CALL TO ORDER Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Braid, Burkart, Churchill and Lake. Absent: None. Also in attendance was City Manager Wedel, City Attorney Kendall, Police Chief Duggan, Assistant City Manager Olson, Community Development Director McCabe and City Clerk Simon. 2. PUBLIC FORUM Dean Swanson, 14080 Hidden View Road- Regarding the County Road 42 proposed reentry home; on a personal note, I am hung up on the R1 zoning issues that seem to be glossed over. While it is planned for 4 individuals living here is true, there will also be support staff. How does that fit in a R1 zoning code? Especially with a driveway that was deemed unsafe. A driveway that the County had planned to tear down, will now have substantially more traffic and yet now they have agreed to not move it? Something does not add up. I would request you to draft the moratorium, maybe not send it yet but draft it on the basis of looking into how this house fits into this R1 zoning. If that is a trigger so, be it, they were doing plenty without notification anyways. If we don’t update the zoning now, what is to stop the next time/next house? If starting that process now helps this house, that is great. I have no response to the County and the bullet points they provided in their response to the city. Another thought was taking those agreements that the county mentioned and use them as a negotiation point. Maybe redirect to women who had been incarcerated as women are less likely to reoffend. Maybe we can ask for longer terms in the house- longer stays. The moratorium would allow us time to look at more data from other homes possibly in surrounding counties and town. Matt Fulton, 14080 Shady Beach Trail- Left the work session disappointed. Strikes me that the Council is hesitant to take action for fear of something else happening. I think the state license might be a benefit. I agree with the mayor’s stance on tackling the State Statues as these reentry homes are a unique land use. The city needs to be notified when a facility of this type enters a community. The location is not great, they need to be close to a bus line and employment centers. By altering the R1 zoning code you can set these parameters for houses of this type going forward. To me as a resident, your hesitation is that you are allowing this and will worry about others down the road. The way the County approached this whole project makes me believe that they won’t play nicer next round. I support council taking a stance and a moratorium to guide the land use in this com- munity. I would not worry about the potential impact of a state license. Would like Council to be proactive vs. reactive with something that affects our neighborhood so greatly. Cassie Johnson, 14104 Hidden View Road NE- Also disappointed in the work session. You acknowledged exhaustion surrounding this issue, times that by 1000 for this neighborhood. You 2 02 06 2023 City Council Meeting Minutes don’t want to live in fear, but you also want to be proactive as an adult to prevent things. I have a lot of hesitation of taking the good faith efforts from the county. These good faith efforts mean noth- ing to me now as the trust is broken with the county. If council prepares a response letter, we urge you to state we disagree with the use of this home black and white. Also acknowledge that with the conditions outlined and add more. My other concern is about the community team. 2 residents to 8 city and county officials. If you are not a public speaker, you will not get heard. That is not setting that up for success in the community side. Jennifer Stearns, 14060 Hidden View Road- I live right across the street from this home and have young children. This home has a bird’s eye view into most of my home. I would not feel comfortable having my kids outside or being alone in my home. I do not trust the County. I would prefer that it be licensed and monitored by the state over the people who are responsible now. If you were me, would you state that you agree and back down? Or stand up? I implore you to think about this on a personal level, and what you know is right in your heart and speak up now. Not when the next one comes down the line. (At 3:42 pm on Monday, February 6, 2023, Jennifer Stearns emailed the City Manager a packet of information and letters regarding the County Road 42 reentry house. These documents are attached at the end of the meeting minutes) Briggs: City Manager Wedel, please recap what was discussed at the workshop prior to responding to the Public. Wedel: At tonight’s work session, we did discuss the response letter that the city received as a direct result of the City Council sending them a letter requesting that the house be repurposed. The response we received from Scott County was that they appreciated the letter but they are going to move forward with using the house as a reentry home. That being said, they would agree to the following five conditions: clients living there would have historical ties to Scott County, there would be no sex offenders, no relocation of the driveway, creation of a community committee with repre- sentatives from the neighborhood and additional landscaping barriers and screening. Also, they agreed to additional hours of supervision from the organization they are working with. The letter was reviewed with Council, and we talked through where the city council could go from there. A moratorium was discussed, which the city council could pursue but consequences of that are that the County noted that if we pursue a moratorium they