HomeMy WebLinkAbout24-089 Resolution Approving the Final Plat for Radermachers Fourth Addition 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 24-089 A RESOLUTION APPROVING THE FINAL PLAT AND DEVELOPMENT AGREEMENT FOR RADERMACHERS FOURTH ADDITION Motion By: Burkart Second By: Churchill WHEREAS, WHEREAS, WHEREAS, Mark Krogh of Java Prior Lake Retail LLC (the “Developer”), on behalf of the property owner, has applied to the City of Prior Lake for approval of a final plat for Radermachers Fourth Addition; and Radermachers Fourth Addition is a replat of Outlot A, Radermacher’s Third Addition (PID 255670020) to create one commercial lot of approximately 0.75 acres and one commercial lot of approximately 1.47 acres; and the Prior Lake City Council approved a preliminary plat known as Radermacher’s Third Addition on March 20, 2023; and WHEREAS, the City Council has found that the final plat of Radermachers Fourth Addition is in substantial compliance with the approved preliminary plat for Radermacher’s Third Addition. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of Radermachers Fourth Addition is approved subject to the following conditions, which shall be met by the Developer prior to release and recording of the final plat: a. A current title opinion or commitment of title insurance is submitted acceptable to the City Attorney. b. Payment of all fees prior to release of the final plat mylars. c. Three mylar sets of the final plat with all required signatures are submitted. d. The final plat and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by November 16, 2024 will render the final plat null and void. 3. The following conditions shall be met by the Developer prior to issuance of a building permit or any grading or work on the site. a. The Developer shall obtain a grading permit from the City Engineering Department. b. The Developer shall obtain required permits from other state or local agencies as applicable. c. The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the Public Works Department dated July 30, 2024. 4. The Mayor and City Manager are hereby authorized to execute the Development Agreement on behalf of the City.
