CALL TO ORDER Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Braid, Burkart, Churchill and Lake. Absent: None. Also in attendance was City Manager Wedel, City Attorney Shepherd and City Clerk Simon. 2.OATH OF OFFICE A. Oath of Office- New Council Member Victor Lake Mayor Briggs presented new Council Member Victor Lake with his Oath of Office. B. Oath of Office- Council Member Re-Elect Kim Churchill Mayor Briggs presented Council Member re-elect Kimberly Churchill with her Oath of Office. 3. PUBLIC FORUM Wesley Steffan, President of the Spring Lake Association; 2350 Raymond Ave Jordan, MN: Introduced himself as the President of the Spring Lake Association. On behalf of the organization, thank you for the financial assistance in supporting our attempt to fix and improve the boat access on Spring Lake. Information from the Watershed District yielded that over 2,000 boats accessed Spring Lake through that boat launch. With the low water levels, getting boats on and off the lake was difficult. Working with Klingberg Excavating and the Department of Natural Resources we were able to fix a spot at the launch caused by power loading boats, which is unfortunately not illegal. If low water levels continue, additional measures will need to be taken moving forward. Would addi- tionally like to thank the City and the Park Supervisor Greg Skluzacek for working with members and residents on Spring Lake in the removal of buckthorn and enhancing the trails at Raymond Park. Kevin Baseheart, 14112 Bayview Circle NE: Thank you for listening to our concerns about the county road 42 reentry home. Wife and I have attended multiple other meetings regarding this same topic. Feel like our concerns have not been listened to. Have spent lots of time reviewing the re- search provided by the County. Questioning the information that was provided at each meeting by the County as it is conflicting information. The ones used in the examples were multi resident dwell- ings such as an apartment complex and no single-family homes. Concerned about the lack of com- munication and lack of supporting data. Collaboration, transparency and communication have dwin- dled. Will keep attending and speaking up as the feeling of safety is immeasurable. Cassandra Johnson, 14104 Hidden View Road NE: Thank you for continuing to listen to us. The lack of collaboration and the lack of community involvement is frustrating. The advisory committee that was brought forward as an option is not acceptable. Why is the responsibility being placed on them to oversee this property? Psychological safety is huge. The relationship between the City and 2 01 04 2023 City Council Meeting Minutes the County has been strained over the years. Ultimately if you don’t feel psychologically safe in raising your voice with your concern, it won’t be heard. If you don’t have an environment where you can be listened to and reciprocated it is a problem. Large strain on the relationship between the neighborhood and the county. While the advisory committee sounds good on paper, the reality is large movements will need to be taken to gain psychological safety where neighbors feel they can be heard and trusted. Andrew Stearns, 14060 Hidden View Road: Few things that are concerning about the re-entry home. A neighbor was watching a few friends and relatives’ kids in her home and the county shut her down claiming she was operating as a daycare facility without a license. But yet this home can commence without a license? The County keeps providing data from Rochester on yearlong pro- grams, but this house will be designed to have the same goals but to be obtained in a 30/60/90-day program. That’s impossible. Setting the house residents up to fail. Worked with many ex-cons. I worked really hard to get to this point in my life to now be part of an experimental program right next door. Would prefer the longer stint/program since they would then have accountability. To me it’s a short-term rental with a revolving door. Unclear on what the house will actually be. Reiterating that we are spending a lot of money for 4 people to revolve through a neighborhood. Jennifer Stearns, 14060 Hidden View Road: Would like to recognize the leadership of the City Council. Acknowledge that this is a difficult task, but the City and Council have handled it well and kept very good communication. Since October, we the citizens and the City Council have been trying to learn more about the County’s intention on the re-entry home intended for our city. It has been clear that the County’s intention was to place this home with no communication which was poor due diligence and public policy. Citizens have brought their concerns to the County with to no avail to gain clarity on this project. The breakdown in communication and stone walling from the County have been very disconcerting. Currently working with the County labor relations regarding this and other violations of the law. All the neighbors were waiting for the County workshop on December 20th. Unfortunately, due to the intentional omission of all of the documents that had been submitted the past 2 months by the neighbors our voice was not included. At this point, we have had ample time to try to understand what this house is and what it is not. We are requesting that City Council puts their support in writing. House is projected to open in March of 2023 so please do not push this off. Taylor Basehart, 14112 Bayview Circle NE: I do feel listened to by the City, but not the County. I have sent over notes to the City Council, biggest concern is the neighborhood committee that was proposed for us to take on was dropped on us not asked of us. That is a large undertaking. Trust has been broken with the County. Entire process and information have to be heavily reviewed as trust has been broken. I do not feel like my voice would be heard by the proposed committee. It is a false value of what our voices are. This home is causing a lot of emotional distress. This is an undertaking that our neighborhood has felt protective of. Afraid that it will break down the neighbor- hood. Clear information should be provided on the legal and data side to ensure safety. 3 01 04 2023 City Council Meeting Minutes Scott Hendrickson, 14109 Bayview Circle NE: Frustrated at how slow the County Attorney is transmitting information. Question about do the occupants pay rent- based on prior meetings is that the occupants do not pay rent as it is provided by grant money and AARPA funds. So, 4 men will move in and have zero equity in this neighborhood, as they have no financial responsibility. After the library meeting, I had emails with the County Administrator asking why no one will tell the City Council or the neighborhood and it was basically stayed they don’t have to. New County commis- sioner who previously was on Shakopee City Council that did not know about the re-entry home in Shakopee until she was brought on the County staff. Linda Eckelman, 4198 Hidden Pond Trail: Questions in terms in our ability to participate who gets into this home? Would like to see and assist in evaluating the people who are coming into this home. As City Council, can you come forward and say the County works for us and request who enters into this home. And what recourse do we have in the event that this is a failure? Wedel: Thank you all for your comments. Common theme was the process in which this house was rolled out. The lack of involvement and foreknowledge of how this house was going to be used with the city and neighborhood is frustrating. A few legal avenues we are still trying to understand, such as how this would or would not fall under the short-term rental ordinance. Waiting on county attorney for contracts. Another is whether this house would need to be licensed with the state. In the mean- time, the City Council did direct staff to put together a letter to the County outlining the City’s desire to use this house for an alternate purpose use such as a short-term housing solution for a family. That letter will be sent to the county in the following days. Briggs: The letter will be signed by each member of the City Council. 4. Approval of the 2023 Tobacco License Holders Briggs: Requesting City Manager Wedel to give a summary of Compliance check on existing li- cense holders. Wedel: We have 9 existing tobacco license holders subject to random compliance checks; we typ- ically do two compliance checks per year. Prior Lake Tobacco and Vape failed in the most recent compliance check and was fined $300 in accordance with MN State Statute and subsequently paid the fine. Three compliance failures within a 36-month period can result in the city suspending or revoking their license. Briggs: This Council has been very concerned with health in our youth.
