PRIOR LAKE PLANNING COMMISSION MINUTES
MONDAY, AUGUST 22, 2022
1. Call to Order and Pledge of Allegiance:
Chair Tieman called the MONDAY, AUGUST 22, 2022 Prior Lake Planning Commission meeting to order at 6:00
p.m. Those present were Commissioners Dave Tieman, Dan Ringstad, Jason Tschetter, Doug Johnson, Michael
Tennison, and William Kallberg. Absent were Bryan Fleming. Also present were City Council Liaison Kim
Churchill, Community Development Director Casey McCabe, City Planner Ian Cochran, City Planner Jeff Matzke,
and Administrative Assistant Jess Erickson.
2. Approval of MONDAY, AUGUST 22, 2022 Agenda :
MOTION BY RINGSTAD, SECONDED TSCHETTER TO APPROVE THE MONDAY, AUGUST 22, 2022 PRIOR
LAKE PLANNING COMMISSION AGENDA.
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, and Kallberg.
The Motion carried 5-0.
3. Approval of July 25, 2022 Meeting Minutes:
MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE THE JULY 25, 2022 PRIOR LAKE
PLANNING COMMISSION MEETING MINUTES.
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, and Kallberg.
The Motion carried 5-0.
4. Public Hearings:
A. PDEV 22-000022 – Request for Conditional Permit for 17188 Adelman St SE– David Cripe, on behalf
of the property owner is requesting a CUP to allow for outdoor storage, Class II, at property located in
the I1 (General Industrial) Zoning District at 17188 Adelman St SE. PID: 254270050
Planner Cochran: Introduced the public hearing to consider a conditional use permit to allow outdoor storage,
Class II, in the I-1 (General Industrial) zoning district located at 17188 Adelmann St SE in the 2nd addition of the
Deerfield Industrial Park. Cochran explained the history, current circumstances, physical site characteristics,
issues, conditional use permit analysis and the requirements.
Commission Comments/Questions:
Kallberg: Asked about the surfacing shown on the plan around the perimeter of the storage area.
Cochran: Replied it is currently proposed as gravel on the plan but a condition of approval is to change the area
near the building to asphalt.
Tschetter: Asked if there are air quality, noise concerns, hours of operation that we should take into
consideration.
Cochran: Replied hours of operation from 6 a.m. to 5 p.m. and added the closest residential area is well over
350 ft from site.
Tschetter: Asked if there was any retail land use.
Cochran: Replied there is no proposed retail land use.
Tieman: Asked about truck traffic that would come to the area.
Tennison: Asked about traffic with school buses departing in the morning.
Cochran: Replied the applicant can address truck traffic.
Applicant: David Cripe 22321 Wagon Wheel Trail replied they have mostly 1-ton pickups, four baby dump
trucks, and two Peterbilt dump trucks.
Tieman: Asked how many trips a day.
Cripe: Replied trucks go to the job site and come back at the end of they day and the larger dump trucks may
make a few deliveries per day.

MOTION BY KALLBERG, SECONDED BY TSCHETTER TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT
6:19 P.M.
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, and Kallberg
The Motion carried 5-0.
Commission Comments/Questions:
Tieman: Replied will be supporting. Land use fits the zoning district.
Kallberg: Replied it’s a good use for the property, will be supporting.
Tschetter: Replied no concerns, will be supporting.
Ringstad: Replied will be supporting.
Johnson: Replied it complements the rest of uses in the business park/industrial area.
Tennison: Replied no issues as well.
MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE A CONDITIONAL USE PERMIT FOR
LOT 1, BLOCK 3 OF DEERFIELD INDUSTRIAL PARK 2ND ADDITION
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, and Kallberg.
The Motion carried 5-0.
B. PDEV 22-000023 – Public Hearing – Request for Variances 3770 Green Heights Trail SE – Pebble
Creek Homes, on behalf of the property owner, is requesting variance from the minimum lake setback,
rear yard setback, maximum impervious surface coverage, and minimum lot area to allow construction
of a new single-family dwelling.
Planner Matzke: Introduced the public hearing to consider variances from the minimum lake setback, minimum
rear yard setback, maximum impervious surface coverage, and minimum lot area to allow construction of a new
single-family dwelling located at 3770 Green Heights Trail Se. Matzke explained the history, current
circumstances, issues and recommends a motion.
Commission Comments/Questions:
Ringstad: Asked if the impervious surface is increasing, can you tell us the percentage increase that it is
proposed to be.
Matzke: Replied correct it is increasing, it’s about 27-28% impervious surface for the property improvements,
36% when you add in the private road and public sewer infrastructure (lift station area).
Tschetter: Stated it is one of the most complex variance discussions we’ve had in recent years.

