Call to Order and Pledge of Allegiance: Chair Tschetter called the MONDAY, JULY 10, 2023 Prior Lake Planning Commission meeting to order at 6:00p.m. Those present were Commissioners, Jason Tschetter, William Kallberg, Christian Fenstermacher, Dan Ringstad, and Doug Johnson. Absent was Michael Tennison. Also present were City Council Liaison Kim Churchill, Community Development Director Casey McCabe, Planner Jeff Matzke, and Administrative Assistant Jess Erickson. 2. Approval of MONDAY, JULY 10, 2023 Agenda: MOTION BY RINGSTAD SECONDED BY JOHNSON TO APPROVE THE MONDAY, JULY 10, 2023 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. The Motion carried 5-0. 3. Approval of MONDAY JUNE 12, 2022 Meeting Minutes: MOTION BY JOHNSON, SECONDED BY RINGSTAD TO APPROVE THE MONDAY JUNE 12, 2022 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. The Motion carried 5-0. 4. Public Hearings: A. PDEV23-000021– Variance – 15283 Fairbanks Trl NE – The property owners, Terry & Rhonda Olynyk are requesting variance from the minimum side yard setback to construct a new single-family dwelling on property located at 15283 Fairbanks Trail NE in the R-1SD Zoning District. The property owner plans to construct a home similar to the existing home footprint size but moving the home foundation 2 feet to the east and reducing the driveway width. PID:250360080 Planner Matzke: Introduced the public hearing to consider approval of a resolution approving variances from the minimum sum of the side yard setbacks on a property located in the R-1 (Low Density Residential) zoning district. Matzke explained the history, current circumstances, issues, and concluded that City staff believes the variance is warranted and necessary to allow for construction of a dwelling due to the narrowness of the lot width (40 feet). Commission Comments/Questions: Tschetter: Asked about the separation distance between neighboring structures. Matzke: Replied adequate separation distances will be maintained. Kallberg: Asked about the continuous long walls. Matzke: Replied the proposed design is not long enough to qualify as a long wall. Applicant: Terry Olynyk - 15283 Fairbanks Trl NE commented on the staff presentation and guidance that provided by Planner Matzke which was very helpful. MOTION BY KALLBERG, SECONDED BY RINGSTAD TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:14P.M. VOTE: Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. The Motion carried 5-0. Public Comment: None 2 MOTION BY KALLBERG, SECONDED BY JOHNSON TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:15 P.M. VOTE: Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. The Motion carried 5-0. Commission Comments/Questions: Kallberg: Meets the criteria and appreciates the decrease in impervious surface. Fenstermacher: Meets the requirements and decreases impervious surface. Johnson: Applaud homeowners working with the city and bringing most of this property into compliance. Ringstad: Will be supporting. Tschetter: Will be supporting. MOTION BY KALLBERG, SECONDED BY JOHNSON TO ADOPT A RESOLUTION APPROVING THE VARIANCE REQUESTED FOR 15283 FAIRBANKS TRAIL NE WITH THE LISTED CONDITIONS. VOTE: Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. The Motion carried 5-0. B. PDEV23-000019-PID 255590020-A Major Planned Unit Development (PUD) Amendment-JEFFERS FOUNDATION is proposing a major planned unit development amendment to allow the construction of Office Building/Learning Center. Planner Matzke: Introduced the agenda item to consider a major amendment to the planned unit development (PUD) known as Jeffers Pond for an office building and learning center. The subject property is in the southwest corner of CSAH 42 and CSAH 21 intersection, along Fountain Hills Drive NW. Matzke explained the history, physical site characteristics, issues, and concluded The Jeffers Foundation has chosen to incorporate their own office areas in the Jeffers Pond PUD site. The commercial site plan will satisfy 7,500 square feet of the total 87,000 square feet designated for the commercial areas of Jeffers Pond. Commission Comments/Questions: Tschetter: Inquired if there were sufficient parking stalls for a learning center and asked about this project meeting the goals for commercial square foot development on this parcel. Matzke: provided background on the proposed use as a learning center and indicated sufficient parking will be available and stated there is still an ability to meet the targeted commercial square feet for this development. Ringstad: Asked about potential additional tenants for the office space. Kallberg: Asked about parking and the concern of only one handicap space. Matzke: Replied the accessible parking stalls will be reviewed at the building permit stage and the site will conform with ADA requirements. Applicant: Kelly Johnson Jeffers Foundation 2605 Fernbrook Ln – The Jeffers Foundation has not started marketing the available space yet, but she could envision a dental, attorney, or insurance office use. Daily there will only be two people in the Jeffers Foundation offices. Workshops are one on one with educators with potential group sizes of 25 for a workshop. The building will be of high-quality materials, lots of windows and natural colors. One stormwater pond is being proposed that would accommodate the building as well as future development in the area. Public Comment: None 3 MOTION BY FENSTEMACHER, SECONDED BY KALLBERG TO CLOSE THE PUBLIC HEARING ON ITEM 4B AT 6:38 P.M. VOTE: Kallberg, Tschetter, Fenstermacher, Johnson, Ringstad. MOTION BY JOHNSON, SECONDED BY KALLBERG RECOMMEDING APPROVAL OF THE MAJOR AMENDMENT TO THE JEFFERS POND PUD SUBJECT TO THE LISTED CONDITIONS, OR OTHERS THAT MAY BE ADDED OR MODIFIED BY THE PLANNING COMMISSION.
