HomeMy WebLinkAbout24-078 CIC 1226 Plat Resolution Phone 952.447.9800 / Fax 952.447.4245 / www.cityofpriorlake.com 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 24-078 RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1226 CIC PLAT MOTION BY: BURKART SECOND BY: LAKE WHEREAS, on December 5, 2022 the City Council approved the Pauls Place Final Plat; and WHEREAS, the buildings which are proposed the be subdivided into a CIC plat are located on an existing platted lot; and WHEREAS, on April 23, 2024, the Prior Lake City Council approved a resolution (Res. #24-043) adopting the assessments for the CH 21/CH 87/170th Street Construction Project CP 2020-29; and WHEREAS, Resolution #24-043 identified a total assessment in the amount of $514,957.14 for the property located at 6010 170th Street East, Prior Lake, MN 55372 (PID 255660010); and WHEREAS, as a result of CIC Plat No. 1226, PID 255660010 will be deactivated, and new Parcel Identification Numbers will be assigned by Scott County; and WHEREAS, the City of Prior Lake shall apportion the pending assessment in the amount of $514,957.14 to the “Additional Real Estate” identified on CIC Plat No. 1226 at 6010 170th Street East, Prior Lake, MN 55372 (PID 255660011); and WHEREAS, apportionment will not materially impair collection of the unpaid balance of the original assessment against the tract; and WHEREAS, the City Council has found the Common Interest Community (CIC) Number 1226 is in substantial compliance with the existing building plan and does not change the site plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that: 1. The above recitals are fully incorporated herein as set forth above. 2. The pending special assessment for the parcel at 6010 170th Street East, Prior Lake, MN 55372 in the amount of $514,957.14 shall be apportioned to the “Additional Real Estate” identified on CIC Plat No. 1226 (PID 255660011). Apportionment will not materially impair collection of the unpaid balance of the original assessment against the tract. 3. The amendment to the CIC plat must be filed with the Scott County Recorder’s Office within 90 days from the date of City Council approval. Failure to record the documents by October 21, 2024 will render the CIC plat null and void. 4. The Mayor and City Manager are hereby authorized to execute the CIC Plat Number 1226 on behalf of the City. Passed and adopted by the Prior Lake City Council this 23rd day of July 2024.
