HomeMy WebLinkAbout4G Text Amendment PC report_Watercraft, Restricted 4646 Dakota Street SE Prior Lake, MN 55372 PLANNING COMMISSION AGENDA REPORT MEETING DATE: July 25, 2022 AGENDA #: 4G PREPARED BY: Casey McCabe, Community Development Director PRESENTED BY: Casey McCabe AGENDA ITEM: Consider Amendments to Prior Lake City Code Section 1111, Definitions, to Include a Definition for Watercraft and Restricted Watercraft DISCUSSION: Introduction The purpose of this public hearing is to consider amendments to Section 1111, of the Zoning Code to include definitions which were unintentionally omitted dur- ing a recent code update. History The Planning Commission reviewed and recommended approval of several amendments to the Zoning Code in 2020 and 2021. The City Council approved the Zoning Code update on June 21, 2021. Current Circumstances Staff has been utilizing the updated Zoning Code since its approval in June 2021. Due to the large scale of the zoning code update project, it was anticipated that minor revisions and amendments would be likely in the months following approval. Staff has found two definitions previously included in the code were unintentionally omitted during the recent code update. Staff is proposing an amendment to Subsection 1111.100, Definitions, to define Watercraft and Restricted Watercraft, which were previously included in the Zoning Code. Watercraft. Any vessel, boat, canoe, raft, barge, sailboard, or any similar device used or useable for carrying and transporting persons on the public waters. Watercraft, Restricted. Watercraft for use on or stored on the public waters ex- cept for the following: 1. Watercraft 16 feet or less in length which uses no motor or a motor of 10 horsepower or less; and 2. Watercraft 20 feet or less in length, which uses no motor and is propelled solely by human power. Conclusion The proposed amendments provide necessary definitions to terms used within the Zoning Code which were unintentionally omitted during a recent code update. Subsection 1153.209 (Policy for Amendments) of the Zoning Code states recom- mendations of the planning commission and final determinations of the city coun- cil shall be supported by findings addressing the relationship of the proposed amendment to the following policies: 2 In the case of amendments to the text of the Zoning Code: ➢ There is a public need for the amendment, or ➢ The amendment will accomplish one or more of the purposes of the Zon- ing Code, the Comprehensive Plan or other adopted plans or policies of the City, or ➢ The adoption of the amendment is consistent with State and/or federal requirements. This amendment is needed as there are currently references in the code to Wa- tercraft and Restricted Watercraft; however, no definitions are provided for clarity. ISSUES: Staff is requesting the planning commission review the proposed Zoning Code amendments, provide any comments, and make a recommendation to the City Council. ALTERNATIVES: 1. Motion and a second to recommend the City Council approve the proposed amendment to Section 1111 of the Prior Lake Zoning Code. 2. Motion and a second to recommend the City Council deny the proposed amendments to Section 1111 of the Prior Lake Zoning Code. 3. Motion and a second to table discussion of the item to a future meeting date and provide staff with direction. RECOMMENDED MOTIONS: Alternative #1
