Consider a request for a Conditional Use Permit to allow an Animal Han-
dling business at 6025 170th Street E
DISCUSSION: Introduction
Spot’s Last Stop, Inc. is requesting a Conditional Use Permit (CUP) to allow an
Animal Handling business at 6025 170th Street E. The subject property is located
north of CH21, west of Revere Way, and south of 170th St. E (P/O PID
259070010).
Background
Spot’s Last Stop Canine Rescue is proposing to purchase an approximate 1.42-
acre site which includes an existing 54 ft. X 90 ft. (4,860 sq. ft.) building to oper-
ate their business. The space will provide a physical location for canine rescue
and will serve as an animal resource center for the public. Spot’s Last Stop will
utilize this location for canine intake approximately one to two times per month,
which requires an Animal Handling CUP. Animals are proposed to only be
housed within the building for a short time until they are transferred to their foster
homes. The applicant has stated it will be rare that animals would be at this
location overnight or for multiple days. A privacy fence will be installed to provide
an outdoor area for the animals during intake and prior to being placed in a foster
home.
Animal Handling is defined in Subsection 1122.300 of City Code as, the sale,
boarding, breeding, grooming, training, treatment and/or care of privately owned
traditional pets. This use requires a conditional use permit in the A, Agricultural,
C-2, General Business, C-3 Business Park, and I-1, Industrial Districts. The sub-
ject property is currently zoned R-1, low density residential as Prior Lake City
Code automatically designates all annexed property as R-1 on the official zoning
map. The subject property is guided for Retail/General Business on the Compre-
hensive Land Use Plan Map. The attached resolution includes a condition re-
quiring the parcel to be rezoned to C-2, General Business prior to operation of
the Animal Handling business.
The minimum conditions identified in City Code for an Animal Handling CUP are
identified below and will be met by the applicant.
• Animal runs and exercise areas shall be located at least 200 feet from
any dwellings and 100 feet from any buildings used by the public.
• No animals shall be kept outside the building or located in a manner or
location which causes offensive odors discernible at the property line of
the property on which the activity is conducted.

• All principal use activities, including animal boarding, shall be conducted
within the principal structure; except that animal runs may be located out-
door as long as the other conditions in this subsection are met and as
long as animals are not left in the run overnight.
• All outdoor animal runs or exercise areas shall be fenced and secured at
all times so that no animal contained therein may escape such enclo-
sure.
• All buildings in which animals are kept or boarded shall be located a min-
imum of 100 feet from any property line in a residential Zoning District.
• All animals shall be kept in conformance with City Code Section 801.
Current Circumstances
The applicant, Spot’s Last Stop, Inc., is requesting a Conditional Use Permit
(CUP) to allow an Animal Handling business at 6025 170th Street E.
PHYSICAL SITE CHARACTERISTICS:
Total Site Area: The site is approximately 1.42 acres.
Building and Site Conditions: There is an existing 4,860 sq. ft. pole building
on the property. The applicant is proposing building alterations and an interior
remodel, but no building expansion is proposed. The site plan shows a 120 ft. X
45 ft. chain link fence enclosing an outdoor animal area. The applicant has in-
formed staff they will be installing a privacy fence, not a chain link fence.
Parking: Prior Lake City Code requires one parking space for each 200 sq. ft.
of floor area for an Animal Handling use. Based on the building size (4,860 sq.
ft.) a total of 24 parking stalls would be required. The applicant proposes to pro-
vide 20 off street parking spaces on a bituminous surface. Staff is comfortable
with the applicant meeting roughly 80% of the parking requirement because
there is additional property available to accommodate extra parking in the future
if it is needed. It is noted the site plan does not provide the 24 ft. drive aisle
required by City Code; the attached staff memorandum includes a comment that
a revised plan shall be submitted to confirm the required drive aisle is provided.
Access: The applicant is proposing to utilize the existing driveway from 170th
Street as their primary access point. The current driveway providing access from
Revere Way will remain but will have limited use.
2040 Comprehensive Plan Designation: This property is designated Re-
tail/General Business use on the 2040 Comprehensive Plan Land Use Map.
Zoning: The site is zoned R-1, Low Density Residential but shall be rezoned to
C-2, General Commercial to conform with the Comprehensive Land Use Plan
Map.
ISSUES: CONDITIONAL USE PERMIT (CUP) ANALYSIS:
Section 1151.200 of the City Code sets forth the criteria for approval of a CUP.
(1) The use is consistent with and supportive of the goals and
policies of the Comprehensive Plan.

