History
•Prior Lake and Spring Lake Township have had an orderly
annexation agreement for 50+ years
•First OAA in 1972
•Second OAA in 2003 (expires on 12/31/25)

Annexation Eligibility
•All property within the OAA is eligible for annexation
•Property Owner Initiated Annexation
•If within 150’ of sewer and water
•If the parcel abuts the City and the City’s system has capacity
•The City may, but shall not be obligated, to make public infrastructure available within
2 years
•City Initiated Annexation
•City may initiate annexation for the purpose of extending public infrastructure
•City initiated annexation shall make public infrastructure available within 150’ of all
annexed parcels within 2 years of annexation

Annexation Eligibility (cont’d)
•Township Initiated Island Annexation
•Islands are annexed only by Township initiation
•Township shall notify the City of this request, and
the City has 1 year to initiate the annexation
•City is not obligated to make public infrastructure
available within 2 years to island parcels
•Streets in island areas need to be in good
condition with a recent seal coat and crack seal
prior to annexation

•Within 6 months of approval, City will
transfer ownership of:
•South Shore Park
•Raymond Avenue Park
•Raymond Avenue Natural Area
•Township accepts parcels as-is and
assumes maintenance on date of transfer

Planning & Land Use Control within OAA
•Planning & land use authority is delegated to the City
•Authority includes, but is not limited to:
•annexation, comp plan amendments, CUP, variances, zoning
map and text amendments, building permits, preliminary/final
plats, PUD, RLS, admin. land subdivisions & combinations, and
regulatory authority, permitting, inspections and enforcement of
wetlands

Termination
•OAA terminates when the
entire has been annexed or
50 years has passed,
whichever is longer

•Additional commercial, industrial and residential growth area
•Land use control to ensure development can be planned and implemented effectively
•Allows for more annexation options; eliminates “domino” requirement
•Township Wins
•Retain parcels south of Spring Lake which represent a significant portion of their tax base
•Maintains connection to Spring Lake
•Property Owner Wins
•More flexibility and opportunities to maximize the value of their land through development
at the highest and best use
