HomeMy WebLinkAbout123-011 Villas at Crest Woods Ordinance 4646 Dakota Street SE Prior Lake, MN 55372 CITY OF PRIOR LAKE ORDINANCE NO. 123-011 AN ORDINANCE APPROVING A ZONING AMENDMENT TO REMOVE A PLANNED UNIT DEVELOPMENT (PUD) OVERLAY DISTRICT ON PROPERTY AT 13755 AND 13855 CREST AVENUE NE The City Council of the City of Prior Lake, Minnesota, ordains: Section 1. On September 7, 2021, at the request of property owner Prior Lake Development, LLC, the Prior Lake City Council approved Ordinance 121-14 amending Section 1120.200 of Prior Lake City Code and the Official Zoning Map for the City of Prior Lake to designate the following legally described property as The Villas At Crest Woods Planned Unit Development (PUD) and rezoning the property from A, Agricultural to R-1, Low Density Residential with a Planned Unit Development (PUD) Overlay District; Legal Description: Section 2. Prior Lake Development, LLC no longer wishes to pursue the development of The Villas at Crest Woods and is requesting an amendment to the Zoning Map to remove the PUD Overlay District; and Page 2 of 3 Section 3. The Prior Lake Planning Commission considered the proposed amendment to the Zoning Map to remove the PUD Overlay District at a public hearing on November 27, 2023; and Section 4. Notice of the Public Hearing on said request has been duly published in accordance with the applicable Prior Lake ordinances; and Section 5. The Planning Commission proceeded to hear all persons interested in this issue and persons interested were afforded the opportunity to present their view and objections related to the request; and Section 6. The Prior Lake City Council considered the request for an amendment to the Zoning Map to remove the PUD Overlay District on December 4, 2023; and Section 7. The Prior Lake City Council finds the request is compatible with the 2040 Comprehensive Plan. The City Council of the City of Prior Lake does hereby ordain: 1. The above recitals are herein fully incorporated herein as set forth above. 2. The Prior Lake Zoning Map, referred to in Prior Lake City Code Subsection 1120.200, is hereby amended to remove the Planned Unit Development Overlay District on the following legally described property.
