HomeMy WebLinkAbout23-097 Disposal of EDA Owned Dakota St. Properties 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 23-97 A RESOLUTION FINDING THE DISPOSAL OF EDA-OWNED PROPERTY AT 4662 AND 4664 DAKOTA STREET SE HAS NO RELATIONSHIP TO THE CITY OF PRIOR LAKE COMPREHENSIVE MUNICIPAL PLAN Motion By: Burkart Second By: Churchill WHEREAS, the Prior Lake Economic Development Authority (“EDA”) owns certain real property in the City of Prior Lake, legally described as: Lots 2 and 3, Block 1, CITY HALL PLAZA, according to the recorded plat thereof, Scott County, Minnesota (PID 255650020 and 255650030) hereinafter referred to as (“Subject Property”); and WHEREAS, the EDA is proposing to sell the Subject Property; and WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the disposal of any publicly owned interest in real property within the City; and WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning Commission review requirement if the City Council, by resolution adopted by two-thirds vote, dispenses with the requirement for Planning Commission review if, in its judgment, the City Council finds that the proposed disposal of real property has no relationship to the comprehensive municipal plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prior Lake that: 1. The disposal of Subject Property has no relationship to the City’s comprehensive municipal plan. 2. Review by the Planning Commission related to the disposal of the Subject Property is hereby dispensed with. Adopted by a two-thirds vote of the City Council of the City of Prior Lake this 17th day of July 2023.
