HomeMy WebLinkAbout22-146 PL 170th Street LLC Addition Final Plat and DA 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 22-146 A RESOLUTION APPROVING THE FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PL 170TH STREET, LLC ADDITION Motion By: Braid Second By: Thompson WHEREAS, Kiehm Construction, Inc. (the “Developer”), on behalf of the property owner, PL 170th Street, LLC, has submitted an application to the City of Prior Lake for approval of a Final Plat for PL 170th Street, LLC Addition; and WHEREAS, the City Council has found that the final plat of PL 170th Street, LLC Addition is in substantial compliance with the approved preliminary plat of Paul’s Place. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of PL 170th Street, LLC Addition is approved subject to the following conditions, which shall be met by the Developer prior to release and recording of the final plat: a. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney. b. Payment of all fees prior to release of the final plat mylars. c. Three mylar sets of the final plat with all required signatures. d. The final plat and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by March 6, 2023 will render the final plat null and void. e. The developer shall revise the plans according to the November 29, 2022 City Public Works Department Memorandum. 3. The Mayor and City Manager are hereby authorized to execute the Development Agreement on behalf of the City. 4. The Mayor and City Manager are hereby authorized to execute the Assessment Development Agreements for 6010 170th Street East and 6025 170th Street East on behalf of the City. Passed and adopted by the Prior Lake City Council this 5th day of December 2022.
