HomeMy WebLinkAbout24-115 Approving a Major Amendment to the Shepherds Path Planned Unit Development (PUD) 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 24-115 A RESOLUTION APPROVING A MAJOR AMENDMENT TO THE SHEPHERDS PATH PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR SCOTT COUNTY CDA SPECIALIZED EMERGENCY FAMILY HOUSING ON LOT 1, BLOCK 1, SHEPHERDS PATH ADDITION Motion By: Burkart Second By: Churchill WHEREAS, the Scott County CDA, on behalf of the property owner Scott County, is requesting a Major Amendment to the Shepherds Path Planned Unit Development (PUD) Plan to construct 14 units of emergency family housing to be built on a parcel located at: Lot 1, Block 1, Shepherds Path Addition (PID 254520010) Address 13780 McKenna Rd. NW, Prior Lake, MN 55372; and WHEREAS, the City Council approved the original PUD Final Plan for Shepherds Path per Resolution 06-092 on June 26, 2006; and WHEREAS, WHEREAS, WHEREAS, the Prior Lake Planning Commission conducted a public hearing on September 23, 2024, to consider the Major Amendment to the PUD to allow a 14-unit emergency family housing market rate apartment building to be constructed on Lot 1, Block 1, Shepherds Path Addition; and notice of said public hearing was duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinance; and the Prior Lake City Council considered the Major Amendment on October 8,2024; and WHEREAS, WHEREAS, the Planning Commission and City Council have reviewed the Major Amendment to the PUD according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said Major Amendment to the PUD to be consistent with the provisions of said Ordinances; and the City Council has the authority to impose reasonable conditions on a Major Amendment to the PUD. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Planned Unit Development Amendment for Shepherds Path is hereby approved subject to the following conditions: a. The property owner shall receive City staff approval of their Administrative Land Subdivision application and record the necessary documents to finalize the land subdivision prior to issuance of a building permit. b. The property owner shall revise the plans per the September 12, 2024, Engineering/Public Works & Community Development memorandum prior to issuance of a building permit. c. The property owner must obtain the required permits from any other state or local agency prior to any work on the site. 3. The City Council hereby approves the alternative access easement and authorizes city staff to approve the administrative land subdivision request. Passed and adopted by the Prior Lake City Council this 8th day of October 2024.
