CALL TO ORDER Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Burkart, Churchill and Lake. Absent: Braid. Also in attendance was City Manager Wedel, City Attorney Kendall, Fire Chief Steinhaus, Police Chief Duggan, Parks and Recreation Manager Hart, Public Works Director Brotzler and City Clerk Simon. 2. PUBLIC FORUM Dean Swanson, 14080 Hidden View Road: Speaking on the County Road 42 reentry house. Getting concerned and frustrated as we have heard occupants as early as March of 2023 which is only 6 or 7 weeks away. Not sure if we have heard response from the County on the use of this house. Has there been any response from the County? Are there any things that the City Departments can do to slow this process down? I would invite all of you to take a drive on Hidden View Road and look at the house, and the vantage point they have in this neighborhood. Matt Fulton, 14080 Shady Beach Trail: Thank you Council for submitting a letter to the County regarding the County Road 42 reentry house. It is unfortunate that the county has not responded to the letter as timing is short. Our neighborhood has done an excellent job in engaging people in the conversation. Engagement is always a positive thing. What is unique about this property is this is such an ironic situation as the county has purchased the house for transportation purpose and now that function has changed. And since there was no communication about the use, the city did not have time to re-zone. There is no appropriate zoning for this type of establishment. It is not near a bus line or any employment center, which will result in lower success. That will create higher turnover. In my previous position as a City Manager in other cities, we would have considered the enactment of a moratorium to create time to consider all the implications and consider the neighborhood and residents. Thank you for all that you have been doing, looking forward to finding a resolution for this. Cassie Johnson, 14104 Hidden View Road: Feeling very frustrated and saddened that there has been no movement on the reentry home on County Road 42. We are so grateful for your letter of support, however, would really like to see a moratorium to just add some more time to consider this. The approach from the county was not what we anticipated as the approach was, we do not have to tell you. We have heard your verbal account of support, and support through email and conversations and now we need more action and help. Kevin Baseheart, 14112 Bayview Circle: Thank you to the Council for the communication on the County Road 42 reentry home. The county has not provided the same respect. The way this all started should reflect on how this operation is going to run. Asking the City Council to seriously consider a moratorium to stall the progress of this house until we have more information. 2 01 18 2023 City Council Meeting Minutes Mike Picka, 14107 Hidden View Road: I have spoken before on the County Road 42 reentry house so not sure if I will provide anything new. We have been here, and consistently shown up. How do we see action, more commitment and movement going forward? All signs and evidence show that this is a poor location in multiple ways. No public transportation or large location of employment. Not much evidence that success of small groups of short-term housing is a success. All the data supports larger home and longer-term housing situations. Did not want to save up for decades, to purchase a nice home in a neighborhood to be part of an experimental home. It only takes one mentally unstable person for something to go south. With 16-40 transitioning through the year, what is the likely hood of one of them being a bad apple and creating an incident? Then the residents would have to live with the trauma and fear when there was knowledge to do something to potentially stop it. Everyone wants a very large public stance against the county, possibly in the form of a moratorium. Todd Voth, 14145 Hidden View Road: Agree with all that has previously been said regarding the County Road 42 reentry house. We have been told that it will be funded by a number of government programs for a certain amount of time. What happens when that concludes- who pays for it? And after that, it is basically a rental property managed by the county. As an investment, would any of us put hundreds of thousands of dollars into a property that was supposed to be torn down for road work? We would go find a better use for that and use that money in a better and wiser way. That is not what is happening here. A driveway being put in on Hidden View Road will create traffic equivalent to a small convenience store that is not natural to the neighborhood. This process needs to be slowed down and thought out better. Briggs: Thank you to all the residents for your testimony. Scott County owns this house, and there are State Statutes. No response to the letter sent from this Council from the County has been received. Defer to Manager Wedel and City Attorney Kendall. Wedel: The question on the timing of the response from the county, Lesley Vermillion and I discussed this topic earlier this week and she verbally confirmed we will receive a response by the end of the week. Our intent was to wait and see what that response is, and then we will bring that back to the City Council to talk about next steps based on what is included in their response. Discussions of a moratorium could be on the table, we have approached that topic with the Council and City Attorney already. There are pros and cons with a moratorium. A moratorium could potentially apply because the facility is not licensed, but if they chose to be state licensed there are Statutes that would protect that use in which case we could not have a moratorium against a state licensed facility. Do not want to take action that would inadvertently take away our ability to negotiate with the County on how this house will be used. There is a lot of work that still needs to happen on this, and we are having those conversations with the Council as soon as we receive the response. Briggs: Certainly, being here not have concreteness, the clock is ticking, and the days are going by. I trust that the Citizens have been just as close in conversations with the Scott County Board and County Commissioners. 3 01 18 2023 City Council Meeting Minutes Burkart: I would like to direct staff to draft a moratorium however I don’t believe that would be supported at this time by the rest of the council. The citizens continue to come here and expect action, and you are not receiving it. I don’t see the harm in directing staff to simply draft what a moratorium might look like for us to discuss internally and have ready to vote on at our next meeting. It certainly helps the clock. It is a shot across the bow with the County. And it is ok for us to disagree with the County on a policy. MOTION MADE BY BURKART TO DIRECT STAFF TO DRAFT A MORATORIUM FOR REVIEW BY COUNCIL REGARDING REENTRY HOMES IN OUR COMMUNITY. NO SECOND WAS INITIATED, AND THE MOTION FAILED. Briggs: If the intent is a shot across the bow, it does not bring what the Council wants which is a change for the use of the house. That is not the way to initiate change. 3. Resolution Authorizing the City Manager to Establish a Slow No-Wake Zone on Lower Prior Lake on Saturday, September 9, 2023 City Manager Wedel presented the item. Lake: Would the lake be closed to the public during those hours? Wedel: A portion of lower Prior Lake from Reeds Island to the north would be partially closed. It would not be available to others to be boating around. We can ask the applicant who is here this evening for more specific details. 5 01 18 2023 City Council Meeting Minutes Mike Thibault: It would be a no wake in that part of the lake however it would be open to the public. We will have the course marked off with buoys and we would ask boats to stay out of the course, but we welcome everyone to come out and watch the event. Lakefront Park Master Plan Adoption Parks and Recreation Manager Hart and Public Works Director Brotzler presented the item. Burkart: To clarify, we are just approving the master plan not approving the cost of the entire plan. Thank you to staff and community through this whole process. Lakefront Park is in need of a facelift. Will take our time and be exploratory through this process. Briggs: This project has been in the works for over 2 years, kudos to staff for all the various facets for the community to be involved. As we were reviewing the Lakefront Park master plan, he was the gentleman who attended multiple meetings advocating for tennis courts. He also served on the Prior Lake Spring Lake Watershed District Board. His family is in our thoughts and prayers during this difficult time. 12.
