AGENDA ITEM: Approve Update to Memorandum of Agreement with Prior Lake
Spring Lake Watershed District
RECOMMENDED ACTION:
Approve an update to Memorandum of Agreement (MOA) with Prior Lake Spring Lake Watershed
District (PLSLWD) regarding a stormwater management credit deficit for the Downtown South
Reconstruction Project, Fish Point Road Phase 1 Reconstruction Projects and the Fish Point
Phase 2 Reconstruction Project.
BACKGROUND:
As part of citywide street and utility reconstruction projects, the City is required to meet Prior Lake
Spring Lake Watershed Districts Stormwater Management Rules. Their rules include the City
providing water quality treatment for any hard surface that is disturbed during the reconstruction
process.
Reconstruction project areas generally lack space for additional water quality facilities within the
project areas, as such, PLSLWD has worked with the City to establish a credit deficit system
which in turn allows the City to provide stormwater management elsewhere in the City.
The MOA was executed last year between the city and PLSLWD for the City’s stormwater deficit
for the Downtown South and Fish Point Phase 1 project. The attached updated MOA adds the
Fish Point Phase 2 reconstruction project.
FINANCIAL IMPACT:
No immediate financial impacts are present with signing this agreement.
Funding in the amount of $950,000 was included in 2024 Water Quality Fund to complete a large
stormwater management project which will provide credits to accommodate the City’s credit deficit
outlined in the attached MOA, but it will also have a surplus of credits to be allocated to future
reconstruction projects. We estimate that the credit surplus generated by this project will cover
approximately 5 to 7 future reconstruction projects. The design for this project was recently
authorized.
ALTERNATIVES:
1. Motion and second to authorize the Mayor and City Manager to enter into an updated
Memorandum of Agreement with Prior Lake Spring Lake Watershed District.