would go around that and get a state license for this house as that would supersede the moratorium. If they did pursue state licensure, there are certain things that they have agreed to in their letter that could potentially come off the table. Things such as the number of tenants could increase from 4 to 6 at a time, allow sex offenders to reside in the house and relocate the driveway out the back to the existing neighborhood. There is a lot of risk with moving forward with a moratorium which is why the direction from council was to not go down that path. There was also discussion about the zoning code and the short-term rental ordinance, and if there were things that we could do in those areas to address things. Ultimately, if the county pursued a state license anything we do with our zoning code is again superseded by state statute. Council agreed that this is something we should be pursuing at the state level. It was also discussed to continue pressure for the use of this home to be changed. The county has made it very clear that will not be an option and they will continue to move forward with this being a reentry home. At the conclusion of the discussion, the direction was to craft a response to the county to memorialize the 3 02 06 2023 City Council Meeting Minutes conditions they outlined in their letter, making sure those are on record for the city archives and records. Related to the zoning, I am going to defer to City Attorney Kendall. Kendall: The zoning authority is effectively preempted by state statutes, stating that licensed group homes shall be a permitted use in R1 zoning districts. The city has no zoning authority to prohibit this use, and it is outlined in a state statute. There could be discussions with the legislature to change the state statutes. My view is not that the council is afraid to go up against the county, its more that the county is not legally required to offer any of these conditions. The council by this decision is trying to look out for the residents the best they can given the circumstances. It is an option to sue the county, but the outcome is uncertain. One thing that is certain, if this is a state licensed facility the city has no ability to prohibit that by zoning. The council is not missing an op- portunity or refusing to exercise authority. Briggs: One of the items that came up in that forum was the creation of that committee. City Man- ager Wedel can I direct this to you. Wedel: Appreciate the comment on the composition or the mix of residents to staff on the commit- tee. I will have more conversations with the county to see if we can modify that group to make it more balanced and have more resident representation. Briggs: We also heard testimony relative to the tone of our letter and be careful that any response to not been seen by the county as agreement of the use. Our intent was to have a memorandum to codify what has been put on the table to ensure they are captured. City Manager Wedel can you expand? Wedel: That is exactly what was discussed in the work session as well. Having a statement at the beginning of the letter that the city does not agree with this use would be something we can incor- porate. That is a consistent message we heard from council, none of the councilors agreed to that proposed use. Under the circumstances, our authority is limited. Jennifer Stearns February 6, 2023 City of Prior Lake Council 4646 Dakota Street SE Prior Lake, MN 55372 Dear Councilors, Thank you for your continued engagement with City residents regarding the County Reentry home on CH42. We’d like to make it clear that the concessions presented by the County in their letter dated on January 24th are not adequate and do not make the surrounding community feel safe nor restore trust in ensuring this project would be properly regulated. As you move forward in the work session this evening we appreciate your diligence examining the legality of this home in an R-1 zone; it is important to clarify how this home applies in this zone as your determination will set a precedent for this type of housing whether by the County or private entities moving forward. The neighbors have discussed a few things we’d like to share and be considered during your discussion this evening. First off, I wanted to make you aware that he County is requesting to increase the ARPA funding for this program from $130,000 per year to more than triple that amount of $400,000 to “increase staff, [unregulated] case management, and actual startup costs” according to Resolution No. 2023-40; this further substantiates this is a business with paid staff, operating budget and traffic/transit to location. As taxpayers, we are also concerned about the eventual tax impact once the grant proceeds expire. Per Resolution 2023-40 to be voted on at the County Board Meeting tomorrow it states that the residents at this location will be supervised by Scott County Corrections staff; a recent article published in SWNews Media quotes Corrections Director Molly Burner saying “that a lot of people on supervision are just receiving basic monitoring. “We’re not meeting with them, we’re not helping them get to treatment, we’re not doing any case management because we can’t”.” There is no guarantee that Damascus Way has the capacity or ability to regulate these individuals. The annual report for the current location, as contractually required, took over 2 months to compile which was a 1 page document with 8 data points. At the last meeting preparing a moratorium did not move forward. A moratorium would be appropriate