Simplify the City Code

Current Circumstances
Staff and City Attorney developed proposed amendments.
Planning Commission discussed amendments during two (2) work sessions in 2020.
Two (2) public hearings were conducted by the Planning Commission.

Replaces existing Sections 1102, 1110, 1111, and 1112.
Created Land Use Table (renamed uses located together, no new added).
Reorganized by land use and includes definition, zoning district and status.
Reduces duplication
Ability to see conditions for specific uses across zoning districts

Proposed Sections 1130 & 1132 (Shoreland, Planned Unit Development)
Replaces portions of Sections 1103, 1104, 1106, 1106A & 1106B & 1107
Separate section for Shoreland Regulations
Defines Riparian, cleans up references and consistency with DNR Model Shoreland Ordinance
Separate section for Planned Unit Developments
Clarifies the underlying zoning district determines the allowed uses in a PUD
Increases time to apply for Final PUD Plan approval by CC from 6 to 12 months
Clarifies when Minor Amendments can be authorized by Zoning Administrator
Clarifies a 500-foot radius for notice of public hearing for Major Amendments

Proposed Sections 1140 - 1144 (General, A, R, C, TC and I Performance Standards, Architectural Design)
Replaces existing Section 1107.
Separates Performance Standard sections by Zoning District.
Incorporates Design Standards for TC.
Brick, stone, rusticated concrete block, glass are permitted exterior materials.
Metal, stucco or EIFS are complementary exterior materials and allowed up to 25% of total area of facades adjacent to public ROW or 50% of facades that do not face public ROW.
Earth tone colors (beige, tan, brown, gray) and white nautical colors permitted.
Flat roofs with detailed parapets and/or cornices.

Base/Middle/Top design
Windows/Glass (front elevation base floor = 50% front exterior, middle/upper = 25%)
Transom and Architectural Detailing beyond basic building materials
Awnings, Balconies/Terraces, Murals

Proposed Section 1145 (Landscaping, Trees, Bufferyards and Fences)
Replaces portions of existing Sections 1101, 1102, 1107, and 1113
Consolidates Landscaping, Bufferyards, Trees and Fencing into one section
Expands list of allowable tree species to be consistent with U of MN Extension Office recommendations.
Makes minimum size of replacement and required landscape trees consistent with front yard tree requirements.
Clarifies requirements for tree inventory, tree preservation and tree replacement plans.
Proposed Section 1146 (Parking)
Creates one section for Parking, Loading Spaces and Driveway regulations.
Makes off-street parking requirements more consistent across uses.
Increases parking stall size to be consistent with engineering standards.
Cleans up references and required conformance with PWDM standards.
Prohibits driveway installation over water and sewer services.
Clarifies curb stops prohibited within the driveway.

Proposed Section 1147 (Signs)
Replaces portions of existing Sections 1101, 1102, 1107, and 1113
Creates one section for Signage.
Clarifies sign definitions, allowances, types and sign plan requirements.
Requires Comprehensive Sign Plan for multi-business buildings.
Wall sign allowed for tenants with exclusive, exterior customer entrances.

Modifications since PC
Modified the impervious surface definition to provide additional clarification.
Revised the Downtown Design Standards to allow greater flexibility.
Reduced the setback requirement and physical barrier standard for outdoor play areas for Commercial Daycares in TC, C-1, C-2 Zoning Districts
