Based on the mutual promises and covenants set forth herein, the sufficiency of which are hereby acknowledged, the City and Consultant agree as follows: 1. Scope of Work Order. Consultant agrees to provide, perform and complete all the services requested by the City in this Work Order and attached Exhibit 1 (“Work”), which Work shall be subject to the terms and conditions of this Work Order and the Contract. 2. Term of Work Order. All Work requested by this Work Order shall be completed by July 31, 2026. 3. Compensation for Work Order. City agrees to pay the Consultant a fixed sum of $146,770 as full and complete payment for the Work requested by this Work Order. 4. Consultant Representative. Consultant has designated Monica Heil to manage the Work Order subject to the supervision of Consultant’s representative. C O M November 27, 2023 Mr. Nick Monserud Assistant City Public Works Director City of Prior Lake 4646 Dakota St SE Prior Lake, MN 55372 RE: Supplemental Agreement to Provide Professional Engineering Services to complete Final Design, Topographic Survey, and Construction Observation/Administration Support and Testing for the Lords Street Bridge Rehabilitation (Bridge No. 70513) for Dear Mr. Monserud: On behalf of WSB we are pleased to submit this Supplemental Agreement to our Public Works Consultant Pool Master Agreement, dated April 20, 2020 to provide engineering services to the City of Prior Lake. Specifically, our services will include State Aid funding requests and meetings, bridge inspection, rehabilitation design including plan preparation and construction document preparat ion, topographic survey, bidding, and assisting the City with Construction Observation and Administration for rehabilitation of Bridge No. 70513 (Lords Street NE over Prior Lake) as part of the City’s 2025 construction program. PROJECT UNDERSTANDING Bridge No. 70513 carries Lords Street NE over Prior Lake. The bridge currently has an LPI (Local Planning Index) of 55, which means its rehabilitation/repair is eligible for State funding. The bridge is a timber slab span bridge constructed in 1986. The timber deck slab is in good to fair condition ; the timber pier caps are in poor condition; the CIP steel pier piling is in fair to poor condition; the timber abutments are in fair condition; and the timber railings are in fair condition. The bridge is currently load posted due to deterioration of the piers. Bridge rehabilitation and bridge replacement have both been considered as potential ways to upgrade the current conditions and bridge rehabilitation has been selected as the preferred approach. This proposal outlines work needed to design and administer construction of a brid ge rehabilitation project of the piers and other items as outlined in the Tasks below. PROJECT APPROACH/SCOPE OF SERVICES WSB’s project scope and proposed tasks are based on our understanding of the project, and we propose the following scope of services: Task 1 – Topographic Survey WSB will complete the topographic survey for the entire bridge and approaches a minimum of 200 feet beyond each end of the bridge. Survey controls will be set up for the project area followed immediately by the topographic survey of the existing conditions within the road right-of-way. Topographic survey will include 200 feet of adjacent roadways that abut the project area. Survey of all utilities within these areas will be included. Topographic survey data will assist with developing final repair elevations on the bridge and for any pavement rehabilitation methodologies adjacent to the bridge. It is also proposed to complete the Gopher State One Call locate request for maps as a part of the topographic survey work. WSB will serve as an extension of City Staff in these meetings, working with members of the public to identify potential areas of concern and incorporating comments received into the final design of the project. WSB will also meet: 1) monthly (virtually) with City staff to update progress 2) with City and MnDOT State Aid staff to properly submit deliverables and funding requests and address any comments. Task 3 – Final Design Project Management Project management includes the development of the project plan through bidding. This task includes the appropriation of necessary staff and resources at all stages of the final design process to achieve project milestones and completion. This includes f requent communication and coordination with City staff and its agents governing all aspects of the project. Proper completion of this task will allow for open lines of communication and routine updates on project issues, as well as keeping the project on schedule and within budget. Design, Specifications, and Plan Preparation WSB will complete the following tasks: • field investigation to verify bridge and approach condition • bridge funding applications and documentation • design and prepare the project plans consistent with MnDOT Bridge Office and State Aid standards and local regulatory standards. • specifications consistent with MnDOT Bridge Office and State Aid standards, City and local regulatory standards. • project quantities and prepare the project Bid Form. • Engineer’s Opinion of Probable Cost on the final design. • quality control reviews regularly throughout the duration of the design. • project meetings