RESOLUTION 23-14
A RESOLUTION APPROVING THE DISPOSAL OF REAL PROPERTY

WHEREAS, the City of Prior Lake (City) is proposing to convey certain City-owned property to the
Prior Lake Veterans of Foreign Wars Post 6208 (VFW); and
WHEREAS, the property to be conveyed is legally described as:
That part of the east 14.00 feet, as measured at a right angle, of Lot 3, Block 2, Cates Addition to Prior Lake, according to the recorded plat thereof, Scott County, Minnesota, lying northerly of the westerly extension of a line drawn from a point on the west line of Lot 2, said Block 2, distant 81.00 feet north of the southwest corner of said Lot 2, easterly to a point on the east line of Lot 1, said Block 2, distant 83.20 feet northerly of the southeast corner of said Lot 1. Tax Parcel Identification No. 250020100 (“Subject Property”); and
WHEREAS, in exchange for the transfer of Subject Property, the VFW is proposing to grant a
drainage, utility, and access easement over a portion of VFW-owned property to the City;
and
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the
disposal of any publicly owned interest in real property within the City, or the City Council
may, by resolution adopted by two-thirds vote, dispense with the requirements of this
subdivision when in its judgment it finds that the proposed acquisition or disposal of real
property or capital improvement has no relationship to the comprehensive municipal
plan; and
WHEREAS, the Prior Lake City Council finds the disposal of Subject Property has no relationship to
the City’s comprehensive municipal plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prior Lake that:
1. The disposal of Subject Property has no relationship to the City’s comprehensive municipal plan
and review by the Planning Commission related to disposal of the Subject Property is hereby
dispensed with.
2. The conveyance of the Subject Property by Quit Claim Deed to the VFW is hereby approved
subject to the following conditions:
a. VFW will dedicate an 11-foot drainage, utility, and access easement in favor of the City
over a 1,701 sq. ft. area along the north side of the VFW-owned 4671 Colorado Street
parking lot at no cost.
b. VFW will dedicate a drainage and utility easement in favor of the City over the Subject
Property prior to City transferring ownership of Subject Property. Said drainage and utility
easement shall be recorded immediately after the Quit Claim Deed conveying ownership
of the Subject Property from City to VFW.
c. City shall be responsible for all costs associated with the conveyance of the Subject
Property and closing of the transaction, including, but not limited to, the recording of the
deed and easements and all closing costs necessary to complete the transaction.
3. The Mayor and City Manager are hereby authorized to execute the deed and all other
documents necessary to convey the Subject Property in accordance with the terms of this
Resolution.
ADOPTED by two-thirds vote of the City Council of the City of Prior Lake, this 6th day of February 2023.
