PRIOR LAKE PLANNING COMMISSION MINUTES
Monday, August 26, 2024
1. Call to Order and Pledge of Allegiance:
Chair Tschetter called the Monday, August 26, 2024 Prior Lake Planning Commission meeting to order
at 6:00 p.m. Those presents were Commissioners Jason Tschetter, Michael Pasquarette, and William
Kallberg. Absent Doug Johnson, Christian Fenstermacher, Michael Tennison and Dan Ringstad. Also
present were City Council Liaison Victor Lake, Community Development Director Casey McCabe,
Planner Paul Moretto, and Deputy Clerk / Administrative Assistant Megan Kooiman.
2. Approval of Monday, August 26, 2024 Agenda:
MOTION BY PASQUARETTE SECONDED BY KALLBERG TO APPROVE THE MONDAY, AUGUST
26, 2024 PRIOR LAKE PLANNING COMMISSION AGENDA.
VOTE: Ayes by Tschetter, Pasquarette, and Kallberg.
Motion carried 3-0.
3. Approval of Monday, August 12, 2024, Meeting Minutes:
MOTION BY KALLBERG SECONDED BY PASQUARETTE TO APPROVE THE MONDAY, AUGUST
12, 2024, PRIOR LAKE PLANNING COMMISSION MEETING MINUTES
VOTE: Ayes by Tschetter, Pasquarette, and Kallberg.
Motion carried 3-0.
4. Public Hearings:
None.
5. Old Business:
A. PDEV 24 – 000011 – 14756 COVE AVE SE – Variance – Continuation of Previously
Tabled Item to the Next Meeting – Continuation of Previously Tabled Request for a Variance
from the Minimum Lake Setback on a Property Located at 14756 Cove Avenue.
Planner Moretto: Reintroduced the Item and discussed what changes have been made to the plan
since the item was tabled. The variance was changed to a 1.9 ft variance from a 7 ft variance. Planner
Moretto showed a revised exhibit prepared by a surveyor on behalf of the applicant showing the historic
904 ft. ordinary high water elevation (OHW) based on a survey from 2000 and the current 904 ft.
ordinary high water elevation. Moretto stated the pool location as shown would not require a variance if
the 904 OHW was in the location as shown in the 2000 survey but does require a variance from the
current 904 OHW elevation. Moretto also highlighted revisions to the proposed pool dimensions and
setbacks. Moretto stated staff is recommending approval of the 1.9 ft variance request.
Tschetter: Questioned the proposed plan showing the 904 elevation from a 2000 survey and asked if
we have city documentation that reenforces the 2000 survey
McCabe: Stated the historic OHW elevation came from a survey from the adjacent property from the
year 2000 in the city records.
Tschetter: Stated the historic elevation can be used as provenance to establish a base but confirmed
the variance request is 73.1 ft. as the new survey will override the 2000 survey for consideration.
McCabe: Stated that is correct, staff cannot issue a permit for the pool using the previous setback.
Tschetter: Commented on shorelines moving and about the proposed pool location meeting a 904
OHW that is believed to be the location in 2000.

Moretto: Stated that city staff was unaware of the 2000 survey OHW location when this item was last
considered, but having that information provides more context. This survey provides a snapshot of
history.
Tschetter: Questioned if situations like this will create future confusion later on.
Moretto: Commented about the 2000 survey showing a historic 904 OHW elevation, but the variance
request is based on what exists today, which is a 1.9 ft. variance request.
Tschetter: Confirmed there are no setback averaging rules that would apply.
Moretto: Correct.
Tschetter: Mentioned the impervious coverage of ten percent and confirmed that includes the entire
property around the pond.
Moretto: Correct. That is all net developable area.
Pasquarette: No further questions.
Kallberg: Questioned how much more would they have to cut to not need to a variance.
McCabe: Directed that question to the applicant, also mentioned that applicant did shrink the size of the
pool, shifted it closer to the house, and cut the corner to come closer into conformance with city
regulations.
Jim Morris 18591 Mushtown Rd. Prior Lake: Commented on the initial meetings between staff and the
architect where it was not known a lake setback variance would be required and the original design was
intended to comply with city setback requirements. Mr. Morris highlighted the differences in the OHW
as shown on the 2000 and 2024 surveys. Morris spoke about why the pool is clipped and described the
reasoning of why it is important for the pool to be built as shown to maintain adequate depth for diving.
Tschetter: Wanted to point out that he appreciates the applicants working hard on a solution, further
explaining the request, and for discussions with City Staff. Appreciated detailed explanations such as
pool covers to the commissioners and a better understanding on the pools dimensions.
Kallberg: No questions.
Pasquarette: No questions
Commissioner Comments:
Tschetter: I appreciate the City Staff efforts that have been put in as well. Thank you for putting the time
into this to optimize to this extent we were able to. No Concerns.
Pasquarette: Looks like everyone has done their due diligence to work together to try to find a sweet
spot without affecting the lake nearby.
Kallberg: I now understand that the applicant has made a lot of changes, not just cut the corner of the
pool. Knowing all that I can go along with these recommendations.
MOTION BY KALLBERG, SECONDED BY PASQUARETTE APPROVING A VARIANCE FROM THE
MINIMUN LAKE SETBACK ON A PROPERTY LOCATED IN THE R-1 ZONING DISTRICT

VOTE: Ayes by Tschetter, Pasquarette, and Kallberg.
Motion carried 3-0.
