Call to Order and Pledge of Allegiance: Chair Tieman called the Monday, April 25, 2022 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Dan Ringstad, Dave Tieman, and William Kallberg; Absent were Jason Tschetter and Bryan Fleming. Also present were Liaison Kim Churchill, Community Development Director Casey McCabe, Assistant City Engineer Nick Monserud, City Planner Jeff Matzke, and Administrative Assistant Jess Erickson. 2. Approval of Monday, April 25, 2022 Agenda: MOTION BY KALLBERG, SECONDED BY RINGSTAD TO APPROVE THE MONDAY, APRIL 25, 2022 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. 3. Approval of April 11, 2022 Meeting Minutes: MOTION BY RINGSTAD, SECONDED BY KALLBERG TO APPROVE THE APRIL 11, 2022 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. 4. Public Hearings: A. PDEV22-000004 – The Preserve at Jeffers Pond - Major Planned Unit Development (PUD) Amendment – RCP Construction and Development LLC, on behalf of the property owner United Properties Residential, LLC, is requesting a Major Planned Unit Development Amendment to allow the construction of a market rate apartment development containing 197 units at 3729 Fountain Hills Drive NW, Prior Lake, MN 55372. PID 254371690 McCabe: Introduced the public hearing to consider an amendment to allow construction of a four-story market rate apartment building to be known as The Preserve at Jeffers Pond. The property is in the southwest corner of CSAH 42 and Fountain Hills Drive NW intersection at 3729 Fountain Hills Drive NW. He explained the history, current circumstances, and physical site characteristics. Commission Comments/Questions: Ringstad: Asked if the remaining outlots were already set for higher density. McCabe: Answered yes, high-density housing has always been anticipated. Ringstad: Asked about parking stalls and it falls in within guidelines. McCabe: Answered the City Code multi-family parking requirement is two stalls per unit and the development is proposing 1.32 stalls per unit and 1.09 stalls per bedroom. Tieman: Asked about the 100 ft setback from County Road 42. McCabe: Replied the setback from building wall to County Road curb will be approximately 100 feet. Applicant: Ian Peterson RCP Construction & Development: Presented information about some of their past projects and examples about the type of buildings they have constructed. He stated that Prior Lake is ready and in need of a Class A building. He presented renderings of the interior and exterior of the building, total of units with square footage, and parking stalls per unit. Commission Comments/Questions: Tieman: Asked about market rate average range of monthly rental rates. Ian Peterson: Replied studio units start at $1400 and largest units will be around $2500 per month. 2 Kallberg: Asked if the rental rate includes a parking stall. Ian Peterson: Replied yes. MOTION BY KALLBERG, SECONDED BY RINGSTAD TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:39 P.M. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. Public Comment: Karen Heike 3588 Cove Point Circle: Not in favor of a 4-story building and commented about noise and traffic concerns. Chuck Rickert, Consultant Transportation Engineer: Commented on traffic volumes being significantly less than what was originally planned for this area of the Jeffers Pond PUD. McCabe: Explained medium and low-density residential units that were anticipated as part of the Jeffers Pond PUD have been built. High-density residential has not been built and most of the anticipated commercial has not been built, with only one commercial building currently under construction. Mike Baynes 3588 Cove Point Circle: Commented about traffic, height of building, and safety concerns. Gina DePauw 3505 Cove Point Circle: Stated concerns about traffic, safety, and height of building. Jim DePauw 3505 Cove Point Circle: Asked about the age demographics and vacancy rate. Ian Peterson: Answered 95-98% occupancy level. Replied the age demographics 1/3 empty nesters, 1/3 millennials, and 1/3 40 somethings with average income of 100k. Mike Baynes 3588 Cove Point Circle: Wants a building to the be right choice and fit and requested the project be put on pause. Ryan O’Keefe 14304 Enclave Ct NW: Asked about traffic study with more deliveries and truck trips and if they are low-income units. Mr. O’Keefe also expressed concerns about traffic and wildlife. McCabe: Answered the units are proposed to be market rate rental units. Cindy Stavrum 3905 Station Place NW: Concerned about the wildlife, value of home, loosing small town feel. John Etchison 3514 Cove Pointe Circle NW: Asked about visitor and unit parking. Concerned about traffic. Ian Peterson: Responded to question about available parking stalls. Lisa Mein 14358 Enclave Court NW: Concerned about traffic with the emergency vehicles, extra pets, extra people, internet, and the Nature Preserve. MOTION BY KALLBERG, SECONDED BY RINGSTAD TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 7:16 P.M. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. Commission Comments/Questions: Kallberg: Commented about understanding the traffic impacts of both projects [including item 4B] being built at the same time. Ringstad: Stated he will be voting to support the project and commented about multi-family residential having been anticipated with the original PUD. Tieman: Stated there is a need for market rate rental housing in this community and commented about support for the project. MOTION BY TIEMAN, SECONDED BY RINGSTAD RECOMMENDING CITY COUNCIL APPROVAL OF THE PRESERVE AT JEFFERS POND MAJOR AMENDMENT TO THE JEFFERS POND PUD SUBJECT TO THE LISTED CONDITIONS. VOTE: Ayes by Tieman, Ringstad. Nay by Kallberg. The Motion carried 2-1. A. PDEV21-000038 – Public Hearing – Major Planned Unit Development Amendment - Jeffers Pond Apartments - Rachel Development and Vincent Development, on behalf of property owner Jeffers Foundation, are requesting a Major Amendment to Jeffers Pond Planned Unit Development (PUD) 3 regarding Outlot C Jeffers Pond 1st Addition to allow the construction of two multi-family apartment buildings containing a total of 221 units. PID 254371701. Planner Matzke: Introduced the public hearing to consider a major amendment to the Planned Unit Development (PUD) known as Jeffers Pond for the proposed high density residential apartment project. The property is located in the southwest corner of the CSAH 42 and CSAH 21 intersection, along Fountain Hills Drive NW. He explained the history, physical site characteristics, proposed plan, issues, and recommended a motion, provide feedback to City Council regarding the proposed high-density residential use versus a mix of residential and commercial uses. He presented a location map and PUD plans. Commission Comments/Questions: Tieman: Asked about detail on stormwater runoff and proposed underground storage. Monserud: Replied this common for this type of project. Tieman: Asked which way the stormwater would discharge from the site. Monserud: Replied it will discharge to the east. Ringstad: Asked about previous plans for 260,000 sq ft of commercial and now is 87,000 sq ft. Matzke: Replied with the history of previous Jeffers Pond PUD amendments which reduced the anticipated commercial square footage and number of residential units. Applicant: Paul Robinson Rachel Development 4180 Napier Ct: Presented his concept for development of Outlot C. Answered questions about storm water treatment, commented about tax base with multifamily housing, anticipated traffic flow, increase in pets, and parking. Presented the rendering with interior and exterior amenities and stated this development would satisfy the housing unit target for the Jeffers Pond PUD. He also commented the additional units would increase demand for commercial uses in the area. MOTION BY RINGSTAD, SECONDED BY FLEMING TO OPEN THE PUBLIC HEARING ON ITEM 4B AT 7:59 P.M. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. Public Comment: Tim Hjulberg 3679 Jeffers Parkway: Questioned the traffic study and expressed concern about traffic and safety. Chuck Rickert: Answered the question on the traffic study and stated the site was originally designed to accommodate 18,000 vehicles per day. Kathy Spanish 3655 Jeffers Parkway NW: Expressed concern about traffic and safety. Kelly Johnson, Jeffers Foundation, Fernbrook Road Plymouth: Provided a brief history of the overall PUD plan and commented about a deposit that was provided for improvements to the Fountain Hills/CH21 intersection with the original Jeffers Pond PUD. Joy Meyers 3609 Jeffers Parkway NW: Expressed concerns about safety, traffic, and vehicle speed. Olivia Sutton 14347 Enclave Ct NW: Concerned about traffic and wildlife. Asked about price of apartments. Paul Robinson: Replied they are projecting $1600-$2400 monthly rental range. Lisa Mine 14358 Enclave Ct NW: Asked if there could be a shared responsibility to keep the area clean for the wildlife preserve. Carol Heesaker 14167 Parkview Lane NW: Concerned about size of apartment building and endangerment to the wildlife. Cindy Stavrum 3905 Station Place NW: Concerned about the public safety vehicles ability to respond and traffic. MOTION BY RINGSTAD, SECONDED KALLBERG BY TO CLOSE THE PUBLIC HEARING ON ITEM 4B AT 8:18 P.M. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. 4 Commission Comments/Questions: Ringstad: Replied he is not ready to move ahead with the proposal brought forward this evening due to concerns over meeting the minimum commercial square footage requirements. Kallberg: Replied he is not ready to support the project. Tieman: Replied he cannot support this development at this time. MOTION BY TIEMAN, SECONDED BY RINGSTAD TO RECOMMEND DENIAL OF THE MAJOR AMENDMENT TO THE JEFFERS POND PUD PLAN. VOTE: Ayes by Tieman, Ringstad, and Kallberg. The Motion carried 3-0. 5. Joint Planning Commission and City Council Meeting on Monday, June 20, 2022 McCabe commented there will be a joint Planning Commission and City Council work session on June 20, 2022.
