AGENDA ITEM: Resolution Receiving Quotes and Awarding the Contract for the
Markley Lake Ravine Stabilization Project (CP 2023-04)
RECOMMENDED ACTION:
Adopt a resolution receiving bids and awarding the contract for the Markley Lake Ravine
Stabilization Project (CP 2023-04).
BACKGROUND:
City staff identified a major eroding ravine on city-owned property adjacent to a storage building
on the south side of Markley Lake. Over the years, the ravine has been depositing sediment into
Markley Lake and on the nearby city trail and has eroded to the point where it is threatening to
damage private property to the south. In 2021, staff contracted with WSB & Associates, Inc.
(WSB) to develop a preliminary design to stabilize the ravine to prevent further erosion and
sedimentation. The resulting design memo led the City to include $250,000 for a stabilization
project in the 2023 Water Quality Fund budget.
On March 20, 2023 the City Council authorized a Work Order with WSB to provide the engineering
and construction administration for this project. WSB solicited quotes from 4 contractors to
complete the necessary work, which includes the following companies:
• Bituminous Roadways
• Krueger Excavating
• Kusske Construction
• Sunram Construction
The following quotes were received and opened on 10/09/23:
• Bituminous Roadways, Inc. in the amount of $106,940.00
• Sunram Construction, Inc. in the amount of $174,917.50
• Krueger Excavating, Inc. in the amount of $184,919.00
• Kusske Construction Company, LLC in the amount of $214,480.00
WSB has provided the attached recommendation letter to award the contract to the low bidder,
Bituminous Roadways, Inc., in the amount of $106,940.00. Work is expected to begin in
November 2023 and be substantially completed by April 15, 2024.
FINANCIAL IMPACT:
The 2023 Water Quality Fund includes $250,000 to cover the overhead (engineering) and
construction costs for this project.

RESOLUTION 23-
A RESOLUTION RECEIVING QUOTES AND AWARDING THE CONTRACT FOR THE
MARKLEY LAKE RAVINE STABILIZATION PROJECT (CP 2023-04)
Motion By: Second By:
WHEREAS, there is an eroding ravine on city-owned property that deposits sediment into
Markley Lake, increases maintenance requirements for the city trail, and
threatens to damage private property; and
WHEREAS, WSB & Associates, Inc. (WSB) developed a preliminary design memo
characterizing the problem and proposing an engineering solution; and
WHEREAS, completing a project to repair the eroding ravine will protect water quality in
Markley Lake, prevent further damage to city-owned property, eliminate
sediment deposits on the city-owned trail, and protect adjacent private property
from potential damage; and
WHEREAS, after the preliminary design memo was completed, $250,000 was added to the
Water Quality Fund budget to complete the project in 2023; and
WHEREAS, WSB solicited quotes for the project and received 4 total quotes, with
Bituminous Roadways, Inc. providing the lowest quote in the amount of
$106,940; and
WHEREAS, WSB has provided a letter of recommendation to award the contract to
Bituminous Roadways, Inc.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are hereby authorized to execute the city’s standard contract
with Bituminous Roadways, Inc in the amount of $106,940 for the Markley Lake Ravine
Stabilization Project.
3. The funding for this project will come from the Water Quality fund.
Passed and adopted by the Prior Lake City Council this 16th day of October 2023.

Dear Mayor and Council Members:
Quotes were received for the above-referenced project on Monday, October 9, 2023. A total of
four (4) quotes were received. The quotes were checked for mathematical accuracy. Please find
enclosed the bid summary indicating the low bid as submitted by Bituminous Roadways, Inc. of
Mendota Heights, MN in the amount of $106,940.00 The Engineer’s Estimate was $147,278.00.
We recommend that the City Council consider these bids and award a contract in the amount of
106,940.00 to Bituminous Roadways, Inc. based on the results of the quotes received.
