Call Meeting to Order and Pledge of Allegiance Vice-Chair Ringstad called the MONDAY, NOVEMBER 27, 2023 Prior Lake Planning Commission meeting to order at 6:00 P.M. Those present were Commissioners William Kallberg, Michael Pasquarette, Mike Tennison, Christian Fenstermacher and Dan Ringstad. Absent was Jason Tschetter and Doug Johnson. Also present were City Council Liaison Kim Churchill, Community Development Director Casey McCabe, Planner Paul Moretto and Administrative Assistant / Deputy Clerk Megan Kooiman. 2. Approval of Agenda MOTION BY KALLBERG, SECONDED BY FENSTERMACHER TO APPROVE THE MONDAY, NOVEMBER 27, 2023 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Kallberg, Pasquarette, Fenstermacher, Tennison and Ringstad. The Motion carried 5-0. 3. Consider Approval of Monday, September 11, 2023 Meeting Minutes MOTION BY TENNISON, SECONDED BY KALLBERGER TO APPROVE THE MONDAY, SEPTEMBER 11, 2023 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Kallberg, Tennison, and Ringstad. Abstaining by Pasquarette and Fenstermacher, The Motion carried 3-0-2. 4. Public Hearings: A. PDEV23-000027 – 13755 & 13855 CREST AVE NE – Rezoning – Prior Lake Development, LLC is requesting to remove a previously approved Planned Unit Development Overlay District on property at 13755 & 13855 Crest Avenue NE. PIDs 259240025 and 259240023 Planner Moretto: Introduced the hearing of the rezoning of 13755 and 13855 Crest Ave NE. The purpose of the rezoning request is to remove the PUD overlay district. Moretto gave context of the adjacent zoning districts to the south, north and east of the subject property. Moretto discussed the history of the previous Planning Commission and City Council approvals for the site including rezoning, Planned Unit Development overlay district and preliminary plat approval. Moretto noted that as of September 7th, 2023 the preliminary plat has expired. Prior Lake Development LLC, the applicant requested a rezoning to remove the PUD overlay so it will no longer apply and it will revert back to R-1, low density residential. Moretto provided an overview of the property and stated the layout and design are no longer valid due to the 4646 Dakota Street SE Prior Lake, MN 55372 preliminary plat expiration. The underlying zoning of R-1, low density residential is in compliance with the 2040 comprehensive plan. Commission Comments/Questions: None Applicant: MOTION BY KALLBERG, SECONDED BY TENNISON, TO OPEN PUBLIC HEARING ON ITEM 4A AT 6:06 P.M. VOTE: Ayes by Kallberg, Pasquarette, Fenstermacher, Tennison and Ringstad. The Motion carried 5-0. Public Comment: Adam Seraphine (property owner Prior Lake Development LLC) 7455 France Avenue South, Edina: Addressed the Commission to state challenging market conditions have resulted in the project not being financially viable and them not pursuing development at this time. The requested action would allow them to start fresh and evaluate development options in the future. MOTION BY TENNISON, SECONDED BY KALLBERG, TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:08P.M. VOTE: Ayes by Kallberg, Pasquarette, Fenstermacher, Tennison and Ringstad. The Motion carried 5-0. Commission Comments / Questions: Kallberg: commented on the developer’s need to start from square one if the previous project does not make sense for them. Ringstad: Agreed with Kallberg commenting the preliminary plat has expired as of September and honoring the applicants desire to take a breather and regroup on this makes perfect sense, particularly in the challenging market conditions and building conditions that exist today. - Tennison: Agreed and was pleased to hear the developer will working with the city on some other options. Fenstermacher: Agreed with fellow commissioners. Pasquarette: Agreed with fellow commissioners. MOTION BY TENNISON, SECONDED BY FENSTERMACHER, TO APPROVE A RESOLUTION APRROVING A REMOVAL OF PREVIOUS APPROVED PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT ON PROPERTY AT 13755 & 13855 CREST AVENUE NE. VOTE: Ayes by Kallberg, Pasquarette, Fenstermacher, Tennison and Ringstad. The Motion carried 5-0. 5. Old Business: 6. New Business: 7. Announcements & Adjournment Announcements: McCabe: stated staff does not anticipate having a December Planning Commission Meeting. McCabe: commented on City Planner Jeff Matzke leaving the city at the end of this week after 18 years of service to the community. McCabe thanked Jeff for all his work on developments over the years to benefit the city. Ringstad: Commented that Jeff was an important part of the planning department and will be missed and requested staff pass on well wishes to Jeff. MOTION BY FENSTERMACHER, SECONDED BY KALLBERG, TO ADJOURN THE MONDAY, NOVEMBER 27, 2023, PLANNING COMMISSION MEETING AT 6:10 P.M.
