HomeMy WebLinkAbout04 - 13755 & 13855 Crest Ave Rezone PC report 4646 Dakota Street SE Prior Lake, MN 55372 PLANNING COMMISSION AGENDA REPORT MEETING DATE: November 27, 2023 AGENDA #: 4A PREPARED BY: Jeff Matzke, Planner PRESENTED BY: PUBLIC HEARING: Paul Moretto, Planner Yes AGENDA ITEM: CONSIDER A ZONING AMENDMENT TO REMOVE A PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT ON PROPERTY AT 13755 & 13855 CREST AVE NE DISCUSSION: Introduction Prior Lake Development LLC, the property owner, is requesting to rezone the property to remove a Planned Unit Development (PUD) overlay from the R-1 Low Density Residential Zoning District on property located east of County Highway 18 (Crest Avenue) and north of Hwy 42 (140th Street) at 13755 and 13855 Crest Avenue NE (PIDs 259240025 & 259240023). History On September 7, 2021 the City Council approved a future low density resi- dential development to be known as The Villas at Crest Woods. The City Council action included rezoning from A, Agricultural to R-1, Low Density Residential; approval of a Preliminary Plat; and approval of a PUD overlay district. Since then, the developer has decided to forego the development plans. On September 7, 2023 The Villas at Crest Woods Preliminary Plat approval expired due to development inactivity. Prior Lake Development LLC requests the PUD overlay designation be removed from the property at this time. Current Circumstances Total Site Area: The total development site area consists of approximately 27.4 acres. Topography: This area has varying topography, with elevations ranging from the 980’ MSL in the northeastern corner to a high point of 1023’ MSL in the northwestern corner of the site. Wetlands: Multiple wetlands exist on the proposed site. The developer does not propose any impacts to the wetlands. Any future impacts would be evaluated under the regulations of the Wetland Conservation Act. Access: The main access to the site is currently from two driveways on Crest Avenue (Hwy 18). 2 2030 Comprehensive Plan Designation: This property is designated for Low Density Residential uses on the 2040 Comprehensive Plan Land Use Map. Zoning: The site is presently zoned R-1 Low Density Residential with a Planned Unit Development (PUD) overlay designation. Conclusion The property owner requests a rezoning to allow removal of the PUD overlay designation from the properties. The site would remain an R-1 Low Density Residential Zoning District which is in conformance with the current 2040 Comprehensive Plan. A single-family home occupies each of the two prop- erties and these homes are allowed to remain until a future subdivision plan is considered. In the future when another development application is submit- ted it will follow the R-1 Zoning standards unless a separate PUD was re- quested. City Staff recommends approval of the rezoning request to remove the PUD overlay designation that was established for The Villas at Crest Woods development. ALTERNATIVES: 1. Motion and a second to recommend approval of the rezoning request to remove the PUD overlay designation. 2. Motion and a second to recommend denial of the rezoning request to remove the PUD overlay designation. 3. Provide direction to staff and continue discussion at a future meeting.
