Property owners have granted the city a permanent easement over, under and across the proposed area to be vacated

Recommendation
Motion and second to approve the resolution vacating a portion of the ROW adjacent to 5470 Fairlawn Shores Trail SE
Resolution includes the following:
The applicant shall enter into an easement agreement to allow temporary construction activities and permanent underground utilities within the vacated ROW area
The City Council finds that the vacation of ROW has no relationship to the comprehensive municipal plan and review by the Planning Commission is dispensed with
Resolution requires 4/5 vote due to dispensing with PC review
