HomeMy WebLinkAbout23-043 Radermachers Third Addition FP 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 23-43 A RESOLUTION APPROVING THE RADERMACHERS THIRD ADDITION FINAL PLAT AND DEVELOPMENT AGREEMENT Motion By: Burkart Second By: Braid WHEREAS, WHEREAS, WHEREAS, WHEREAS, Mark Krogh of Java Companies (the “Developer”), on behalf of the property owner, has submitted an application to the City of Prior Lake for approval of a final plat for Radermachers Third Addition; and Radermachers Third Addition is a replat of Outlot C, Radermacher’s First Addition (PID 252820040) to create one commercial lot of approximately 0.93 acres and one Outlot of approximately 2.22 acres that will be reserved for future development; and the Prior Lake City Council approved a preliminary plat known as Radermacher’s Second Addition on January 4, 2023; and following approval of the preliminary plat of Radermacher’s Second Addition, the plat name was changed to Radermachers Third Addition to avoid conflict with another existing plat name; and WHEREAS, the City Council has found that the final plat of Radermachers Third Addition is in substantial compliance with the approved preliminary plat for Radermacher’s Second Addition. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of Radermachers Third Addition is approved subject to the following conditions, which shall be met by the Developer prior to release and recording of the final plat: a. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney. b. Payment of all fees prior to release of the final plat mylars. c. Three mylar sets of the final plat with all required signatures are submitted. d. The final plat and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by June 18, 2023 will render the final plat null and void. 3. The following conditions shall be met by the Developer prior to issuance of a building permit or any grading or work on the site. a. The Developer shall obtain a grading permit from the City Engineering Department. b. The Developer shall obtain required permits from other state or local agencies as applicable. c. The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the Public Works Department dated November 3, 2022. 2 d. The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the Community Development Department dated December 1, 2022. 4. The Mayor and City Manager are hereby authorized to execute the Development Agreement on behalf of the City. Passed and adopted by the Prior Lake City Council this 20th day of March 2023.