One goal of the 2040 Comprehensive Plan is to “maintain and promote
safe, sound, and connected land use.” The purpose of this goal is to
ensure a balanced and well-planned mix of commercial and industrial
uses. The Conditional Use Permit review and related conditions of
approval finds the Animal Handling use complies with the land use
guidance.
(2) The use will not be detrimental to the health, safety, morals, and
general welfare of the community as a whole.
Based on staff review, the proposed use will not be detrimental to the
health, safety, morals and general welfare of the community. The con-
ditions of the approving resolution are intended to ensure ongoing pro-
tection of the community.
(3) The use is consistent with the intent and purpose of the Zoning
Code and the Use District in which the Conditional Use is located.
The conditions set forth in the Zoning Code will be met with the
issuance of the Conditional Use Permit and rezoning of the property to
C-2, General Business.
(4) The use will not have undue adverse impacts on governmental fa-
cilities, services, or improvements which are either existing or
proposed.
The use will not have adverse impacts on governmental facilities.
(5) The use will not have undue adverse impacts on the use and en-
joyment of properties in close proximity to the conditional use.
The use will not have undue adverse impacts on the use and enjoyment
of properties in close proximity as long as all conditions of approval are
adhered to.
(6) The use is subject to the design and other requirements of site
and landscape plans prepared by or under the direction of a pro-
fessional landscape architect, or civil engineer registered in the
State of Minnesota.
The applicant is proposing to utilize an existing building and property
which is already developed. No building additions are proposed. The
applicant shall comply with Prior Lake City Code and Building Code
requirements related to building modifications and planned improve-
ments.
(7) The use is subject to drainage and utility plans prepared by a
professional civil engineer registered in the State of Minnesota
which illustrate locations of city water, city sewer, fire hydrants,
manholes, power, telephone and cable lines, natural gas mains,
and other service facilities.
The applicant is proposing to utilize an existing building and property
which is already developed. The applicant is proposing to connect the
building to available municipal water and sanitary sewer utilities which
are not currently connected. A utility plan prepared by a professional
civil engineer registered in the State of Minnesota shall be submitted
for review and approval by City staff prior to any utility connection.

(8) The use is subject to such other additional conditions which the
Planning Commission may find necessary to protect the general
welfare, public safety and neighborhood character. Such
additional conditions may be imposed in those situations where
the other dimensional standards, performance standards,
conditions or requirements in this Ordinance are insufficient to
achieve the objectives contained in subsection 1151.204. In these
circumstances, the City Council may impose restrictions and
conditions on the CUP which are more stringent than those set
forth in the Ordinance and which are consistent with the general
conditions above. The additional conditions shall be set forth in
the CUP approved by the City Council.
Additional conditions to ensure the protection of the general health,
safety and welfare of the public are included as part of the CUP
resolution and within a city staff memorandum dated November 4,
2024.
Issues
The subject property is a portion of a larger parcel that is proposed for subdivi-
sion as part of a combined preliminary and final plat to be known as Revere
Addition. The attached resolution shall be amended by staff to include the correct
parcel identification number and shall be recorded at Scott County following ap-
proval and recording of the final plat of Revere Addition.
Conclusion
City Staff recommends approval of the CUP with the following conditions:
1. The applicant shall address all comments in the City staff memorandum
dated November 4, 2024 prior to operation of the Animal Handling business.
2. The parcel shall be rezoned to C-2, General Business prior to operation of
the Animal Handling business.
ALTERNATIVES: 1. Motion and a second to approve a Conditional Use Permit to allow an Animal
Handling business at 6025 170th Street E subject to the listed conditions.
2. Motion and a second to deny the request based on specific findings of fact.
3. Provide direction to staff and continue discussion at a future meeting.

RESOLUTION TO APPROVE A CONDITIONAL USE PERMIT TO ALLOW
AN ANIMAL HANDLING BUSINESS AT 6025 170TH STREET E

The Prior Lake Planning Commission conducted a public hearing on November 13, 2024
to consider a request from Spot’s Last Stop, Inc. for a Conditional Use Permit (CUP) to
allow an Animal Handling business at 6025 170th Street E; and
The property is legally described as:
Lot 1, Block 1, Revere Addition, Scott County, Minnesota (P/O PID 259070010); and
WHEREAS, Notice of the public hearing on said CUP was duly published in accordance with the
applicable Prior Lake Ordinances; and
WHEREAS, The Planning Commission proceeded to hear all persons interested in this CUP, and
persons interested were afforded the opportunity to present their views and objections
related to the CUP; and
WHEREAS, The Planning Commission finds the proposed CUP is compatible with the stated
purposes and intent of the Zoning Ordinance as they relate to conditionally permitted
uses, and further, that the proposed CUP meets the criteria for approval of CUP as
contained in Subsection 1110.500, 1151.100, and 1151.200 of the Prior Lake Zoning
Ordinance.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING COMMISSION, ACTING AS
THE BOARD OF ADJUSTMENT, OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Planning Commission hereby adopts the following findings:
a. The use is consistent with and supportive of the goals and policies of the
Comprehensive Plan.

