RESOLUTION APPROVING THE TRANSFER OF PROPERTY FROM THE
CITY OF PRIOR LAKE TO THE PRIOR LAKE ECONOMIC DEVELOPMENT AUTHORITY

the City of Prior Lake (“City”) is proposing to convey certain City-owned property to the Prior
Lake Economic Development Authority (“EDA”); and
the City is the owner of the North 100 feet of Lot 2, Block 1, City Hall Plaza (PID 255650020)
and the North 100 feet of Lot 3, Block 1, City Hall Plaza (PID 255650030), (“Subject
Property”); and
the EDA is the owner of the South 200 feet of Lot 2, Block 1, City Hall Plaza (PID
255650020) and the South 200 feet of Lot 3, Block 1, City Hall Plaza (PID 255650030); and
the City wishes to transfer ownership of the Subject Property to the EDA to facilitate
redevelopment of the properties; and
redevelopment in downtown Prior Lake is supported in various policy and planning
documents of the City, including the 2040 Vision and Strategic Plan and the
Comprehensive Plan; and
Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the disposal
of any publicly owned interest in real property within the City, or the City Council may, by
resolution adopted by two-thirds vote, dispense with the requirements of this subdivision
when in its judgment it finds that the proposed acquisition or disposal of real property or
capital improvement has no relationship to the comprehensive municipal plan; and
the Prior Lake City Council finds the disposal of Subject Property has no relationship to the
City’s comprehensive municipal plan; and
the Prior Lake City Council considered the transfer of the Subject Property on March 6,
2023 and approved the transfer of the Subject Property to the EDA.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The disposal of Subject Property has no relationship to the City’s comprehensive municipal plan and
review by the Planning Commission related to disposal of the Subject Property is hereby dispensed with.
3. The City Attorney is directed to prepare documents necessary for the transfer of the north 100 feet of
Lots 2 and 3, Block 1, City Hall Plaza to the EDA.
4. The Mayor and City Manager are hereby authorized to execute the deed and all other documents
necessary to convey the Subject Property in accordance with the terms of this Resolution.
