Call to Order and Pledge of Allegiance: Chair Tschetter called the MONDAY, SEPTEMBER 11, 2023 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Jason Tschetter, Dan Ringstad, William Kallberg, and Mike Tennison. Also present were City Council Liaison Kim Churchill, Community Development Director Casey McCabe, and Planner Jeff Matzke. 2. Approval of MONDAY, SEPTEMBER 11, 2023 Agenda: MOTION BY TENNISON SECONDED BY KALLBERG TO APPROVE THE MONDAY, SEPTEMBER 11, 2023 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison. The Motion carried 4-0. 3. Approval of MONDAY AUGUST 28, 2023 Meeting Minutes: MOTION BY KALLBERG, SECONDED BY RINGSTAD TO APPROVE THE MONDAY AUGUST 28, 2023 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison. The Motion carried 4-0. 4. Public Hearings: A. PDEV23-000025 – 4846 DAKOTA ST SE– Variance – The property owner requests a variance for a front setback requirement to build a 24'X24' garage. PID 250010830 Planner Matzke: Introduced the public hearing and stated Kathryn Fahrenkamp, the property owner, is requesting a 9.1-foot variance from the required minimum 25-foot front yard setback to allow construction of a new detached garage. The property is located at 4846 Dakota Street SE, east of Trunk State Highway 13 and north of County State Aid Highway 21. Matzke provided an overview of the property, reviewed the variance criteria of Section 1152 and recommended approval of the variance request. Commission Comments/Questions: Kallberg: asked about a chain link fence on the property behind the home that appears to be located in Evanston Avenue right of way. Matzke: commented that if the fence is in the right of way, it may need to be removed if it presents a problem with future city or utility company work. Applicant: Applicant was in attendance, but no comments were made. MOTION BY TENNISON, SECONDED BY KALLBERG TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:09 P.M. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison. The Motion carried 4-0. Public Comment: None. MOTION BY RINGSTAD, SECONDED BY TENNISON TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:10 P.M. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison. The Motion carried 4-0. 2 Commission Comments/Questions: Tschetter: stated no concerns with the request and he will be supporting. Kallberg: commented it is appropriate to have a garage in Minnesota. He will be supporting. Tennison: no additional comments. Ringstad: stated a two-car garage is necessity in Minnesota and the commission has supported two-car garages in the past when possible. He will be supporting. MOTION BY TENNISON, SECONDED BY KALLBERG TO ADOPT A RESOLUTION APPROVING THE VARIANCE REQUESTED FOR 4846 DAKOTA STREET SE WITH THE LISTED CONDITIONS. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison. The Motion carried 4-0. 5. Old Business: None. 6. New Business: None. 7. Announcements & Adjournment: Matzke: informed Commissioners the September 25th Planning Commission meeting has been canceled. MOTION BY KALLBERG, SECONDED BY TENNISON TO ADJOURN THE MONDAY, SEPTEMBER 11, 2023, PLANNING COMMISSION MEETING AT 6:12 P.M. VOTE: Ayes by Tschetter, Ringstad, Kallberg, and Tennison.