with City staff and design team (WSB staff) members as necessary. The project plans will be generally organized as follows: • Title sheet • General layout • Statement of Estimated Quantities and Tabulations • Bridge Repair details including staging and falsework requirements • Standard details • Removals including environmental restrictions • Traffic staging or detour plans • Minor roadway approach improvement plans • Erosion control • SWPPP Deliverables: • 60% Plan Submittal: Draft bridge repair plan set for MnDOT Bridge State Aid and City review and comment Mr. Nick Monserud November 27, 2023 Page 3 G:\.Clients All\Prior Lake\Proposals\2024 Lords Street Bridge\Prior Lake Lords Street Bridge Rehab Prof. Engineering Services Proposal 11_29_23.docx • 90% Plan and Specification Submittal: Draft plan set and specifications for MnDOT Bridge State Aid and City review and comment • 100% Plan and Specification Submittal: Three (3) 11” x 17” final plan sets and three (3) specifications for your files Permits Prepare the following assumed permit for project: • MNDNR Work in Public Waters Permit Bidding Assistance Prepare the Advertisement for Bid in compliance with the City’s practices; facilitate project bidding by answering contractor questions, prepare the Addenda if necessary, and host the virtual bid opening for the project. The cost to advertise the project will be paid by the City of Prior Lake. WSB will submit the Advertisement for Bid to the local paper and to Finance and Commerce. As-builts WSB will prepare as-builts detailing the scope of the bridge repair elements . Deliverables will include a .pdf version of the as-builts. Task 4 – Assisting the City with Construction Management Construction Staking WSB will provide construction staking and survey for construction of the project. WSB assumes one -time staking for all required staking needs. Any re-staking will be billed at a time and materials hourly rate. Construction Contract Administration WSB will provide Contract Administration services through construction of the project and final project closeout. This will include: • Preparation of materials for and attendance at the preconstruction meeting for the project. • Bi-weekly project progress meetings for the duration of the project • Responding to all contractor requests for information (RFI). • Responding to all City requests for information/clarification during construction. • Labor Compliance interviews and documentation We understand that the City anticipates needing part- to full-time construction observation support for the project. WSB has included construction observation services for the 2025 construction season. We have assumed bridge construction activities will last 8-weeks. It is anticipated that the contract documents will specify that construction can be completed within a 4-month window in the summer of 2025, but that once construction commences, work is to be completed within 8-weeks. We are estimating 40 hours per week of construction observation needs to meet reporting and observation requirements necessitated by the State Bridge Funding requirements. If construction activities are longer in duration, we may need to negotiate additional fees. Should the contractor’s schedule require less than 8-weeks of construction observation and administration support, WSB will only invoice the City for actual hours spent on the job. Mr. Nick Monserud November 27, 2023 Page 4 G:\.Clients All\Prior Lake\Proposals\2024 Lords Street Bridge\Prior Lake Lords Street Bridge Rehab Prof. Engineering Services Proposal 11_29_23.docx Construction Materials Testing WSB will provide the following construction materials testing services for the project: o Perform gradations for reclaimed aggregate, topsoil and bituminous mix (for any roadway patching at the bridge surface) o Perform bituminous density testing o Perform concrete testing as needed • Coordination with City inspection staff to determine testing frequency and locations. • Communicate verbal testing results to the City inspection staff as soon as results are available. • Provide written testing reports to the City within two weeks of testing. • Utilize City survey stationing for all testing results. Schedule Based on our discussions with City Staff, we are proposing the following schedule for the 2025 Lords Street Bridge Rehabilitation Project: • December 2024: Authorize the contract with WSB • December 2023 – April 2024: o Bridge Funding Request o Topographic survey o Bridge Design and Drafting • April 2024: 60% Plans • June 2024: 90% plans and Specifications • July 2024 – Signed Plans and Specification • October 2024 - Approve plans and specifications and authorize ads for bid • November 2024 – Construction letting • May – July 2025: Bridge Construction PROPOSED FEE WSB will provide the services as outlined in Project Approach/Scope of Services. Our budget was developed based on our understanding of the scope and experience with previous bridge reconstruction projects and anticipates 2025 construction. Our proposal has considered estimated year-over-year increases in our annual fee schedule. We estimate an hourly fee not to exceed fee of $146,770.00 The proposed scope and fee presented herein represents our complete understanding of the project based on site visits and discussions with City staff.
