CONSIDER RECOMMENDATION OF APPROVAL FOR A REGISTERED
LAND SURVEY AT 3470 SYCAMORE TRAIL SE
DISCUSSION: Introduction
HM Homeworks LLC has applied for the approval of a registered land survey on
approximately 22,400 square feet of land to combine two parcels of land at 3470
Sycamore Trail SE on the shore of Upper Prior Lake, north of TH 13 and west of
Willow Beach Trail.
Current Circumstances
A Registered Land Survey is a survey performed for the identification of
registered (or Torrens) lands in accordance with the requirements of Minnesota
Statutes. The applicant proposes to designate the property as a registered land
survey.
The following paragraphs outline the physical characteristics of the existing site,
the Comprehensive Plan and zoning designations, and a description of some of
the specifics of the site.
PHYSICAL SITE CHARACTERISTICS:
Total Site Area: The total site area consists of approximately 22,400 square
feet. The current property contains one single family home.
Wetlands: No wetlands are located on the properties.
Access: Access to the property is currently from Sycamore Trail.
2040 Comprehensive Plan Designation: The property is designated R-LD for
Urban Low-Density Residential uses on the 2040 Comprehensive Plan Land Use
Map.
Zoning: The property is located within the R-1 Zoning District (Low Density
Residential). The R-1 district is consistent with the proposed R-LD designation.
This district permits a maximum density of 4.0 units per acre.
Shoreland: The property is located within the Shoreland District of Prior Lake
and are subject to the City’s Shoreland Ordinance.
PROPOSED PLAN
Lots: The proposed registered land survey consists of 1 lot. The single
proposed lot is 22,453 square feet and contains the existing house.
Streets: The proposed lot has current frontage on existing Sycamore Trail.
Sanitary Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in
place for the property.
Shoreland Ordinance: The proposed registered land survey is located within
the Shoreland District for Prior Lake and therefore the properties are required to
meet the requirements of the Shoreland Ordinance including but not limited to a
maximum impervious surface area of no more than 30% of the total lot area. The
current impervious surface is approximately 23%.
Conclusion
Prior Lake City Code Subsection 1006.103 states, all registered land surveys in
the City shall be processed in the same manner as a combined preliminary and
final plat application. In accordance with the standards set forth in the Subdivision
Code for combined preliminary plat and final plat applications, the Planning
Commission shall first approve the arrangement, sizes and relationships of
proposed tracts in such registered land surveys, and tracts to be used as
easements or roads should be so indicated. Unless a recommendation and
approval have been obtained from the Planning Commission and City Council
respectively, in accordance with the standards set forth in the Subdivision Code,
building permits will be withheld for buildings on tracts which have been so
subdivided by registered land surveys and the City may refuse to take over tracts
as streets or roads or to improve, repair or maintain any such tracts unless so
approved.
The applicants proposed to combine two existing parcels of land. The combined
parcel will meet the City requirements for the R-1 Zoning District. The proposed
registered land survey will comply with all relevant ordinance provisions and City
standards, provided all the conditions of approval are met. Therefore, City Staff
recommends approval of the registered land survey with the following conditions
of approval:
1. The registered land survey shall be recorded at Scott County within 90 days
of approval by the City Council.
ALTERNATIVES: 1. Motion and a second recommending the City Council approve the registered
land survey.
2. Table this item to a date specific and provide the applicant with direction on
the issues that have been discussed.

1.Subject property's address is 3470 Sycamore Trail SW, Prior Lake, its property
identification numbers are 250980060 & 251950011.
2.The bearing system is based on the Southerly line of Lots 7 and 8,
MAPLEWOOD TOWNSITE which is assumed to bear South 88 degrees 21
minutes 00 seconds West.
3.Field work was completed 4/13/2022.
4.The building(s) and exterior dimensions of the outside wall at ground level are
shown on the survey. It may not be the foundation wall.
5.No specific title search for existence or non-existence of recorded or
un-recorded easements has been conducted by the surveyor as a part of this
survey. Only easements per the recorded plat are shown.
6.The gross area (above the 904 contour) of the subject property is
0.515 Acres or 22,453 square feet.
7.Existing Comprehensive Plan and Zoning classifications, including Shoreland
District boundaries: Urban Low Density, R-1 Low Density Residential, within
the Shoreland District.

All that part of Lots 7 and 8, MAPLEWOOD TOWNSITE, together with that part of
Tract A, REGISTERED LAND SURVEY NO. 94, and the lakeshore adjacent to said Lots
7 and 8, in Government Lot 3, Section 3, Township 114, Range 22, Scott County,
Minnesota, described as follows:
Beginning at the most easterly corner of said Tract A; thence on an assumed
bearing of North 43 degrees 03 minutes 36 seconds West, along the northeasterly
line of said Tract A, a distance of 29.43 feet; thence North 52 degrees 25 minutes
03 seconds West a distance of 196 feet, more or less, to the shoreline of Prior
Lake; thence northeasterly along said shoreline to its intersection with the
northwesterly extension of the northeasterly line of said Lot 7; thence South 29
degrees 18 minutes 08 seconds East, along said northwesterly extension and the
northeasterly line of said Lot 7, a distance of 246 feet, more or less, to the
southeast corner of said Lot 7; thence South 77 degrees 16 minutes 06 seconds
West, along the south line of said Lots 7 and 8, a distance of 60.23 feet to the
point of beginning.