The Motion carried 5-0.
Commission Comments/Questions:
Tieman: Stated thank you to the planning department and the developer with this complex lot, I have no concerns
moving forward.
Tschetter: Stated the question with the impervious surface, with the constraints of the lot it is difficult to maintain
a percentage below the 30% requirement, he will support.
Kallberg: Stated moving the new house further back from lake than the existing house is a plus, very nice
addition to the neighborhood.
Johnson: Stated the lake setback looking at neighboring properties averaging 40.7 feet, the proposed is similar
at 37 feet.
Matzke: Replied, correct 37 feet from bottom of the proposed stairs and 41 feet from the proposed deck.
Ringstad: Stated every variance situation is different and we strive and look for improvement, I believe they
have accomplished improvements over the existing situation given the small, narrow lot constraints.

C. PDEV 22-000024 – Public Hearing – Request for Variance for Lot 18, Green Heights Plat. – Pebble
Creek Homes, on behalf of the property owner, is requesting variances from the minimum front setback,
rear yard setback, rear yard setback, maximum impervious surface coverage, and minimum lot area to
allow construction of a new single-family dwelling.
MATZKE: Introduced the public hearing to consider approval of variances for property located lot 18, Green
Heights Plat. Matzke explained history, current circumstances, issues and recommended a motion.
Commission Comments/Questions:
Ringstad: Asked if there was a house on this property.
Matzke: Replied no there hasn’t been a home on the property previously, it was owned by a property owner that
had two separate, non-contiguous lots in the neighborhood.
Ringstad: Asked if the current zoning is residential and if the lot is being taxed as a buildable lot.
Matzke: Replied correct.
Kallberg: Asked why the city has a 15 -foo t utility easement on the property when there was a platted street.
Matzke: Replied the current utilities were installed in 1973, utilities are deep and therefore maintenance on the
utility line needs a wider area than just the platted roadway area so the City acquired an easement as well.
Tschetter: Asked if the city has any say on the misalignment of Roosevelt Street (the private road) located on
the property and not only within the platted roadway area.
Matzke: Replied City staff has always tried to encourage homeowners to line up their joint private street/driveway
and services. Cabin lots were platted in the early 1900’s so it is challenging to realign these joint areas.
Tschetter: Confirmed it is not because the road is getting wider, it’s because it doesn’t line up to the land.
Matzke: Replied, correct.
Tschetter: Asked if staff can describe the conversations between the applicant and City regarding the requested
variances.
Matzke: Replied the applicant considered a couple different renderings and designs, only ½ ft variance for the
long wall over 60-foot requirement. The applicant has also revised the rear patio originally proposed into a
platform deck to reduce the impervious surface proposed.

MOTION BY KALLBERG, SECONDED BY TSCHETTER TO CLOSE THE PUBLIC HEARING ON ITEM 4C AT
7:03 P.M.
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, Tennison, and Kallberg
The Motion carried 5-0.
Commission Comments/Questions:
Kallberg: Replied it’s a good addition to the neighborhood, will be supporting.
Tschetter: Replied that being developed into a livable lot is an improvement, will be supporting.
Tieman: Replied will be supporting, this Green Heights neighborhood has many older platted cabin lots that
have constraints for modern home construction due to narrow, small lots.
Ringstad: Replied I will be supporting on what is a very challenging lot size situation .
Johnson: Replied will be supporting, makes sense in this area, an improvement for the area.
Tennison: Replied that he agrees with all commissioner’s comment, will be supporting.
MOTION BY RINGSTAD, SECONDED BY TSCHETTER TO ADOPT A RESOLUTION APPROVING THE
VARIANCE FOR LOT 18, GREEN HEIGHTS PLAT WITH LISTED CONDITIONS.
VOTE: Ayes by Tieman, Ringstad, Tschetter, Johnson, and Kallberg.
The Motion carried 5-0.
