HomeMy WebLinkAbout05(G) - Resolution Accepting Public Improvements for the Summit Preserve 1st and 2nd Additions (DEV16-000001) Report ITEM: 5G CITY COUNCIL AGENDA REPORT MEETING DATE: June 5, 2023 PREPARED BY: Christine Watson, Public Works Coordinator PRESENTED BY: Andy Brotzler, Public Works Director/City Engineer AGENDA ITEM: Resolution Accepting Public Improvements for the Summit Preserve 1st and 2nd Additions (DEV16-000001) RECOMMENDED ACTION: Adopt a resolution accepting the public improvements for the Summit Preserve 1st and 2nd Additions. BACKGROUND: This action is called for as part of the development agreement between the Developer and the City. It is the process through which privately installed improvements come into public ownership pursuant to the development agreement. The development agreement outlines the mechanisms for city acceptance of the developer-installed improvements, requiring City Council authorization to accept the improvements in addition to the final written acceptance by the City Engineer. The developer has now completed the improvements as outlined in the development agreements for the Summit Preserve 1st and 2nd Additions. The improvements have been inspected by the city for compliance with city standards and the approved drawings. In some cases, minor field changes were necessary during construction. These improvements, including any field adjustments, were documented in the as-built drawings that were completed by the developer and reviewed by the city. Public Works staff has reviewed the improvements and has written the acceptance letter for these developments. It is now appropriate for the City Council to accept the improvements for these developments. FINANCIAL IMPACT: None ALTERNATIVES: 1. Location map City of Prior Lake | 4646 Dakota Street SE | Prior Lake MN 55372 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 23 - A RESOLUTION ACCEPTING THE IMPROVEMENTS FOR THE STND SUMMIT PRESERVE 1 AND 2 ADDITIONS Motion By: Second By: WHEREAS, the City entered into a development agreements with Lennar, Inc. as indicated by Resolution 17-089 approved May 22, 2017 and Resolution 18-001 approved January 16, 2017; and WHEREAS, the development agreements outlined the improvements the developer was responsible for installing; and WHEREAS, these improvements are now complete to the satisfaction of the city and the city has received the as-built drawings; and WHEREAS, Public Works staff has reviewed the improvements and written the acceptance letter for these developments. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council hereby accepts the improvements for the Summit Preserve 1st and 2nd Additions. 3. Any remaining escrow dollars for construction inspection will be returned to the developer at the conclusion of the warranty period. th Passed and adopted by the Prior Lake City Council this 5 day of June 2023.