at this point so this property doesn’t fall under a Legally Non-Conforming Use. That will provide ample time for the City of Prior Lake to clarify how various housing initiatives will fit into the ordinances to protect legitimate businesses and R-1 residents. I have attached a document from the MN DOC Inspection and Enforcement Unit which outlines the requirements to obtain a 2920 license. A few things to note would be that the first requirement is to obtain permission from the city you want to open the facility in which may require a conditional use permit; 24/7 supervision is mandatory as well as 9 other requirements. Additionally, a Certificate of Occupancy would be required. The neighbors would like clarity on what would be a legally binding agreement which would ensure that the County doesn’t not move the driveway down to Hidden View Road or Bayview Circle. The County has stated they would put this in writing but we haven’t seen an official document. Lastly, I have attached a community petition which has been signed by 953 people who don’t believe this is an appropriate location for this type of housing. I would like this letter as well as its attachments to be submitted for the public record for the City Council meeting this evening. WHEREAS, the County entered into an agreement with Damascus Way Re-entry Center, Inc. in 2021 to provide a Re-entry and Halfway Housing Program; and WHEREAS, as part of this program, Damascus Way provides community resources and referrals to clients; and WHEREAS, they collaborate with correctional agents to discuss any issues or behaviors that may be warning signs of relapse and reoffending; and WHEREAS, they will assist clients with locating permanent housing and will meet with potential landlords to advocate on their behalf; and WHEREAS, Amendment No. 1 will increase the not to exceed amount to $400,000 annually to cover increased staffing hours at two houses, case management, and actual startup costs; and WHEREAS, the Contract has extension options through 2026; and WHEREAS, the County has determined that this is an eligible use of the funds under the sections of “responding to COVID-19 - Behavioral Health Care” and “Building Stronger Communities through Investments in Housing and Neighborhoods – Services to address homelessness such as supportive housing, and to improve access to stable, affordable housing among unhoused individuals”; and WHEREAS, the County received $70,000 in funds for fiscal year 2022, and in 2023, an additional $70,000 in funds was awarded; and WHEREAS, the grant allows up to four annual extensions to be awarded to the County (through separate agreements) under the original grant with the Minnesota Department of Corrections; and WHEREAS, the County will utilize American Rescue Plan Act (ARPA) funds for its contribution to the project; and WHEREAS, it has been determined that these expenses are an eligible use of the funds through 2026; and WHEREAS, it is expected that inflation will increase expenses payable under the contract if contract extension options are exercised; and WHEREAS, it is reasonable to authorize the County Administrator to approve contract expense increases that do not exceed 4% over the prior year's maximum contract amount. Since early 2020, Scott County has been impacted by an outbreak of a respiratory disease caused by a novel coronavirus that has been detected across the world, including in Minnesota. On March 11, 2020, the World Health Organization declared COVID-19 as a pandemic. On March 13, 2020, the President of the United States declared a national emergency for the COVID-19 pandemic. On March 13, 2020, the Governor of Minnesota declared a peacetime emergency due to the COVID- 19 pandemic. On March 17, 2020, the Scott County Board of Commissioners declared a local state of emergency due to the COVID-19 pandemic. On March 11, 2021, the Federal Government passed the American Rescue Plan Act (ARPA) of 2021. The Fiscal Recovery Funds are intended to provide support to state, local, and tribal governments in responding to the impact of COVID-19 and in their efforts to contain COVID-19 on their communities, residents, and businesses. The Fiscal Recovery Funds build on and expand the support provided to these governments over the last year, including through the Coronavirus Relief Fund (CRF). Scott County will receive $28.9 million of these funds. The funds may be spent by the local agencies to offset public health and economic impacts of COVID-19. In order to be eligible for the funding, expenditures must be used for one of the following reasons: 1. To respond to the public health emergency or its negative economic impacts. 2. To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers. 3. For the provision of government services to the extent of the reduction in revenue due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year prior to the emergency. 