Re: Spot’s Last Stop CUP Review Memo
We have reviewed the preliminary design and site plan submitted on October 31, 2024 and prepared by
Kiehm Construction, Inc. and have the following comments.
General
1. Submit for and provide copies to the City of all required permits from regulatory agencies (MCES,
Minnesota Pollution Control Agency, Minnesota Department of Health, NPDES, etc.)
Site Plan
1. The parking lot drive aisle shall provide a minimum width of 24 ft. between parking stalls.
2. The site plan identifies a gravel surface over the entire lot which is not covered by structure or
bituminous surface. The site plan shall be revised prior to submitting a building permit application
to identify grass/turf areas. No gravel parking or driving surfaces are permitted on the site.
3. A building permit shall be issued by the City of Prior Lake prior to any construction activities on
the site. The applicant shall comply with Prior Lake City Code and Building Code requirements
related to building modifications and planned improvements.
4. A separate fence permit shall be issued by the City of Prior Lake prior to the fence being
constructed on the property. The fence permit shall identify a privacy fence instead of chain link
fence.
5. A separate sign permit shall be issued by the City of Prior Lake prior to any signage being installed
on the property.
6. The building shall be connected to the City sanitary sewer and water service and the existing
holding tank shall be abandoned per MN Rule Ch 7080 requirements.
a. A utility plan prepared by a professional civil engineer registered in the State of Minnesota
shall be submitted for review and approval by City staff prior to any utility connection.
b. The holding tank shall be pumped and the company doing the abandonment shall contact
Scott County Environmental Services Department to obtain a pump permit.
c. A septic abandonment report form must be completed and submitted to the Scott County
Environmental Services Department when the abandonment has been completed.
7. The parcel shall be rezoned to C-2, General Business prior to operation of the Animal Handling
business.
8. No ponding, berming, signage, or landscaping is permitted in the County right of way, and any
work within the right of way shall require a county permit.

Abandoning a sub-surface sewage treatment system
Guidance and requirements for abandoning a septic system
A sub-surface sewage treatment system (SSTS) can either be abandoned in place or removed from the site. The
person or business abandoning the system must complete and sign a record of abandonment and send it to the
local government unit with 90 days of abandonment.
Minnesota law requires that a seller disclose a property’s abandoned septic system to buyers prior to signing an
agreement to sell or transfer. The disclosure must include a map showing the system location.
Abandoning systems in place
For sewage tanks, cesspools, leaching pits, drywells, seepage pits, vault and pit privies, and distribution devices:
• A licensed professional must remove and dispose of all septage (solids and liquids) in accordance with
Minn. R. 7080.2450, subp. 6. If the business disposes of the septage at a sewage treatment facility, it
must have a written agreement with the accepting facility. If the septage is disposed by land application,
ensure federal requirements are met (see the MPCA’s septage management guidelines) along with local
requirements, if they exist.
• All mercury-containing and electrical devices must be removed and disposed of according to applicable
regulations.
• Abandoned tanks or other underground cavities must be crushed and the remaining cavity filled with
soil or rock.
Abandonment activities other than septage removal must conform to Minn. R. 7080.2500, but can be performed
by contractors without SSTS licenses.
The drainfield can remain in place. Inspection pipes may be removed, backfilled, and disposed of in a mixed
municipal solid waste landfill.
No future discharge can have access to the system; ensure this by removing the piping or filling the end of the
supply pipe with grout.
Removing abandoned systems
It’s critical to prevent human contact with the contaminated materials, including the distribution media, soil, or
sand within three feet of the system bottom, distribution pipes, sewage tanks, and any soils around leaky
sewage tanks or that received sewage from a surfacing effluent. Contaminated distribution piping, manifold,
geotextile fabric, and other materials must be dried and disposed of in a mixed municipal solid waste landfill;
they can’t be taken to a demolition landfill.
Contaminated soil may be stockpiled prior to final disposal to allow pathogens to die off. The stockpile must
conform to SSTS separation distances, including well and property line setbacks, and a three-foot vertical
separation to periodically saturated soil or bedrock. The stockpiled material must be covered with a minimum of
six inches of uncontaminated soil and be protected from erosion. Contact the local government to check for
additional or stricter ordinance requirements.

If the soil is stockpiled for at least a year, it may be land applied in any place meeting the setback requirements
of Minn. R. 4725.4450, covered with at least six inches of uncontaminated soil, and protected from erosion. It
may also be used to fill in the abandoned tank cavities.

This form is offered to meet the abandonment requirements of Minn. R. 7080.2500 and Disclosure Requirements of Minn. Stat.
