RELEASE OF DEVELOPMENT CONTRACT
WHEREAS, the City of Prior Lake, a Minnesota municipal corporation (“City”), Shepherd of
the Lake Lutheran Church a Minnesota Nonprofit Corporation (“SOLLC”), and Shepherd’s Path Senior
Housing, Inc. a Minnesota Nonprofit Corporation (“SPSH”) entered into that certain Development
Contract for Shepherds Path dated June 26, 2006 and recorded as Document No. 744390 in the Office
of the County Recorder Scott County, Minnesota on July 7, 2006 (the “Development Contract”); and
WHEREAS, the City, SOLLC, and SPSH entered into that certain Contract for Development of
Land as a Planned Unit Development in the City of Prior Lake, Minnesota, to be known as Shepherd’s
Path dated June 26, 2006 and recorded as Document No. 744391 in the Office of the County Recorder
Scott County, Minnesota on July 7, 2006 (the “PUD Development Contract”); and
WHEREAS, the City has confirmed that all work to be performed under the Development
Contract is complete; and
WHEREAS, the PUD Development Contract will continue and not be affected by the release or
termination of the Development Contract; and
WHEREAS, On November 26, 2024, the Prior Lake City Council agreed to terminate the
Development Contract.
NOW THEREFORE, the Development Contract is hereby terminated.
