ORDINANCE NO. 121-16
AN ORDINANCE APPROVING A PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT
AND AMENDING THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE
IN SECTION 1120.200 OF PRIOR LAKE CITY CODE

WHEREAS: Kiehm Construction, Inc., on behalf of the property owner, PL 170th Street, LLC,
has requested approval of a Planned Unit Development (PUD) overlay to be
known as Paul’s Place; and
WHEREAS: The Prior Lake Planning Commission considered the proposed PUD at a public
hearing on September 27, 2021; and
WHEREAS: Notice of the public hearing on said PUD has been duly published in accordance
with the applicable Prior Lake Ordinances; and
WHEREAS: The Planning Commission proceeded to hear all persons interested in this issue
and persons interested were afforded the opportunity to present their views and
objections related to the PUD; and
WHEREAS: The Prior Lake City Council considered the proposed PUD for Paul’s Place on
October 4, 2021; and
WHEREAS: The City Council finds the PUD is compatible with the stated purposes and intent
of the Section 1132 Planned Unit Developments of the Zoning Ordinance.
The City Council of the City of Prior Lake does hereby ordain:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1120.200, is hereby
amended to designate a Planned Unit Development (PUD) Overlay District, to be known as
Paul’s Place, over the following legally described property.
LEGAL DESCRIPTION:
The south 1391.13 feet of the west half of the Southwest Quarter of Section 6, Township 114, Range
21, Scott County, Minnesota, lying west of the of the east 366 feet thereof, Except the west 375.75
feet of the east 741.75 feet of the south 1391.13 feet of the west half of the Southwest Quarter of
Section 6, Township 114, Range 21, Scott County, Minnesota. (PID 259060060)
3. The Paul’s Place Planned Unit Development includes the following elements:
a. The PUD is a self-service storage facility development including three separate self-storage
buildings which total approximately 227,000 square feet.

b. The elements of the plan will be as shown on the plans dated July 12, 2021, except for
modifications approved as part of the final PUD plan.
4. The Prior Lake City Council hereby adopts the following findings:
a. The development provides a flexible approach to development which is in harmony with the
purpose and intent of the City's Comprehensive Plan and Zoning Ordinance. The proposed
PUD is consistent with the Comprehensive Land Use Plan designation for Planned Industrial
uses on this property.
b. The development allows for more creative, efficient, and effective use of land, open space,
and public facilities through mixing of land uses. The PUD approach allows for a decreased
building setback from the east property line to allow for more efficient use of space while
reserving a large portion of developable land for wetlands and storm water management.
c. The development will result in increased economic vitality and expand market opportunities
with the additional of commercial space which will contribute to and diversify the city’s tax base.
d. The development will help support long-term economic stability by strengthening the tax base.
e. The development will extend public utilities to serve the proposed development as well as
providing needed utility services to encourage additional commercial development on adjacent
parcels. The development will also contribute funds to assist with nearby street intersection
improvements will provide a more efficient and effective use of streets.
f. The design of the structures will be compatible with surrounding light industrial land uses.
5. Final plans for Paul’s Place Planned Unit Development are subject to the following conditions:
a. The developer shall revise the plans according to the September 16, 2021 City Engineering &
Public Works Dept. Memorandum
b. The developer shall revise the plans according to the August 5, 2021 City Community
Development Dept. Memorandum
c. The developer shall obtain a grading permit from the City Engineering Department prior to any
grading or tree removal on the site. The City Council resolution shall include a requirement that
the developer/applicant shall address all grading, stormwater, and wetland comments to the
satisfaction of the City Engineer prior to any site work or issuance of a grading permit for the
property.
d. The Developer shall obtain the required permits from other state or local agencies, as applicable,
prior to any site work.
This ordinance shall become effective from and after its passage and publication.