4. To make necessary investments in water, sewer, or broadband infrastructure. On July 20, 2021, the Scott County Board adopted Resolution No. 2021-127; accepting the ARPA funding allocated by the U.S. Department of Treasury in the amount of $28,944.028; establishing a special revenue fund for the allocation; and authorizing the transfer of eligible costs already incurred and to be incurred to said fund. Staff met with the Scott County Board in a workshop setting and were provided high level direction regarding the use of the ARPA funds. One area identified was the use of the funds to provide supportive transitional housing services, including behavioral health services and substance misuse treatment. These services were identified as eligible uses by the Interim Final Rule: Pg. 19 – “Behavioral Health Care. In addition, new or enhanced state, local, and tribal government services may be needed to meet behavioral health needs exacerbated by the pandemic and respond to other public health impacts. These services include mental health treatment, substance misuse treatment, other behavioral health services, hotlines or warmlines, crisis intervention, overdose prevention, infectious disease prevention, and services or outreach to promote access to physical or behavioral health primary care and preventative medicine.” It is also authorized under Building Stronger Communities through investment in Housing and Neighborhoods of the Interim Final Rule: Pg. 39 – “Services to address homelessness such as supportive housing and to improve access to stable, affordable housing among unhoused individuals” The County entered into an agreement with Damascus Way Re-entry Center, Inc. in 2021 to provide a Re-entry and Halfway Housing Program. The goal of the services is to address any barriers to client success. As part of this program, Damascus Way provides community resources and referrals to clients (community social services, AA/NA, legal aid, financial assistance, primary care, mental health, substance use treatment, transportation, employment, education, volunteering, clothing, bus cards, etc.). They collaborate with correctional agents to discuss any issues or behaviors that may be warning signs of relapse and reoffending and will assist clients with locating permanent housing and will meet with potential landlords to advocate on their behalf. Amendment No. 1 will increase the not to exceed amount to $400,000 annually, to cover staffing hours at two locations, case management, and actual startup costs, which will include IT expenses for the installation of security cameras, other IT related expenses, and equipment such as Wi-Fi and computers, and other miscellaneous household items. The Contract has extension options through 2026 and based upon current inflationary trends, it is anticipated that expenses payable by the County under the agreement will increase each year. Staff is requesting that if an extension option is exercised, the County Administrator be given authority to approve contract expense increases that do not exceed 4% over the prior year's maximum contract amount. BUDGET AMENDMENT: No FUNDING DESCRIPTION: On June 15, 2021, the County Board approved the original grant agreement with the Department of Corrections for the Re-entry and Halfway Housing Program. The County received $70,000 in funds for fiscal year 2022, and in 2023, an additional $70,000 in funds was awarded. The grant allows up to four annual extensions to be awarded to the County (through separate agreements) under the original grant with the Minnesota Department of Corrections. Most of the current community facilities are in the metro area. Whether these facilities are full or not varies. There is a small need in outstate Minnesota. To sustain an adult community-based facility there will need to be multiple funding sources, such as county, state and maybe federal. What types of residents are sent to a halfway house? To be licensed as a correctional community-based facility, the majority of your residents need to be there as a condition of probation or supervised release. You can take non-correctional residents also. It is important to be aware that the majority of the clients you would get from the MN Department of Corrections are going to be violent offenders or sex offenders. How do I apply to open an Adult Community-Based Residential Facility? The first thing you need to do is to get approval from the city you want to open the facility in. You also need to have staff 24/7 at the facility. The use was then changed to be used as a transitional re-entry home for incarcerated adult males. These men would have felony convictions, some with violent and sexual oenses, including level 1 and level 2 sexual oenders. This facility is not state licensed or regulated and each former incarcerated man would be housed there for a range of 30 to 90 days. These individuals would rotate through the house on a regular basis. The City of Prior Lake had not been contacted by the County regarding this home being placed in what is classied as an R-1 residential zone. On November 1st, Scott County held a public meeting; over 100 residents were in attendance to learn about this program and also voice their obvious concerns surrounding the safety for residents and the numerous young children who live in the neighborhood. A local in-home daycare provider voiced her fear of losing her license due to the nature of crimes the individuals in the home have been incarcerated for. Others voiced concerns that this property is directly across the street from a public playground. The concerned residents reiterated several times that they agree that Scott County has housing needs and they support nding solutions for those needs. Placing a home of this type is a residential neighborhood is a new model in this County and not supported by any prior data. This process signicantly lacked proper due diligence, coordination with City government, and transparent, community engagement. Last year, a similar facility in a residential zone was opened in Shakopee, MN without the surrounding community’s awareness. The residents simply asked for further discussion and were met with rm opposition by County representatives.
