BACKGROUND: On August 1, 2022, the City Council passed an interim ordinance for a moratorium on low dose hemp derived THC consumable for one year. It was anticipated that the State legislature would address these products in 2023 as part of their session during that time. Unfortunately, the State legislature did not address these products and the City’s moratorium expired on July 31, 2023. In anticipation of the City’s moratorium expiring, on July 13, 2023, the Prior Lake City Council passed ordinance number 123-08 requiring businesses to apply for and obtain a license for the retail sale of low dose hemp derived THC consumables, such as gummy edibles and infused seltzers. This license will be required to be renewed annually moving forward at the beginning of the calendar year until such time the State Office of Cannabis Management assumes licensing authority. Applicant Information: Happy Greens LLC dba Natreum Hemp Wellness 16228 Main Avenue SE Suite 108 Prior Lake, MN 55372 The Prior Lake Police Department has completed an investigation of the applicant to ensure that all requirements and issues concerning public safety and compliance have been met. Additionally, the applicant has provided the required documentation for this license. FINANCIAL IMPACT: The applicant has paid the annual license fee of $700.00. ALTERNATIVES: 1. Motion and second as part of the consent agenda to approve the low dose hemp derived THC consumable license. 2. Motion and second to remove this item from the consent agenda for additional discussion.
