Call to Order and Pledge of Allegiance: Vice Chair Ringstad called the Monday, March 25, 2024 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Jason Tschetter, Dan Ringstad, William Kallberg, Michael Pasquarette, Christian Fenstermacher, Mike Tennison and Doug Johnson. Absent is Jason Tschetter. Also present were City Council Liaison Victor Lake, Community Development Director Casey McCabe, Planner Paul Moretto, and Deputy Clerk / Administrative Assistant Megan Kooiman. 2. Approval of Monday, March 25, 2024 Agenda: MOTION BY KALLBERG SECONDED BY JOHNSON TO APPROVE THE MONDAY, MARCH 25, 2024 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Ringstad, Kallberg, Tennison, Pasquarette, and Johnson. The Motion carried 5-0. 3. Approval of Monday, February 12, 2024, Meeting Minutes: MOTION BY KALLBERG SECONDED BY TENNISON TO APPROVE THE MONDAY, FEBRUARY 12, 2024, PRIOR LAKE PLANNING COMMISSION MEETING MINUTES VOTE: Ayes by Ringstad, Kallberg, Tennison, Pasquarette and Johnson. The Motion carried 5-0. 4. Public Hearings: A. PDEV24-000004 – 2965 Spring Lake RD SW – Variance – Property owners Robert and Nicole Langheim are proposing to construct a new single-family home on the property and are requesting a setback variance from the Ordinary High-Water Level (OHWL) of Spring Lake and the Spring Lake outlet channel. Planner Moretto: Introduced the public hearing to consider a request from Robert and Nicole Langheim for a setback variance from the Ordinary High-Water Level (OHWL) of Spring Lake and the Spring Lake outlet channel for construction of a single-family home. The variance would allow a 20-foot variance from the required minimum Ordinary High-Water. Moretto explained the current circumstances, physical site characteristics, future outcome, and is recommending a motion. Commission Comment/Questions : None. Applicant: Rob Just 15100 Condemn St.: Speaking on behalf of property owners Robert and Nicole Langheim and assisting them with the project. Discussed the site and constraints and felt the new single-family home would be a nice addition to the neighborhood. MOTION BY KALLBERG, SECONDED BY TENNISON TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:09 P.M. VOTE: Ayes by Ringstad, Kallberg, Tennison, Johnson, and Pasquarette. The Motion carried 5-0. Public Comment: None. MOTION BY JOHNSON SECONDED BY PASQUARETTE TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:10 P.M. 2 VOTE: Ayes by Ringstad, Kallberg, Tennison, Johnson, and Pasquarette. The Motion carried 5-0. Commission Comments/Questions: Pasquarette: No Comment Tennison: Impressed with the design and seems to make sense for the neighborhood and the lot. Johnson: Looks like a challenging lot and a lot of consideration went into the project. Kallberg: The home would be a nice improvement for the lot. Ringstad: Noted improvements within the request related to reduced impervious surface coverage and a greater setback from the ordinary high-water level; stated the variance criteria is being met. MOTION BY TENNISON, SECONDED BY KALLBERG TO ADOPT A RESOLUTION APPROVING A VARIANCE FOR 2965 SPRING LAKE RD. SW. VOTE: Ayes by Ringstad, Kallberg, Tennison, Johnson, and Pasquarette. The Motion carried 5-0. 5. Old Business: None. 6. New Business: A. Variance Extension – Prior Lake Revival LLC, the property owner, is requesting an extension to a variance from the zoning code approved as Resolution 23-02PC. The subject property is located south of CH21 between West Avenue SE and Duluth Avenue SE (PIDs: 259021520 and 259021260). Planner Moretto: Introduced the item and provided a history of the February 27, 2023 variance approval from the minimum floor area ratio. Moretto stated the reason for the extension was due to the recent acquisition of two adjacent parcels located west of Prior Lake Revival II site. Moretto commented that the project included an approved variance which required progress to be made within 12 months. The Property Owner has been making progress on the property; however, the acquisition has provided the property owner / developer with an opportunity to maximize the development potential by revising previous stormwater plans. The extension will allow the property owner to revise the stormwater plans. Commission Comments/Questions: Ringstad: questioned how many extensions are available. McCabe: stated the applicant can request an extension of up to 12 months. Ringstad: Commented on the city council approving a six-month extension for the preliminary plat and asked if the Commission should tie a variance extension to match the preliminary plat extension. McCabe: Commented that staff’s though was 12-month extension for the variance would allow time for the developer to begin their project after the final plat is submitted in six months. MOTION BY KALLBERG, SECONDED BY JOHNSON TO APPROVE A DEADLINE EXTENSION OF ONE YEAR FOR A VARIANCE RESOLUTION. VOTE: Ayes by Ringstad, Kallberg, Tennison, Johnson, and Pasquarette. The Motion carried 5-0. 7. Announcements & Adjournment: McCabe: stated there are no items scheduled for the April 8th Planning Commission Meeting and the next meeting will be April 22nd. 3 MOTION BY JOHNSON, SECONDED BY TENNISON TO ADJOURN THE MONDAY, MARCH 25, 2024, PLANNING COMMISSION MEETING AT 6:16 P.M.
