RECOMMENDED ACTION:
Adopt a resolution ordering the improvements for the Martindale Henning Hickory Reclamation
Project (CP 2025-03). A 4/5 vote is required to approve the resolution to order the
improvements.
BACKGROUND:
The City uses a Capital Improvement Program to plan its infrastructure improvements and the
financing for capital improvements. The Martindale-Henning-Hickory Reclamation Project
includes full-depth reclamation for Martindale St NE, Henning Cir NE and Hickory Ave NE, as well
as some stormwater drainage improvements throughout the project area shown on the attached
location map.
The M.S. Chapter 429 process applies to all projects that will be financed in whole or in part
through special assessments or bond proceeds. The Feasibility Report, which was approved by
the City Council at the June 25, 2024 meeting, includes total estimated costs, preliminary
assessment amounts, and a project financing summary. The report, which has been shared with
residents via the project website, outlines which portions of the cost will be assessed to the
benefiting properties.
A public hearing was conducted on July 23, 2024. At that time, multiple residents spoke about the
project, prompting council to table the discussion and decision until more public input could be
gathered. Since then, staff have been gathering information from those affected via a mailing and
open house, and have concluded that there is greater support for the project with the addition of
bituminous curb and removal of concrete curb from the project scope. As a change from what
was previously presented, staff recommends utilitizing bituminous curb in order to reduce costs
and maintain the rural feel of the neighborhood.

This project is feasible from an engineering and economic standpoint. The Chapter 429 special
assessment statute requires a public hearing be conducted prior to proceeding with the project.
Approval of the resolution ordering the improvements requires a 4/5 vote.
FINANCIAL IMPACT:
The Martindale Henning Hickory Reclamation Project is proposed to be funded as follows:

Tax Levy $458,400
Utility Fund -Stormwater $150,000
SMSC Cost Share $48,600
Total $900,000
The previous assessment amount presented at the public hearing on July 23 rd was $9,500 per
parcel. The change from concrete curb and gutter to bituminous curb reduced the proposed
assessments by $1,400 per parcel.
