Current Circumstances
Staff and City Attorney have developed proposed amendments.
3 work sessions with Planning Commission, 1 work session with City Council
Public hearings in January, February, May and June 2021.
Purpose of the public hearing is to consider amendments to the following Sections:
1101 – General Provisions
1102 – Use District Regulations
1103 – Overlay Districts
1104 – Shoreland Regulations
1106 – Planned Unit Developments
1106A & 1106B – Flexible Development in Areas with High and Moderate Quality Natural Communities
1107 – General Performance Standards
1108 – CUPs, Variances, Amendments and Interim Use Permits
1109 – Administrative Procedures
1110 – Communication Towers
1111 – Adult Uses
1112 – Official Maps
1113 – Signage for Facilities of Regional Significance
Proposed Ordinance Amendments

Proposed Sections 1110, 1111, 1160 & 1161 (Administration)
Replaces existing Section 1101.
Includes general provisions and definitions not related to land uses or floodplain (i.e. alley, building height).
Proposed Table of Contents (TOC)
Reorganized Sections into Articles:
Article 1: Administration
Article 2: Use District
Article 3: Overlay Districts
Article 4: Performance Standards
Article 5: Procedures
Article 6: Miscellaneous
Allows Sections to be added without losing organization of the TOC.

Proposed Ordinance Amendments
Proposed Section 1120-1125 (Use Districts)
Replaces existing Sections 1102, 1110, 1111, and 1112.
Created Land Use Table.
Reorganized by land use and includes definition, zoning district and requirements (i.e. permitted, permitted with conditions, accessory or conditional).

Proposed Sections 1150 - 1155 (Procedures)
Replaces existing Sections 1108 & 1109.
Created separate section for each procedure (i.e. conditional use permit, variance)
Proposed Sections 1130 & 1132 (Overlay Districts)
Replaces existing Sections 1104, 1106, 1106A & 1106B.
Clarified requirements related to retaining walls in bluff and bluff setbacks.
Continued conformance with DNR Model Ordinance.
Proposed Sections 1140 - 1146 (Performance Standards)
Replaces existing Section 1107.
Creates Performance Standards sections by Zoning District.
Incorporates Architectural Design requirements for Town Center (TC) into Zoning Code rather than separate document.
