Association in Boudins Bay
RECOMMENDED ACTION:
Approval of a resolution approving a dock modification for the Watersedge Townhomes
Association dock.
BACKGROUND:
The Watersedge Townhomes Association (hereinafter “Association”) is an association of ten
attached homes located on Boudins Bay, south of Boudin Street NE and west of Hwy 13. The
Association is requesting approval to reconfigure their 10-slip dock from 90 degree slips to 45
degree slips to allow for easier navigation.
Current Circumstances
Association members provided staff with a copy of the Minnesota Department of Natural
Resources (DNR) permit (No. 81-6088) dated June 17, 1981 which states, “Docking facilities may
be provided for a maximum of 10 watercraft on the shore of designated area Outlot B, Boudin’s
Manor Fifth Addition, to provide for one dock 120’ long and a 30’ dock and ramp.”
As shown in the attached aerial photo, the Association dock is currently constructed with 90
degree slips, making navigation difficult for the slips closest to shore. The Association is proposing
to reconfigure the slips to 45 degrees, as shown in the second attachment, to make navigation
easier.
Issues
Although the current dock is approximately 100 feet long, the original DNR permit allowed for a
120-foot-long dock. The proposed dock, if approved, would extend approximately 120 feet from
the 904’ ordinary high water elevation. There is currently approximately 75 feet of navigable water
between the current Association dock and the Waters Edge Marina dock located to the immediate
south. If approved, the new dock configuration would reduce the navigable area to approximately
55 feet.
This area of the lake is somewhat unique in that the adjacent lakebed to the south is privately
owned. A parcel of land exists in this area because prior to the channel being opened up through
Watersedge Trail NE around 1970, this area was dry. The Association docks already appear to
be located over this private property and extending the dock an additional 20 feet would expand
the dock further over the property line.
City staff contacted the DNR South Metro Area Hydrologist to inquire whether a dock extending
over a private property line could be anchored or have metal supports in contact with the
privately owned lakebed. DNR staff stated the parcel lines only apply if there is no water, so

the Association could extend the dock, if approved by the City. If water levels recede then the
dock would be located on private property and would need to be relocated if the Association does
not have permission from the property owner.
Conclusion
If the Council is supportive of the dock reconfiguration as proposed, approval of alternateive one
below is appropriate. If the council is not supportive of the proposed dock reconfiguration,
approval of alternative two below is appropriate.
FINANCIAL IMPACT:
No financial impact is anticipated.
ALTERNATIVES:
1. Motion and second to approve a resolution approving a dock modification for the
Watersedge Townhomes Association dock.
2. Motion and second to deny the resolution approving a dock modification.
3. Provide direction to staff and continue discussion at a future meeting.

RESOLUTION APPROVING A DOCK MODIFICATION
FOR THE WATERSEDGE TOWNHOMES ASSOCIATION IN BOUDINS BAY
Motion By: Second By:
WHEREAS, Watersedge Townhomes Association (hereinafter “Association”) is an association of ten
attached homes located on Boudins Bay, south of Boudin Street NE and west of Hwy
13 within PID 252000110; and
WHEREAS, the Association received a Minnesota Department of Natural Resources (DNR) permit
(No. 81-6088) dated June 17, 1981 which states, “Docking facilities may be provided for
a maximum of 10 watercraft on the shore of designated area Outlot B, Boudin’s Manor
Fifth Addition, to provide for one dock 120’ long and a 30’ dock and ramp”; and
WHEREAS, on June 5, 2023, the Prior Lake City Council considered a request from the Association
to extend their existing 10-slip 100 foot dock by 20 feet and reconfigure the dock from
90 degree slips to 45 degree slips to allow for easier navigation; and
WHEREAS, the Prior Lake City Council approved the request from the Association to extend the 10-
slip dock by 20 feet, to 120 feet total, and to reconfigure the dock from 90 degree slips
to 45 degree slips.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Watersedge Townhomes Association is hereby approved to extend the 10-slip dock by 20 feet, to
120 feet total, and to reconfigure the dock from 90 degree slips to 45 degree slips.
