Call to Order and Pledge of Allegiance: Chair Tschetter called the Monday, February 12, 2024 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Jason Tschetter, Dan Ringstad, William Kallberg, Michael Pasquarette, Christian Fenstermacher, and Mike Tennison. Absent is Doug Johnson. Also present were City Council Liaison Victor Lake, Community Development Director Casey McCabe, Planner Paul Moretto, and Deputy Clerk / Administrative Assistant Megan Kooiman. 2. Approval of Monday, February 12, 2024 Agenda: MOTION BY RINGSTAD SECONDED BY FENSTERMACHER TO APPROVE THE MONDAY, FEBRUARY 12, 2024 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Tschetter, Ringstad, Kallberg, Tennison, and Fenstermacher. The Motion carried 5-0. 3. Approval of Monday November 27, 2023 Meeting Minutes: MOTION BY FENSTERMACHER SECONDED BY TENNISON TO APPROVE THE MONDAY NOVEMBER 27, 2023 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES VOTE: Ayes by Tschetter, Ringstad, Kallberg, Tennison, and Fenstermacher, The Motion carried 5-0. 4. Public Hearings: A. PDEV24-000025 – 4719 Park Nicollet Ave SE 205 – Conditional Use Permit – Tradition Equipment Leasing, LLC is requesting Conditional Use Permit to allow motor vehicle sales business in the C-2 (General Business) Zoning District located at 4719 Park Nicollet Ave STE 205. Planner Moretto: Introduced the public hearing and stated that the property owner is requesting a CUP to conduct a motor vehicle sales business. The property is located at 4719 Park Nicollet Ave SE 205. Moretto provided an overview of the property and the neighborhood and recommended approval with the additional condition that no vehicles are to be displayed for sale on site. Commission Comments/Questions: None. Applicant: Duane Geiger: 7991 Covered Bridge Rd Prior Lake MN further explained what his plan is for the property and agrees with the conditions that Moretto had recommended. Kallberg: questioned if the business is virtual and that the vehicles will not be stored on the property. Geiger: Explained that most vehicles will be for employee shuttles and are leased throughout the country. Mr. Geiger reassured the Planning Commission that there will not be vehicles stored, displayed, or sold on the property. Tennison: Questioned the applicant about getting his dealer license, will there be any changes to the site when that is obtained. Geiger: No MOTION BY KALLBERG, SECONDED BY RINGSTAD TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:10 P.M. VOTE: Ayes by Tschetter, Ringstad, Kallberg, Tennison, and Fenstermacher. The Motion carried 5-0. 2 Public Comment: None. MOTION BY TENNISON, SECONDED BY KALLBERG TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:11 P.M. VOTE: Ayes by Tschetter, Ringstad, Kallberg, Tennison, and Fenstermacher. The Motion carried 5-0. Commission Comments/Questions: Tschetter: Feels the request is straight forward and appreciates the applicant for moving the business into Prior Lake. Ringstad: in complete support of the new business. Kallberg: States he has no problem with is as long as no vehicles are for sale on the property. He supported the request. MOTION BY RINGSTAD, SECONDED BY KALLBERG TO ADOPT A RESOLUTION APPROVING THE CONDITIONAL USE PERMIT TO ALLOW MOTOR VEHICLE SALES AT 4719 PARK NICOLLET AVENUE SE SUBJECT TO THE LISTED CONDITIONS. VOTE: Ayes by Tschetter, Ringstad, Kallberg, Tennison, and Fenstermacher. The Motion carried 5-0. 5. Old Business: None. 6. New Business: None. 7. Announcements & Adjournment: McCabe: informed Commissioners the March 11th Planning Commission meeting has been canceled. MOTION BY FENSTERMACHER, SECONDED BY KALLBERG TO ADJOURN THE MONDAY, FEBRUARY 12, 2024, PLANNING COMMISSION MEETING AT 6:12 P.M.
