Based on the mutual promises and covenants set forth herein, the sufficiency of which are hereby acknowledged, the City and Consultant agree as follows: 1. Scope of Work Order. Consultant agrees to provide, perform and complete all the services requested by the City in this Work Order and attached Exhibit 1 (“Work”), which Work shall be subject to the terms and conditions of this Work Order and the Contract. 2. Term of Work Order. All Work requested by this Work Order shall be completed by December 31, 2025. 3. Compensation for Work Order. City agrees to pay the Consultant an amount not to exceed $35,000 as full and complete payment for the Work requested by this Work Order. 4. Consultant Representative. Consultant has designated Jake Newhall to manage the Work Order subject to the supervision of Consultant’s representative. C O M August 13, 2024 Mr. Nick Monserud, PE Assistant Public Works Director City of Prior Lake 4646 Dakota Street SE Prior Lake, MN 55372 Re: Proposal to Provide Preliminary and Final Design and Construction Management for the 2025 Miscellaneous Drainage Project City of Prior Lake, MN Dear Mr. Monserud: Attached for your review and approval is our proposed scope of services, fee, and schedule for providing professional engineering services to complete preliminary and final design and construction management for the 2025 Miscellaneous Drainage Project. This project includes developing the plans, specifications, and cost estimates for drainage related projects throughout the City. Several parts of the project have already been identified, as described below. It is anticipated that other parts of similar scope may also be added. -Lake Theilen Outlet – Structure 5350 o This outlet control structure (OCS) has been clogging repeatedly this spring. It is our understanding that the City is interested in a different design, potentially like the dual outlet structure at Cate’s Creek. -North Wood Meadows – Structure 233 o The pipe has pulled away from the structure and the area around the structure has eroded. It is anticipated that this structure will be reconstructed or replaced, not significantly redesigned. -The Wilds Pond 148 – Structure 4768 o The pipe downstream of the OCS has broken away from the structure due to settlement and/or undermining. It is anticipated that this OCS and the pipes around it won’t be significantly redesigned. o The riprap at the inlet to the pond with this structure is in need of clean up and/or supplementing as part of the project. -Structure 5283 o This OCS was constructed several feet from the berm, rather than tied into it. It is anticipated that the proposed structure will be moved and tied into the berm, but not significantly redesigned. o There is evidence of settlement of the downstream pipe, on the opposite side of the trail from the OCS that should be filled in and cleaned up. -Carriage Hills Parkway and Meadowlawn Trail – Inlet 3476 to Outlet 452 o The pipe connecting storm inlet 3476 and storm outlet 452 has a loose joint. o Water is flowing under and around the inlet apron, eroding soil. o It is anticipated that the pipe will be repaired, not replaced, and a stabilized overflow will be added. -Structure 5359 o The pipe has pulled away from the structure. It is anticipated that the pipe will be reconnected, not significantly redesigned. EXHIBIT 1 Mr. Nick Monserud August 13, 2024 Page 2 We are excited to work with you on this project. Sincerely, WSB Jake Newhall, PE Laura Rescorla, PE Director of Water Resources Project Engineer Attachment ACCEPTED BY: City of Prior Lake, MN Name Title Date Mr. Nick Monserud August 13, 2024 Page 2 SCOPE OF ENGINEERING SERVICES FOR 2025 MISCELLANEOUS DRAINAGE PROJECT FOR THE CITY OF PRIOR LAKE SCOPE OF ENGINEERING SERVICES Task 1 – Project Management ($2,700) Project management will be performed throughout the course of the project. The following subtasks are included as part of Project Management: 1.1 Attend project update meetings with City staff to discuss draft plans, final plans, cost estimates, bidding, and other project variables. This will include developing agendas, preparing handouts and graphics, and attending meetings. 1.2 Work with project team and the City to coordinate project deliverables, schedule, and budget. Deliverables: Two (2) meetings with City staff to review draft plans and final plans. Task 2 – Permit Coordination ($2,500) This task consists of coordinating and obtaining the required permits for the proposed. It is anticipated that only a Wetland Conservation Act (WCA) no-loss application will be needed. Deliverables: Necessary permitting documentation for the WCA. This task does not include any necessary permit application fees; these will be passed on to the City if applicable. Task 3 – Construction Documents ($17,300) This task consists of completing construction plans, specifications, and bidding documents for the 2025 Miscellaneous Drainage Project to maintain and improve drainage infrastructure as previously listed and otherwise identified by the City. It includes topographic survey of the existing pipes and structures and the areas around them. Plans are anticipated to include cover sheet, site plans, erosion control/restoration, and details. An updated cost estimate will be developed to verify consistency between the proposed improvements and the City project budget. This scope assumes answering questions during the bid process to help facilitate the understanding of construction expectations. 3.1 Prepare draft construction plans, specification, and updated cost estimate. 3.2 Finalize construction plans, specification, and bidding documents based on feedback from City staff. Deliverables: Final Plans, Specifications, and Bid Documents. Task 4 – Construction Management ($12,500) Construction management will be performed throughout the course of constructio n. This will include attending the pre-construction meeting as well as progress meetings throughout the project, and other necessary construction coordination. This task will include part-time observation (approximately 10 hours per week). This will include inspection of all critical construction components as well as regular check -ins with the contractor and the City. WSB will also perform the necessary construction staking and survey work. This includes any necessary survey for record drawings. Mr. Nick Monserud July 23, 2024 Page 3 4.1 Attend construction meetings. 4.2 Part-time construction observation. 4.3 Review and approve pay vouchers. 4.4 Construction staking and record drawings. Deliverables: Construction Meetings, Construction Observation, Construction Staking, Record Drawings. TOTAL ESTIMATED ENGINEERING FEE The cost to provide the scope of services outlined in this proposal will be billed hourly, based on our current hourly rates. We are proposing to complete the 2025 Miscellaneous Drainage Project for an hourly not-to-exceed fee of $35,000. TIME SCHEDULE Based on the current project schedule, WSB proposes to complete the draft plans and cost estimates by August 2024 to allow for City budgeting of the project. Final construction documents will be completed by March 2025 to allow for bidding with construction anticipated in the spring/summer of 2025.
