a lot that has an ' old cabin on it Not only did this substantially reduce this parcels buildable area , y it severely , limits this lots ' street access . At 3454 there is an older ;garage built too close to the roadway . ( Actually it is located partially in the vacated roadway ) . My feeling , is that since 3454 now is limited in its street access and buildable surface area , I think the roadway should be changed to cut off a larger corner of Mr . Simpson ' s roadway easement '. If that ; is not possible , then I think the city should condemn the garage at 3454 to accomodate a wider , more navigable turn in the roadway;. The turn in the roadway , as it presently exists , is very unsafe . K There is a huge blind area when driving around Mr . Simpson ' s hill . With the road too narrow , and the absence of any street signs , ' I firmly believe there is going to be an accident at this corner in the k near future . I have also expressed my concerns several times to the Police Department in recent months concerning this very same issue . ' With the increased traffic lately , this is literally " Dead Man ' s Curve " . I ` think the 'safety issue should be seriously evaluated before any further development takes place down on this portion of Sycamore Trail . The road ' s width is only one aspect of the problem . The quality of the pavement is yet another issue . The neighboring homes have privately paid for the asphalt on this segment of Sycamore prior to Mr . Smpson ' s purchase of his home . Neither Mr . Simpson ,' nor the city x have paid a dime towards our streets ' maintenance . Both parties should realize this was paid for by individuals who desire to improve their fi neighborhood . Without our assistance , this street would till be a gravel path . I think both Mr . 'Simpson and the ; city ; take this for granted . This road was improved by the individuals who use it to better our neighborhood ' s quality of life , not to enhance Mr . ' Simpson ' s 1 proposed site , and not to ; take pressure off of the city to improve ; this roadway . Allowing further development on this , portion of Sycamore Trail will ' only ' further deteriorate its condition . I feel the city ; should repair the road in front of 3406 for granting a ` permit without adequate street repair . If the city allows development on Mr . Simpson ' s proposed site , I insist it should upgrade the roadway in advance to meet current Prior Lake development require - ments '. If it does not , I feel it is unfair to other area developers who currently are having to comply with such standards . The Proposed Lot : The proposed lot was declared "un-buildable " by its previous two owners .' Why it is all of a sudden okay to develop it astounds me . Development of this site means drastically changing Mr . Simpson ' s own homes ' value , ' a change that will decrease his home value . 4 r Tearing off his three season porch will reduce his homes value , even if he :plans to re - assemble it in the rear of his home . De - velopment on this proposed site will kill one of the areas largest maple trees that is presently owned by neighbors , Mr . and Mrs . , Gary Detjen: Furthermore , excavation on the proposed site will require extensive retaining wall work around Mr . and Mrs . Detjen ' s home . ' This cost will be out of their control and will be incurred by them just to preserve their homes ' structure . It financially u would be unfair to them to grant Mr . '` S ' son ' s request to divide his land . It would also be unfair to Ron Johnson , as well as , , rt myself in terms of further compounding an already bad water run off situation in this area . I am confident that the city of Prior Lake did not solicite11, Mr . Smpson ' s request '. With the rapid growth our city is incurring ' I am sure there are more serious planning issues to address than this one . This proposed land division not only depreciates the quality improvement efforts made previously by devoted tax paying citizens , it also causes financial hardships on them . I can ' t take anymore wafter in my basement neither can anyone of the westward side of Sycamore Trail in the area . I don ' t believe Mr . and Mrs . Detjen should have to further invest in their property to protect it from foundation erosion just to accomodate Mr . Smpson ' s request . Either our ' children , as well as ourselves shouldn ' t be subject to I unsafe roadway conditions in order to develop this questionable piece of land . And finally , this segment of Sycamore Trail , needs to be R improved just to handle the present traffic safely . ; I think the planning department may need a portion of Mr . Simpson ' s lot in order 0, to make these necessary changes'. ` Mr . SoIMP son ' s objective is tomake a ' quick buck and get out . His goal isn ' t to be a Prior Lake citizen . His goal is short term and money motivated . His plan is to ' sell ' out and move to a hobby farm . ' He has made that public to his surrounding neighbors . Deny it in the name of creating a quality city , or postpone it until the road be clearly defined and upgraded . I have spent everything I ' ve got on my home . Dear Ms . Mitchell , We own the property immediately across the street from the lot that is proposed for division , and are vigorously opposed to the division for the following reasons . First , homes on the lake shore side of Sycamore Trail S . W . are already suffering from water drainage problems . The combination of heavy rain , and run - off from the property proposed for division ( and property adjacent to it ) , contributed to the collapse of a retaining wall on our property which had to be reconstructed at a cost of approximately $ 12 , 000 . We also have had to replace the floor in a lower bedroom , and reconstruct a small retaining wall that abuts the house , because of water penetration . It is also my understanding that neighboring properties to the South have had lower level water problems . Adding another house and driveway right across the street will obviously reduce water retention and increase run - off onto our property and / or neighboring property . Second , the street has a sharp curve with limited visibility at the property proposed for division . Adding another house and driveway at this location will substantially increase the risk of accident . Third , the street is currently not maintained by the city , presumably because it is not to City Codes . To further subdivide property in this location prior to developing a plan for upgrading the area , will limit the options that would be available in the future , for current residents . i Therefore , we request that the Proposed Division not be approved at this time . If a plan can be developed and implemented that would bring the street up to City Codes and allow the City to maintain it , and that would deal with water run - off and safety , then I would no longer oppose the division . If no negative comments had been received from the adjacent property owners, the Administrative Land Division could have been processed without going before the City Council. Please be advised that the following objections and concerns were raised by persons notified of the proposed land division : 1 . Possible loss of a mature Maple tree, as well as possible monetary and aesthetic value loss to the adjacent property to the west, should a retaining wall be constructed r along that property line. h 2 . Possible drainage problems to adjacent property owners . 3 . A concern regarding the loss of property value to your present home by removing the screened in porch, which would be contrary to some of your neighbors ' objectives of improving the value of the neighborhood. 4 . An increase of traffic in the neighborhood. In addition , the City Engineering and Building Inspections Departments will require that a development plan for the proposed new lot be submitted acceptable to the City, as a condition of approval . Specifically, the development plan will need to define a future building pad location ; indicate existing and proposed elevations at all corners of the lot and building at at 25 intervals in all proposed drainage swales , the elevation of the street at the proposed driveway location and existing elevations at the adjacent corners of existing homes on adjacent lots ; a proposed home style (rambler, split entry, two-story etc . . . ) must also be indicated for proposed Parcel B . This information is necessary in order to show that the proposed lot can be developed without causing drainage problems to adjacent properties . In addition , a possible park dedication fee to be determined by the Parks Director may be needed, as well as other associated development fees will be required to be paid at the time of land division approval . In a phone conversation with Mrs . Simpson on January 18 , 1994 it was indicated that you would be out of town on February 7 , 1994. Because the neighborhood objections have been filed, Staff cannot approve the application . It will be necessary for this item to be decided by the City Council.
