CALL TO ORDER Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Braid, Burkart, Churchill and Lake. Absent: None. Also in attendance was City Manager Wedel, City Attorney Kendall, Police Chief Duggan, Community Development Director McCabe and Clerk Simon. Briggs: Item 9C is being tabled to a future meeting date pending information from the Department of Natural Resources. 2. PUBLIC FORUM Keri Colvin, President Oakland Beach Association: Representing the neighborhood around Oakland Beach and Rustic Road. Concerns with Waters Edge Marina and their configuration of their dock. Currently an L shape, permitted to be a T shape. Still not compliant. Requesting enforce- ment for them to be compliant with their dock. Stan Kempton, 6750 Rustic Road SE: Appointed to be the representative for the Oakland Beach neighborhood, Oakland Beach Association and Boudins Manor. Looking for a follow-up on the di- rective from the Council in regard to Waters Edge Marina and their dock structure. Still in an “L” formation and not in a “T” formation. Water’s Edge Marina believes their permit allows this configu- ration. Wondering who is in charge and why there is so much confusion. Wedel: Water’s Edge Marina was denied their requested dock extension by the City Council. It did take a few weeks to restore the dock to the previous state. Regarding questions on if the permit allows a “T” vs. “L” shape on the end of dock he will defer to Director McCabe. McCabe: Waters Edge Marina did remove the extension as Council directed. The dock was in the shape of a “T” for many years, but the DNR permit did not specify the shape of the end of the dock. They are in compliance with the allowed footage. Same navigation distance. Nothing in the city permits that states that it must be in a “T” shape. Briggs: The point of the shape is to have navigable water; if there is no evidence that the shape is impeding on the navigation what is the necessity of dictating the shape? Braid: Overall goal is for everyone to have navigable water. This pairs with item 9C that we tabled pending more information. Think we should wait until we have more information on the townhome request (item 9C). 2 06 05 2023 City Council Meeting Minutes McCabe: Unsure if the City Council would have authority to control the shape of the dock if it is not specified in the DNR permit. 3.
